(4) Als die erste Anmeldung, von deren<br />
Einreichung an die Prioritätsfrist läuft,<br />
wird auch eine jüngere Anmeldung<br />
angesehen, die denselben Gegenstand<br />
betrifft wie eine erste ältere in demselben<br />
oder für denselben Staat eingereichte<br />
Anmeldung, sofern diese ältere Anmeldung<br />
bis zur Einreichung der jüngeren<br />
Anmeldung zurückgenommen, fallen<br />
gelassen oder zurückgewiesen worden<br />
ist, und zwar bevor sie öffentlich ausgelegt<br />
worden ist und ohne dass Rechte<br />
bestehen geblieben sind; ebenso wenig<br />
darf diese ältere Anmeldung schon<br />
Grundlage für die Inanspruchnahme des<br />
Prioritätsrechts gewesen sein. Die ältere<br />
Anmeldung kann in diesem Fall nicht<br />
mehr als Grundlage für die Inanspruchnahme<br />
des Prioritätsrechts dienen.<br />
(5) Ist die erste Anmeldung bei einer<br />
nicht der Pariser Verbandsübereinkunft<br />
zum Schutz des gewerblichen Eigentums<br />
oder dem Übereinkommen zur<br />
Errichtung der Welthandelsorganisation<br />
unterliegenden Behörde für den gewerblichen<br />
Rechtsschutz eingereicht worden,<br />
so sind die Absätze 1 bis 4 anzuwenden,<br />
wenn diese Behörde nach einer<br />
Bekanntmachung des Präsidenten des<br />
Europäischen <strong>Patent</strong>amts anerkennt,<br />
dass eine erste Anmeldung beim Europäischen<br />
<strong>Patent</strong>amt ein Prioritätsrecht<br />
unter Voraussetzungen und mit<br />
Wirkungen begründet, die denen der<br />
Pariser Verbandsübereinkunft<br />
vergleichbar sind.<br />
Artikel 88<br />
Inanspruchnahme der Priorität<br />
(1) Der Anmelder, der die Priorität einer<br />
früheren Anmeldung in Anspruch nehmen<br />
will, hat eine Prioritätserklärung<br />
und weitere erforderliche Unterlagen<br />
nach Maßgabe der Ausführungsordnung<br />
einzureichen.<br />
(2) Für eine europäische <strong>Patent</strong>anmeldung<br />
können mehrere Prioritäten in<br />
Anspruch genommen werden, selbst<br />
wenn sie aus verschiedenen Staaten<br />
stammen. Für einen <strong>Patent</strong>anspruch<br />
können mehrere Prioritäten in Anspruch<br />
genommen werden. Werden mehrere<br />
Prioritäten in Anspruch genommen, so<br />
beginnen Fristen, die vom Prioritätstag<br />
an laufen, vom frühesten Prioritätstag an<br />
zu laufen.<br />
(4) A subsequent application in respect<br />
of the same subjectmatter as a previous<br />
first application and filed in or for the<br />
same State shall be considered as the<br />
first application for the purposes of determining<br />
priority, provided that, at the date<br />
of filing the subsequent application, the<br />
previous application has been withdrawn,<br />
abandoned or refused, without<br />
being open to public inspection and<br />
without leaving any rights outstanding,<br />
and has not served as a basis for<br />
claiming a right of priority. The previous<br />
application may not thereafter serve as a<br />
basis for claiming a right of priority.<br />
(5) If the first filing has been made with<br />
an industrial property authority which is<br />
not subject to the Paris Convention for<br />
the Protection of Industrial Property or<br />
the Agreement Establishing the World<br />
Trade Organization, paragraphs 1 to 4<br />
shall apply if that authority, according to<br />
a communication issued by the President<br />
of the <strong>European</strong> <strong>Patent</strong> <strong>Office</strong>,<br />
recognises that a first filing made with<br />
the <strong>European</strong> <strong>Patent</strong> <strong>Office</strong> gives rise to<br />
a right of priority under conditions and<br />
with effects equivalent to those laid down<br />
in the Paris Convention.<br />
Article 88<br />
Claiming priority<br />
(1) An applicant desiring to take advantage<br />
of the priority of a previous application<br />
shall file a declaration of priority<br />
and any other document required, in<br />
accordance with the Implementing<br />
Regulations.<br />
(2) Multiple priorities may be claimed in<br />
respect of a <strong>European</strong> patent application,<br />
notwithstanding the fact that they<br />
originated in different countries. Where<br />
appropriate, multiple priorities may be<br />
claimed for any one claim. Where<br />
multiple priorities are claimed, time limits<br />
which run from the date of priority shall<br />
run from the earliest date of priority.<br />
(4) Est considérée comme première<br />

antérieure ne peut plus alors servir de<br />
base pour la revendication du droit de<br />
priorité.<br />
(5) Si le premier dépôt a été effectué<br />
auprès d’un service de la propriété<br />
industrielle qui n’est pas lié par la<br />
Convention de Paris pour la protection<br />
de la propriété industrielle ou par<br />
l’Accord instituant l’Organisation<br />
mondiale du commerce, les paragraphes1à4s’appliquent<br />
si, suivant une<br />
communication émanant du Président<br />
de l’<strong>Office</strong> européen des brevets, ce<br />
service reconnaît qu’un premier dépôt<br />
effectué auprès de l’<strong>Office</strong> européen des<br />
brevets donne naissance à un droit de<br />
priorité soumis à des conditions et ayant<br />
des effets équivalents à ceux prévus par<br />
la Convention de Paris.<br />
Article 88<br />
Revendication de priorité<br />
(1) Le demandeur qui veut se prévaloir<br />
de la priorité d’un dépôt antérieur est<br />
tenu de produire une déclaration de priorité<br />
et tout autre document exigé, conformément<br />
au règlement d’exécution.<br />
(2) Des priorités multiples peuvent être<br />
revendiquées pour une demande de<br />
brevet européen même si elles proviennent<br />
d’Etats différents. Le cas échéant,<br />
des priorités multiples peuvent être<br />
revendiquées pour une même revendication.<br />
Si des priorités multiples sont<br />
revendiquées, les délais qui ont pour<br />
point de départ la date de priorité sont<br />
calculés à compter de la date de la priorité<br />
la plus ancienne.
