e) die Art und Weise der Berechnung<br />
der nach Artikel 146 zu leistenden<br />
Beiträge;<br />
f) Zusammensetzung und Aufgaben<br />
eines Haushalts und Finanzausschusses,<br />
der vom Verwaltungsrat<br />
eingesetzt werden soll;<br />
g) die dem Haushaltsplan und dem<br />
Jahresabschluss zugrunde zu legenden<br />
allgemein anerkannten Rechnungslegungsgrundsätze.<br />
Artikel 51<br />
Gebühren<br />
(1) Das Europäische <strong>Patent</strong>amt kann<br />
Gebühren für die nach diesem Übereinkommen<br />
durchgeführten amtlichen<br />
Aufgaben und Verfahren erheben.<br />
(2) Fristen für die Entrichtung von<br />
Gebühren, die nicht bereits im Übereinkommen<br />
bestimmt sind, werden in der<br />
Ausführungsordnung festgelegt.<br />
(3) Sieht die Ausführungsordnung vor,<br />
dass eine Gebühr zu entrichten ist, so<br />
werden dort auch die Rechtsfolgen ihrer<br />
nicht rechtzeitigen Entrichtung festgelegt.<br />
(4) Die Gebührenordnung bestimmt<br />
insbesondere die Höhe der Gebühren<br />
und die Art und Weise, wie sie zu<br />
entrichten sind.<br />
ZWEITER TEIL<br />
MATERIELLES PATENTRECHT<br />
Kapitel I<br />
<strong>Patent</strong>ierbarkeit<br />
Artikel 52<br />
<strong>Patent</strong>ierbare Erfindungen<br />
(1) Europäische <strong>Patent</strong>e werden für<br />
Erfindungen auf allen Gebieten der<br />
Technik erteilt, sofern sie neu sind, auf<br />
einer erfinderischen Tätigkeit beruhen<br />
und gewerblich anwendbar sind.<br />
(2) Als Erfindungen im Sinne des<br />
Absatzes 1 werden insbesondere nicht<br />
angesehen:<br />
a) Entdeckungen, wissenschaftliche<br />
Theorien und mathematische Methoden;<br />
b) ästhetische Formschöpfungen;<br />
c) Pläne, Regeln und Verfahren für<br />
gedankliche Tätigkeiten, für Spiele oder<br />
für geschäftliche Tätigkeiten sowie<br />
Programme für Datenverarbeitungsanlagen;<br />
(e) the method of calculating the contributions<br />
payable by virtue of Article 146;<br />
(f) the composition of and duties to be<br />
assigned to a Budget and Finance<br />
Committee which should be set up by<br />
the Administrative Council;<br />
(g) the generally accepted accounting<br />
principles on which the budget and the<br />
annual financial statements shall be<br />
based.<br />
Article 51<br />
Fees<br />
(1) The <strong>European</strong> <strong>Patent</strong> <strong>Office</strong> may levy<br />
fees for any official task or procedure<br />
carried out under this Convention.<br />
(2) Time limits for the payment of fees<br />
other than those fixed by this Convention<br />
shall be laid down in the Implementing<br />
Regulations.<br />
(3) Where the Implementing Regulations<br />
provide that a fee shall be paid, they<br />
shall also lay down the legal consequences<br />
of failure to pay such fee in due<br />
time.<br />
(4) The Rules relating to Fees shall<br />
determine in particular the amounts of<br />
the fees and the ways in which they are<br />
to be paid.<br />
PART II<br />
SUBSTANTIVE PATENT LAW<br />
Chapter I<br />
<strong>Patent</strong>ability<br />
Article 52<br />
<strong>Patent</strong>able inventions<br />
(1) <strong>European</strong> patents shall be granted<br />
for any inventions, in all fields of technology,<br />
provided that they are new,<br />
involve an inventive step and are<br />
susceptible of industrial application.<br />
(2) The following in particular shall not<br />
be regarded as inventions within the<br />
meaning of paragraph 1:<br />
(a) discoveries, scientific theories and<br />
mathematical methods;<br />
(b) aesthetic creations;<br />
(c) schemes, rules and methods for<br />
performing mental acts, playing games<br />
or doing business, and programs for<br />
computers;<br />
e) les modalités de calcul des contributions<br />
à verser au titre de l’article 146 ;<br />
f) la composition et les tâches d’une<br />
commission du budget et des finances<br />
qui devrait être instituée par le Conseil<br />
d’administration ;<br />
g) les principes comptables généralement<br />
admis sur lesquels se fondent le<br />
budget et les états financiers annuels.<br />
Article 51<br />
Taxes<br />
(1) L’<strong>Office</strong> européen des brevets peut<br />
percevoir des taxes pour toute tâche ou<br />
procédure officielle exécutée en vertu de<br />
la présente convention.<br />
(2) Les délais de paiement des taxes<br />
autres que ceux fixés par la présente<br />
convention sont prévus dans le règlement<br />
d’exécution.<br />
(3) Lorsque le règlement d’exécution<br />
prescrit le paiement d’une taxe, il prévoit<br />
également les conséquences juridiques<br />
du défaut de paiement dans les délais.<br />
(4) Le règlement relatif aux taxes fixe<br />
notamment le montant des taxes et leur<br />
mode de perception.<br />
DEUXIEME PARTIE<br />
DROIT DES BREVETS<br />
Chapitre I<br />
Brevetabilité<br />
Article 52<br />
Inventions brevetables<br />
(1) Les brevets européens sont délivrés<br />
pour toute invention dans tous les<br />
domaines technologiques, à condition<br />
qu’elle soit nouvelle, qu’elle implique une<br />
activité inventive et qu’elle soit susceptible<br />
d’application industrielle.<br />
(2) Ne sont pas considérés comme des<br />
inventions au sens du paragraphe 1<br />
notamment :<br />
a) les découvertes, les théories scientifiques<br />
et les méthodes mathématiques ;<br />
b) les créations esthétiques ;<br />
c) les plans, principes et méthodes dans<br />
l’exercice d’activités intellectuelles, en<br />
matière de jeu ou dans le domaine des<br />
activités économiques, ainsi que les<br />
programmes d’ordinateur ;
