Tag wirksam, an dem der Hinweis auf<br />
die Erteilung im Europäischen <strong>Patent</strong>blatt<br />
bekannt gemacht wird.<br />
Artikel 98<br />
Veröffentlichung der europäischen<br />
<strong>Patent</strong>schrift<br />
Das Europäische <strong>Patent</strong>amt veröffentlicht<br />
die europäische <strong>Patent</strong>schrift so<br />
bald wie möglich nach Bekanntmachung<br />
des Hinweises auf die Erteilung des<br />
europäischen <strong>Patent</strong>s im Europäischen<br />
<strong>Patent</strong>blatt.<br />
FÜNFTER TEIL<br />
EINSPRUCHS- UND<br />
BESCHRÄNKUNGSVERFAHREN<br />
Artikel 99<br />
Einspruch<br />
(1) Innerhalb von neun Monaten nach<br />
Bekanntmachung des Hinweises auf die<br />
Erteilung des europäischen <strong>Patent</strong>s im<br />
Europäischen <strong>Patent</strong>blatt kann jedermann<br />
nach Maßgabe der Ausführungsordnung<br />
beim Europäischen <strong>Patent</strong>amt<br />
gegen dieses <strong>Patent</strong> Einspruch einlegen.<br />
Der Einspruch gilt erst als eingelegt,<br />
wenn die Einspruchsgebühr<br />
entrichtet worden ist.<br />
(2) Der Einspruch erfasst das europäische<br />
<strong>Patent</strong> für alle Vertragsstaaten, in<br />
denen es Wirkung hat.<br />
(3) Am Einspruchsverfahren sind neben<br />
dem <strong>Patent</strong>inhaber die Einsprechenden<br />
beteiligt.<br />
(4) Weist jemand nach, dass er in einem<br />
Vertragsstaat aufgrund einer rechtskräftigen<br />
Entscheidung anstelle des bisherigen<br />
<strong>Patent</strong>inhabers in das <strong>Patent</strong>register<br />
dieses Staats eingetragen ist, so<br />
tritt er auf Antrag in Bezug auf diesen<br />
Staat an die Stelle des bisherigen<br />
<strong>Patent</strong>inhabers. Abweichend von Artikel<br />
118 gelten der bisherige <strong>Patent</strong>inhaber<br />
und derjenige, der sein Recht geltend<br />
macht, nicht als gemeinsame Inhaber,<br />
es sei denn, dass beide dies verlangen.<br />
(3) The decision to grant a <strong>European</strong><br />
patent shall take effect on the date on<br />
which the mention of the grant is<br />
published in the <strong>European</strong> <strong>Patent</strong><br />
Bulletin.<br />
Article 98<br />
Publication of the specification of the<br />
<strong>European</strong> patent<br />
The <strong>European</strong> <strong>Patent</strong> <strong>Office</strong> shall<br />
publish the specification of the <strong>European</strong><br />
patent as soon as possible after the<br />
mention of the grant of the <strong>European</strong><br />
patent has been published in the<br />
<strong>European</strong> <strong>Patent</strong> Bulletin.<br />
PART V<br />
OPPOSITION AND LIMITATION<br />
PROCEDURE<br />
Article 99<br />
Opposition<br />
(1) Within nine months of the publication<br />
of the mention of the grant of the<br />
<strong>European</strong> patent in the <strong>European</strong> <strong>Patent</strong><br />
Bulletin, any person may give notice to<br />
the <strong>European</strong> <strong>Patent</strong> <strong>Office</strong> of opposition<br />
to that patent, in accordance with the<br />
Implementing Regulations. Notice of<br />
opposition shall not be deemed to have<br />
been filed until the opposition fee has<br />
been paid.<br />
(2) The opposition shall apply to the<br />
<strong>European</strong> patent in all the Contracting<br />
States in which that patent has effect.<br />
(3) Opponents shall be parties to the<br />
opposition proceedings as well as the<br />
proprietor of the patent.<br />
(4) Where a person provides evidence<br />
that in a Contracting State, following a<br />
final decision, he has been entered in<br />
the patent register of such State instead<br />
of the previous proprietor, such person<br />
shall, at his request, replace the previous<br />
proprietor in respect of such State.<br />
Notwithstanding Article 118, the previous<br />
proprietor and the person making the<br />
request shall not be regarded as joint<br />
proprietors unless both so request.<br />
(3) La décision relative à la délivrance<br />
du brevet européen prend effet à la date<br />
à laquelle la mention de la délivrance est<br />
publiée au Bulletin européen des<br />
brevets.<br />
Article 98<br />
Publication du fascicule du brevet européen<br />
L’<strong>Office</strong> européen des brevets publie le<br />
fascicule du brevet européen dès que<br />
possible après la publication de la<br />
mention de la délivrance du brevet européen<br />
au Bulletin européen des brevets.<br />
CINQUIEME PARTIE<br />
PROCEDURE D’OPPOSITION<br />
ET DE LIMITATION<br />
Article 99<br />
Opposition<br />
(1) Dans un délai de neuf mois à<br />
compter de la publication de la mention<br />
de la délivrance du brevet européen au<br />
Bulletin européen des brevets, toute<br />
personne peut faire opposition à ce<br />
brevet auprès de l’<strong>Office</strong> européen des<br />
brevets, conformément au règlement<br />
d’exécution. L’opposition n’est réputée<br />
formée qu’après le paiement de la taxe<br />
d’opposition.<br />
(2) L’opposition au brevet européen<br />
affecte ce brevet dans tous les Etats<br />
contractants dans lesquels il produit ses<br />
effets.<br />
(3) Les opposants sont parties, avec le<br />
titulaire du brevet, à la procédure d’opposition.<br />
(4) Si une personne apporte la preuve<br />
que, dans un Etat contractant, elle est<br />
inscrite au registre des brevets, en vertu<br />
d’une décision passée en force de chose<br />
jugée, au lieu et place du titulaire précédent,<br />
elle est, sur requête, substituée à<br />
ce dernier pour ledit Etat. Nonobstant<br />
l’article 118, le titulaire précédent du<br />
brevet et la personne qui fait ainsi valoir<br />
ses droits ne sont pas considérés<br />
comme copropriétaires, à moins qu’ils<br />
ne demandent tous deux à l’être.
