EPA / Special edition No. 1 OJ EPO / Edition spéciale n° 1 JO OEB Artikel 148 Die europäische Patentanmeldung als Gegenstand des Vermögens (1) Artikel 74 ist anzuwenden, wenn die Gruppe von Vertragsstaaten nichts anderes bestimmt hat. (2) Die Gruppe von Vertragsstaaten kann vorschreiben, dass die europäische Patentanmeldung, soweit für sie diese Vertragsstaaten benannt sind, nur für alle diese Vertragsstaaten und nur nach den Vorschriften des besonderen Übereinkommens Gegenstand eines Rechtsübergangs sein sowie belastet oder Zwangsvollstreckungsmaßnahmen unterworfen werden kann. Artikel 149 Gemeinsame Benennung (1) Die Gruppe von Vertragsstaaten kann vorschreiben, dass ihre Benennung nur gemeinsam erfolgen kann und dass die Benennung eines oder mehrerer der Vertragsstaaten der Gruppe als Benennung aller dieser Vertragsstaaten gilt. (2) Ist das Europäische Patentamt nach Artikel 153 Absatz 1 Bestimmungsamt, so ist Absatz 1 anzuwenden, wenn der Anmelder in der internationalen Anmeldung mitgeteilt hat, dass er für einen oder mehrere der benannten Staaten der Gruppe ein europäisches Patent begehrt. Das Gleiche gilt, wenn der Anmelder in der internationalen Anmeldung einen dieser Gruppe angehörenden Vertragsstaat benannt hat, dessen Recht vorschreibt, dass eine Bestimmung dieses Staats die Wirkung einer Anmeldung für ein europäisches Patent hat. Artikel 149a Andere Übereinkommen zwischen den Vertragsstaaten (1) Dieses Übereinkommen lässt das Recht aller oder einiger Vertragsstaaten unberührt, besondere Übereinkommen über alle europäische Patentanmeldungen oder Patente betreffenden Fragen zu schließen, die nach diesem Übereinkommen nationalem Recht unterliegen und dort geregelt sind, wie insbesondere a) ein Übereinkommen über die Schaffung eines gemeinsamen europäischen Patentgerichts für die ihm angehörenden Vertragsstaaten; Article 148 The European patent application as an object of property (1) Article 74 shall apply unless the group of Contracting States has specified otherwise. (2) The group of Contracting States may provide that a European patent application for which these Contracting States are designated may only be transferred, mortgaged or subjected to any legal means of execution in respect of all the Contracting States of the group and in accordance with the provisions of the special agreement. Article 149 Joint designation (1) The group of Contracting States may provide that these States may only be designated jointly, and that the designation of one or some only of such States shall be deemed to constitute the designation of all the States of the group. (2) Where the European Patent Office acts as a designated Office under Article 153, paragraph 1, paragraph 1 shall apply if the applicant has indicated in the international application that he wishes to obtain a European patent for one or more of the designated States of the group. The same shall apply if the applicant designates in the international application one of the Contracting States in the group, whose national law provides that the designation of that State shall have the effect of the application being for a European patent. Article 149a Other agreements between the Contracting States (1) Nothing in this Convention shall be construed as limiting the right of some or all of the Contracting States to conclude special agreements on any matters concerning European patent applications or European patents which under this Convention are subject to and governed by national law, such as, in particular (a) an agreement establishing a European patent court common to the Contracting States party to it; Article 148 De la demande de brevet européen comme objet de propriété 2007 (1) L’article 74 est applicable lorsque le groupe d’Etats contractants n’a pas prévu d’autres dispositions. Article 149 Désignation conjointe (1)Legrouped’Etats contractants peut prescrire que la désignation des Etats du groupe ne peut se faire que conjointement et que la désignation d’un ou de plusieurs Etats dudit groupe vaut désignation de l’ensemble de ceuxci. (2) Lorsque l’Office européen des brevets est l’office désigné au sens de l’article 153, paragraphe 1, le paragraphe 1 du présent article est applicable si le demandeur fait connaître dans la demande internationale qu’il entend obtenir un brevet européen pour les Etats du groupe qu’il a désignés ou pour l’un d’entre eux seulement. La présente disposition est également applicable lorsque le demandeur a désigné dans la demande internationale un Etat contractant appartenant à ce groupe, si la législation de cet Etat prévoit qu’une désignation dudit Etat a les effets d’une demande de brevet européen. Article 149bis Autres accords entre les Etats contractants (1) La présente convention ne saurait être interprétée en ce sens qu’elle limite le droit de tous les Etats contractants ou de plusieurs d’entre eux de conclure des accords particuliers sur des questions relatives aux demandes de brevet européen ou aux brevets européens qui, en vertu de la présente convention, relèvent du droit national et sont régis par lui, comme notamment a) un accord portant création d’une juridiction des brevets européens commune aux Etats contractants parties audit accord ;

