196 Übergangsbestimmungen Artikel 7 der Akte zur Revision des EPÜ vom 29. November 2000 Artikel 7 Übergangsbestimmungen Sonderausgabe Nr. 1 ABl. EPA / Special edition No. 1 OJ EPO / Edition spéciale n° 1 JO OEB (1) Die revidierte Fassung des Übereinkommens findet auf alle nach ihrem Inkrafttreten eingereichten europäischen Patentanmeldungen und die darauf erteilten Patente Anwendung. Sie findet nicht auf die bei ihrem Inkrafttreten bereits erteilten europäischen Patente und auf europäische Patentanmeldungen Anwendung, die in diesem Zeitpunkt anhängig sind, soweit der Verwaltungsrat der Europäischen Patentorganisation nichts anderes bestimmt. (2) Der Verwaltungsrat der Europäischen Patentorganisation fasst spätestens am 30. Juni 2001 einen Beschluss nach Absatz 1 mit Dreiviertelmehrheit der vertretenen Vertragsstaaten, die eine Stimme abgeben. Ein solcher Beschluss wird Bestandteil dieser Revisionsakte. Transitional provisions Article 7 of the Act revising the EPC of 29 November 2000 Article 7 Transitional provisions (1) The revised version of the Convention shall apply to all European patent applications filed after its entry into force, as well as to all patents granted in respect of such applications. It shall not apply to European patents already granted at the time of its entry into force, or to European patent applications pending at that time, unless otherwise decided by the Administrative Council of the European Patent Organisation. (2) The Administrative Council of the European Patent Organisation shall take a decision under paragraph 1 no later than 30 June 2001, by a majority of three quarters of the Contracting States represented and voting. Such decision shall become an integral part of this Revision Act. Dispositions transitoires 2007 Article7del’acte portant révision de la CBE en date du 29 novembre 2000 Article 7 Dispositions transitoires (1) Le texte révisé de la convention s’applique à toutes les demandes de brevet européen déposées après son entrée en vigueur et aux brevets européens délivrés sur la base de ces demandes. Il ne s’applique pas aux brevets européens déjà délivrés lors de son entrée en vigueur, ni aux demandes de brevet européen qui sont pendantes à cette date, à moins que le Conseil d’administration de l’Organisation européenne des brevets n’en dispose autrement. (2) Le Conseil d’administration de l’Organisation européenne des brevets prend unedécisionconformémentauparagraphe 1 le 30 juin 2001 au plus tard, à la majorité des trois quarts des Etats contractants représentés et votants. Cette décision devient partie intégrante du présent acte de révision.

Juni 2001 über die Übergangsbestimmungen nach Artikel 7 der Akte zur Revision des Europäischen Patentübereinkommens vom 29. November 2000 DER VERWALTUNGSRAT DER EURO- PÄISCHEN PATENTORGANISATION, gestützt auf Artikel 7 Absatz 2 der Akte zur Revision des Europäischen Patentübereinkommens vom 29. November 2000 ("Revisionsakte"), auf Vorschlag des Präsidenten des Europäischen Patentamts, nach Stellungnahme des Ausschusses "Patentrecht", BESCHLIESST: Artikel 1 Gemäß Artikel 7 Absatz 1 Satz 2 der Revisionsakte gilt für die nachgenannten geänderten und neuen Bestimmungen des Europäischen Patentübereinkommens die folgende Übergangsregelung: 1. Die Artikel 14 (3)-(6), 51, 52, 53, 54 (3) und (4), 61, 67, 68, 69 und das Protokoll über die Auslegung des Artikels 69, sowie die Artikel 70, 86, 88, 90, 92, 93, 94, 97, 98, 106, 108, 110, 115, 117, 119, 120, 123, 124, 127, 128, 129, 133, 135, 137 und 141 sind auf die bei ihrem Inkrafttreten anhängigen europäischen Patentanmeldungen und bereits erteilten europäischen Patente anzuwenden. Jedoch ist Artikel 54 (4) der vor diesem Zeitpunkt geltenden Fassung des Übereinkommens auf diese Anmeldungen und Patente weiterhin anzuwenden. 2. Die Artikel 65, 99, 101, 103, 104, 105, 105a-c und 138 sind auf die bei ihrem Inkrafttreten bereits erteilten europäischen Patente sowie die europäischen Patente anzuwenden, die auf zu diesem Zeitpunkt anhängige europäische Patentanmeldungen erteilt werden. Decision of the Administrative Council of 28 June 2001 on the transitional provisions under Article 7 of the Act revising the European Patent Convention of 29 November 2000 THE ADMINISTRATIVE COUNCIL OF THE EUROPEAN PATENT ORGANISATION, Having regard to Article 7, paragraph 2, of the Act revising the European Patent Convention of 29 November 2000 ("Revision Act"), On a proposal from the President of the European Patent Office, Having regard to the opinion of the Committee on Patent Law, HAS DECIDED AS FOLLOWS: Article 1 In accordance with Article 7, paragraph 1, second sentence, of the Revision Act, the following transitional provisions shall apply to the amended and new provisions of the European Patent Convention specified below: 1. Articles 14(3) to (6), 51, 52, 53, 54(3) and (4), 61, 67, 68 and 69, the Protocol on the Interpretation of Article 69, and Articles 70, 86, 88, 90, 92, 93, 94, 97, 98, 106, 108, 110, 115, 117, 119, 120, 123, 124, 127, 128, 129, 133, 135, 137 and 141 shall apply to European patent applications pending at the time of their entry into force and to European patents already granted at that time. However, Article 54(4) of the version of the Convention in force before that time shall continue to apply to these applications and patents. 2. Articles 65, 99, 101, 103, 104, 105, 105a-c and 138 shall apply to European patents already granted at the time of their entry into force and to European patents granted in respect of European patent applications pending at that time. Décision du Conseil d’administration du 28 juin 2001 relative aux dispositions transitoires au titre de l’article 7 de l’Acte de révision de la Convention sur le brevet européen du 29 novembre 2000 LE CONSEIL D’ADMINISTRATION DE L’ORGANISATION EUROPEENNE DES BREVETS, vu l’article 7, paragraphe 2 de l’Acte de révision de la Convention sur le brevet européen du 29 novembre 2000 (ci-après dénommé "l’acte de révision"), sur proposition du Président de l’Office européen des brevets, vu l’avis du comité "Droit des brevets", DECIDE : Article premier Conformément à l’article 7, paragraphe 1, deuxième phrase de l’acte de révision, les dispositions transitoires suivantes s’appliquent aux dispositions modifiées et aux nouvelles dispositions de la Convention sur le brevet européen mentionnées ciaprès : 1. Les articles 14 (3) à (6), 51, 52, 53, 54 (3) et (4), 61, 67, 68, 69 et le protocole interprétatif de l’article 69, ainsi que les articles 70, 86, 88, 90, 92, 93, 94, 97, 98, 106, 108, 110, 115, 117, 119, 120, 123, 124, 127, 128, 129, 133, 135, 137 et 141 sont applicables aux demandes de brevet européen pendantes ainsi qu’aux brevets européens déjà délivrés àladatedeleurentréeenvigueur. Toutefois, l’article 54 (4) du texte de la convention en vigueur avant cette date continue de s’appliquer à ces demandes et brevets. 2. Les articles 65, 99, 101, 103, 104, 105, 105bis à quater, et 138 sont applicables aux brevets européens déjà délivrés à la date de leur entrée en vigueur ainsi qu’aux brevets européens délivrés pour des demandes de brevet européen pendantes à cette date.
