(2) Jeder Vertragsstaat, der eine<br />
Vorschrift nach Absatz 1 erlassen hat,<br />
kann vorschreiben, dass der <strong>Patent</strong>inhaber<br />
innerhalb einer von diesem<br />
Staat bestimmten Frist die Kosten für<br />
eine Veröffentlichung der Übersetzung<br />
ganz oder teilweise zu entrichten hat.<br />
(3) Jeder Vertragsstaat kann vorschreiben,<br />
dass im Fall der Nichtbeachtung<br />
einer nach den Absätzen 1 und<br />
2 erlassenen Vorschrift die Wirkungen<br />
des europäischen <strong>Patent</strong>s in diesem<br />
Staat als von Anfang an nicht eingetreten<br />
gelten.<br />
Artikel 66<br />
Wirkung der europäischen <strong>Patent</strong>anmeldung<br />
als nationale Anmeldung<br />
Eine europäische <strong>Patent</strong>anmeldung, der<br />
ein Anmeldetag zuerkannt worden ist,<br />
hat in den benannten Vertragsstaaten<br />
die Wirkung einer vorschriftsmäßigen<br />
nationalen Anmeldung, gegebenenfalls<br />
mit der für die europäische <strong>Patent</strong>anmeldung<br />
in Anspruch genommenen<br />
Priorität.<br />
Artikel 67<br />
Rechte aus der europäischen <strong>Patent</strong>anmeldung<br />
nach Veröffentlichung<br />
(1) Die europäische <strong>Patent</strong>anmeldung<br />
gewährt dem Anmelder vom Tag ihrer<br />
Veröffentlichung an in den benannten<br />
Vertragsstaaten einstweilen den Schutz<br />
nach Artikel 64.<br />
(2) Jeder Vertragsstaat kann vorsehen,<br />
dass die europäische <strong>Patent</strong>anmeldung<br />
nicht den Schutz nach Artikel 64<br />
gewährt. Der Schutz, der mit der Veröffentlichung<br />
der europäischen <strong>Patent</strong>anmeldung<br />
verbunden ist, darf jedoch nicht<br />
geringer sein als der Schutz, der sich<br />
aufgrund des Rechts des betreffenden<br />
Staats aus der zwingend vorgeschriebenen<br />
Veröffentlichung der ungeprüften<br />
nationalen <strong>Patent</strong>anmeldungen ergibt.<br />
Zumindest hat jeder Vertragsstaat vorzusehen,<br />
dass der Anmelder für die Zeit<br />
von der Veröffentlichung der europäischen<br />
<strong>Patent</strong>anmeldung an von demjenigen,<br />
der die Erfindung in diesem<br />
Vertragsstaat unter Voraussetzungen<br />
benutzt hat, die nach dem nationalen<br />
Recht im Fall der Verletzung eines nationalen<br />
<strong>Patent</strong>s sein Verschulden begründen<br />
würden, eine den Umständen nach<br />
angemessene Entschädigung verlangen<br />
kann.<br />
(2) Any Contracting State which has<br />
adopted provisions pursuant to paragraph<br />
1 may prescribe that the proprietor<br />
of the patent must pay all or part of the<br />
costs of publication of such translation<br />
within a period laid down by that State.<br />
(3) Any Contracting State may prescribe<br />
that in the event of failure to observe the<br />
provisions adopted in accordance with<br />
paragraphs 1 and 2, the <strong>European</strong><br />
patent shall be deemed to be void ab<br />
initio in that State.<br />
Article 66<br />
Equivalence of <strong>European</strong> filing with<br />
national filing<br />
A <strong>European</strong> patent application which<br />
has been accorded a date of filing shall,<br />
in the designated Contracting States, be<br />
equivalent to a regular national filing,<br />
where appropriate with the priority<br />
claimed for the <strong>European</strong> patent application.<br />
Article 67<br />
Rights conferred by a <strong>European</strong> patent<br />
application after publication<br />
(1) A <strong>European</strong> patent application shall,<br />
from the date of its publication, provisionally<br />
confer upon the applicant the protection<br />
provided for by Article 64, in the<br />
Contracting States designated in the<br />
application.<br />
(2) Any Contracting State may prescribe<br />
that a <strong>European</strong> patent application shall<br />
not confer such protection as is<br />
conferred by Article 64. However, the<br />
protection attached to the publication of<br />
the <strong>European</strong> patent application may not<br />
be less than that which the laws of the<br />
State concerned attach to the compulsory<br />
publication of unexamined national<br />
patent applications. In any event, each<br />
State shall ensure at least that, from the<br />
date of publication of a <strong>European</strong> patent<br />
application, the applicant can claim<br />
compensation reasonable in the circumstances<br />
from any person who has used<br />
the invention in that State in circumstances<br />
where that person would be<br />
liable under national law for infringement<br />
of a national patent.<br />
(2) Tout Etat contractant qui a adopté<br />
des dispositions en vertu du paragraphe<br />
1 peut prescrire que le titulaire<br />
du brevet acquitte, dans un délai fixé<br />
par cet Etat, tout ou partie des frais de<br />
publication de la traduction.<br />
(3) Tout Etat contractant peut prescrire<br />
que, si les dispositions adoptées en<br />
vertu des paragraphes 1 et 2 ne sont<br />
pas observées, le brevet européen est,<br />
dès l’origine, réputé sans effet dans cet<br />
Etat.<br />
Article 66<br />
Valeur de dépôt national du dépôt<br />
européen<br />
La demande de brevet européen à<br />
laquelle une date de dépôt a été<br />
accordée a, dans les Etats contractants<br />
désignés, la valeur d’un dépôt national<br />
régulier, compte tenu, le cas échéant, du<br />
droit de priorité invoqué à l’appui de la<br />
demande de brevet européen.<br />
Article 67<br />
Droits conférés par la demande de<br />
brevet européen après sa publication<br />
(1) A compter de sa publication, la<br />
demande de brevet européen assure<br />
provisoirement au demandeur, dans<br />
les Etats contractants désignés dans<br />
la demande, la protection prévue à<br />
l’article 64.<br />
(2) Tout Etat contractant peut prévoir<br />
que la demande de brevet européen<br />
n’assure pas la protection prévue à<br />
l’article 64. Toutefois, la protection attachée<br />
à la publication de la demande de<br />
brevet européen ne peut être inférieure<br />
à celle que la législation de l’Etat considéré<br />
attache à la publication obligatoire<br />
des demandes de brevet national non<br />
examinées. En tout état de cause,<br />
chaque Etat contractant doit au moins<br />
prévoir qu’à partir de la publication de la<br />
demande de brevet européen, le demandeur<br />
peut exiger une indemnité raisonnable,<br />
fixée suivant les circonstances,<br />
de toute personne ayant exploité, dans<br />
cet Etat contractant, l’invention objet de<br />
la demande de brevet européen, dans<br />
des conditions qui, selon le droit<br />
national, mettraient en jeu sa responsabilité<br />
s’il s’agissait d’une contrefaçon<br />
d’un brevet national.