EPA / Special edition No. 1 OJ EPO / Edition spéciale n° 1 JO OEB 79 b) ein Übereinkommen über die Schaffung einer gemeinsamen Einrichtung für die ihm angehörenden Vertragsstaaten, die auf Ersuchen nationaler Gerichte oder gerichtsähnlicher Behörden Gutachten über Fragen des europäischen oder damit harmonisierten nationalen Patentrechts erstattet; c) ein Übereinkommen, dem zufolge die ihm angehörenden Vertragsstaaten auf Übersetzungen europäischer Patente nach Artikel 65 ganz oder teilweise verzichten; d) ein Übereinkommen, dem zufolge die ihm angehörenden Vertragsstaaten vorsehen, dass nach Artikel 65 vorgeschriebene Übersetzungen europäischer Patente beim Europäischen Patentamt eingereicht und von ihm veröffentlicht werden können. (2) Der Verwaltungsrat ist befugt zu beschließen, dass a) die Mitglieder der Beschwerdekammern oder der Großen Beschwerdekammer in einem europäischen Patentgericht oder einer gemeinsamen Einrichtung tätig werden und in Verfahren vor diesem Gericht oder dieser Einrichtung nach Maßgabe eines solchen Übereinkommens mitwirken dürfen; b) das Europäische Patentamt einer gemeinsamen Einrichtung das Unterstützungspersonal, die Räumlichkeiten und die Ausstattung zur Verfügung stellt, die sie zur Durchführung ihrer Aufgaben benötigt, und die Kosten dieser Einrichtung ganz oder teilweise von der Organisation getragen werden. ZEHNTER TEIL INTERNATIONALE ANMELDUNGEN NACH DEM VERTRAG ÜBER DIE INTERNATIONALE ZUSAMMEN- ARBEIT AUF DEM GEBIET DES PATENTWESENS – EUROPCT ANMELDUNGEN Artikel 150 Anwendung des Vertrags über die internationale Zusammenarbeit auf dem Gebiet des Patentwesens (1) Der Vertrag über die internationale Zusammenarbeit auf dem Gebiet des Patentwesens vom 19. Juni 1970, im folgenden PCT genannt, ist nach Maßgabe dieses Teils anzuwenden. (b) an agreement establishing an entity common to the Contracting States party to it to deliver, at the request of national courts or quasijudicial authorities, opinions on issues of European or harmonised national patent law; (c) an agreement under which the Contracting States party to it dispense fully or in part with translations of European patents under Article 65; (d) an agreement under which the Contracting States party to it provide that translations of European patents as required under Article 65 may be filed with, and published by, the European Patent Office. (2) The Administrative Council shall be competent to decide that: (a) the members of the Boards of Appeal or the Enlarged Board of Appeal may serve on a European patent court or a common entity and take part in proceedings before that court or entity in accordance with any such agreement; (b) the European Patent Office shall provide a common entity with such support staff, premises and equipment as may be necessary for the performance of its duties, and the expenses incurred by that entity shall be borne fully or in part by the Organisation. PART X INTERNATIONAL APPLICATIONS UNDER THE PATENT COOPERATION TREATY – EUROPCT APPLICATIONS Article 150 Application of the Patent Cooperation Treaty (1) The Patent Cooperation Treaty of 19 June 1970, hereinafter referred to as the PCT, shall be applied in accordance with the provisions of this Part. b) un accord portant création d’une entité commune aux Etats contractants parties audit accord qui donne, sur requête des juridictions ou autorités quasi judiciaires nationales, des avis sur des questions relatives au droit européen des brevets ou au droit national harmonisé avec celuici ; c) un accord aux termes duquel les Etats contractants parties audit accord renoncent en tout ou en partie aux traductions de brevets européens prévues à l’article 65 ; d) un accord aux termes duquel les Etats contractants parties audit accord prévoient que les traductions de brevets européens exigées conformément à l’article 65 peuvent être produites auprès de l’Office européen des brevets et publiées par celuici. (2) Le Conseil d’administration a compétence pour décider que a) les membres des chambres de recours ou de la Grande Chambre de recours peuvent faire partie d’une juridiction des brevets européens ou d’une entité commune et prendre part aux procédures engagées devant cette juridiction ou cette entité conformément à un tel accord ; b) l’Office européen des brevets fournit à une entité commune le personnel de soutien, les locaux et les moyens matériels nécessaires à l’accomplissement de sa mission, et que l’Organisation prendenchargeentoutouenpartieles frais liés à cette entité.
