Artikel 86<br />
Jahresgebühren für die europäische<br />
<strong>Patent</strong>anmeldung<br />

(1) Für die europäische <strong>Patent</strong>anmeldung<br />
sind nach Maßgabe der Ausführungsordnung<br />
Jahresgebühren an das<br />
Europäische <strong>Patent</strong>amt zu entrichten.<br />
Sie werden für das dritte und jedes<br />
weitere Jahr, gerechnet vom Anmeldetag<br />
an, geschuldet. Wird eine Jahresgebühr<br />
nicht rechtzeitig entrichtet, so gilt<br />
die Anmeldung als zurückgenommen.<br />
(2) Die Verpflichtung zur Zahlung von<br />
Jahresgebühren endet mit der Zahlung<br />
der Jahresgebühr, die für das Jahr fällig<br />
ist, in dem der Hinweis auf die Erteilung<br />
des europäischen <strong>Patent</strong>s im Europäischen<br />
<strong>Patent</strong>blatt bekannt gemacht<br />
wird.<br />
Kapitel II<br />
Priorität<br />
Artikel 87<br />
Prioritätsrecht<br />
(1) Jedermann, der in einem oder mit<br />
Wirkung für<br />
a) einen Vertragsstaat der Pariser<br />
Verbandsübereinkunft zum Schutz des<br />
gewerblichen Eigentums oder<br />
b) ein Mitglied der Welthandelsorganisation<br />
eine Anmeldung für ein <strong>Patent</strong>, ein<br />
Gebrauchsmuster oder ein Gebrauchszertifikat<br />
vorschriftsmäßig eingereicht<br />
hat, oder sein Rechtsnachfolger genießt<br />
für die Anmeldung derselben Erfindung<br />
zum europäischen <strong>Patent</strong> während einer<br />
Frist von zwölf Monaten nach dem<br />
Anmeldetag der ersten Anmeldung ein<br />
Prioritätsrecht.<br />
(2) Als prioritätsbegründend wird jede<br />
Anmeldung anerkannt, der nach dem<br />
nationalen Recht des Staats, in dem die<br />
Anmeldung eingereicht worden ist, oder<br />
nach zwei oder mehrseitigen Verträgen<br />
unter Einschluss dieses Übereinkommens<br />
die Bedeutung einer vorschriftsmäßigen<br />
nationalen Anmeldung<br />
zukommt.<br />
(3) Unter vorschriftsmäßiger nationaler<br />
Anmeldung ist jede Anmeldung zu<br />
verstehen, die zur Festlegung des Tags<br />
ausreicht, an dem die Anmeldung eingereicht<br />
worden ist, wobei das spätere<br />
Schicksal der Anmeldung ohne Bedeutung<br />
ist.<br />
Article 86<br />
Renewal fees for the <strong>European</strong> patent<br />
application<br />
(1) Renewal fees for the <strong>European</strong><br />
patent application shall be paid to the<br />
<strong>European</strong> <strong>Patent</strong> <strong>Office</strong> in accordance<br />
with the Implementing Regulations.<br />
These fees shall be due in respect of the<br />
third year and each subsequent year,<br />
calculated from the date of filing of the<br />
application. If a renewal fee is not paid in<br />
due time, the application shall be<br />
deemed to be withdrawn.<br />
(2) The obligation to pay renewal fees<br />
shall terminate with the payment of the<br />
renewal fee due in respect of the year in<br />
which the mention of the grant of the<br />
<strong>European</strong> patent is published in the<br />
<strong>European</strong> <strong>Patent</strong> Bulletin.<br />
Chapter II<br />
Priority<br />
Article 87<br />
Priority right<br />
(1) Any person who has duly filed, in or<br />
for<br />
(a) any State party to the Paris Convention<br />
for the Protection of Industrial<br />
Property or<br />
(b) any Member of the World Trade<br />
Organization, an application for a patent,<br />
a utility model or a utility certificate, or<br />
his successor in title, shall enjoy, for the<br />
purpose of filing a <strong>European</strong> patent<br />
application in respect of the same invention,<br />
a right of priority during a period of<br />
twelve months from the date of filing of<br />
the first application.<br />
(2) Every filing that is equivalent to a<br />
regular national filing under the national<br />
law of the State where it was made or<br />
under bilateral or multilateral agreements,<br />
including this Convention, shall<br />
be recognised as giving rise to a right of<br />
priority.<br />
(3) A regular national filing shall mean<br />
any filing that is sufficient to establish the<br />
date on which the application was filed,<br />
whatever the outcome of the application<br />
may be.<br />
Article 86<br />
Taxes annuelles pour la demande de<br />
brevet européen<br />
2007<br />
(1) Des taxes annuelles doivent, conformément<br />
au règlement d’exécution, être<br />
payées à l’<strong>Office</strong> européen des brevets<br />
pour toute demande de brevet européen.<br />
Ces taxes sont dues pour la troisième<br />
année, à compter de la date de<br />
dépôt de la demande, et pour chacune<br />
des années suivantes. Si une taxe<br />
annuelle n’a pas été acquittée dans les<br />
délais, la demande est réputée retirée.<br />
(2) Aucune taxe annuelle n’est exigible<br />
après le paiement de celle qui doit être<br />
acquittée au titre de l’année au cours de<br />
laquelle la mention de la délivrance du<br />
brevet européen est publiée au Bulletin<br />
européen des brevets.<br />
Chapitre II<br />
Priorité<br />
Article 87<br />
Droit de priorité<br />
(1) Celui qui a régulièrement déposé,<br />
dans ou pour<br />
a) un Etat partie à la Convention de<br />
Paris pour la protection de la propriété<br />
industrielle ou<br />
b) un membre de l’Organisation<br />
mondiale du commerce, une demande<br />
de brevet d’invention, de modèle d’utilité<br />
ou de certificat d’utilité, ou son ayant<br />
cause, jouit, pour effectuer le dépôt<br />
d’une demande de brevet européen pour<br />
la même invention, d’un droit de priorité<br />
pendant un délai de douze mois à<br />
compter de la date de dépôt de la<br />
première demande.<br />
(2) Est reconnu comme donnant naissance<br />
au droit de priorité tout dépôt<br />
ayant la valeur d’un dépôt national régulier<br />
en vertu de la législation nationale de<br />
l’Etat dans lequel il a été effectué ou<br />
d’accords bilatéraux ou multilatéraux, y<br />
compris la présente convention.<br />
(3) Par dépôt national régulier, on doit<br />
entendre tout dépôt qui suffit à établir la<br />
date à laquelle la demande a été<br />
déposée, quel que soit le sort ultérieur<br />
de cette demande.
