(6) Werden die in den Absätzen 1, 4 und<br />
5 genannten Mängel nicht rechtzeitig<br />
beseitigt, so wird die europäische<br />
<strong>Patent</strong>anmeldung zurückgewiesen. Wird<br />
der in Absatz 2 genannte Mangel nicht<br />
rechtzeitig beseitigt, so geht das Prioritätsrecht<br />
für die Anmeldung verloren.<br />
Regel 164<br />
Prüfung der Einheitlichkeit durch das<br />
Europäische <strong>Patent</strong>amt<br />
(1) Ist das Europäische <strong>Patent</strong>amt der<br />
Auffassung, dass die Anmeldungsunterlagen,<br />
die der ergänzenden Recherche<br />
zugrunde zu legen sind, den Anforderungen<br />
an die Einheitlichkeit der Erfindung<br />
nicht entsprechen, so wird ein<br />
ergänzender Recherchenbericht für die<br />
Teile der Anmeldung erstellt, die sich auf<br />
die zuerst in den <strong>Patent</strong>ansprüchen<br />
erwähnte Erfindung oder Gruppe von<br />
Erfindungen im Sinne des Artikels 82<br />
beziehen.<br />
(2) Stellt die Prüfungsabteilung fest,<br />
dass die Anmeldungsunterlagen, die<br />
dem europäischen Erteilungsverfahren<br />
zugrunde zu legen sind, den Anforderungen<br />
an die Einheitlichkeit der Erfindung<br />
nicht entsprechen oder dass<br />
Schutz für eine Erfindung begehrt wird,<br />
die im internationalen Recherchenbericht<br />
oder gegebenenfalls im ergänzenden<br />
Recherchenbericht nicht behandelt<br />
wurde, so fordert sie den Anmelder auf,<br />
die Anmeldung auf eine einzige Erfindung<br />
zu begrenzen, die im internationalen<br />
Recherchenbericht bzw. im<br />
ergänzenden Recherchenbericht<br />
behandelt wurde.<br />
Regel 165<br />
Die EuroPCTAnmeldung als kollidierende<br />
Anmeldung nach Artikel 54<br />
Absatz 3<br />
Eine EuroPCTAnmeldung gilt als Stand<br />
der Technik nach Artikel 54 Absatz 3,<br />
wenn die in Artikel 153 Absatz 3 oder 4<br />
festgelegten Voraussetzungen erfüllt<br />
sind und die Anmeldegebühr nach<br />
Regel 159 Absatz 1 c) entrichtet worden<br />
ist.<br />
(6) If the deficiencies noted under paragraphs<br />
1, 4 or 5 are not corrected in due<br />
time, the <strong>European</strong> patent application<br />
shall be refused. If the deficiency noted<br />
under paragraph 2 is not corrected in<br />
due time, the right of priority shall be lost<br />
for the application.<br />
Rule 164<br />
Consideration of unity by the <strong>European</strong><br />
<strong>Patent</strong> <strong>Office</strong><br />
(1) Where the <strong>European</strong> <strong>Patent</strong> <strong>Office</strong><br />
considers that the application documents<br />
which are to serve as the basis for the<br />
supplementary search do not meet the<br />
requirements of unity of invention, a<br />
supplementary search report shall be<br />
drawn up on those parts of the application<br />
which relate to the invention, or the<br />
group of inventions within the meaning<br />
of Article 82, first mentioned in the<br />
claims.<br />
(2) Where the examining division finds<br />
that the application documents on which<br />
the <strong>European</strong> grant procedure is to be<br />
based do not meet the requirements of<br />
unity of invention, or protection is sought<br />
for an invention not covered by the international<br />
search report or, as the case<br />
may be, by the supplementary search<br />
report, it shall invite the applicant to limit<br />
the application to one invention covered<br />
by the international search report or the<br />
supplementary search report.<br />
Rule 165<br />
The EuroPCT application as conflicting<br />
application under Article 54, paragraph 3<br />
A EuroPCT application shall be considered<br />
as comprised in the state of the<br />
art under Article 54, paragraph 3, if in<br />
addition to the conditions laid down in<br />
Article 153, paragraph 3 or 4, the filing<br />
fee under Rule 159, paragraph 1(c) has<br />
been paid.<br />
(6) Lorsqu’il n’est pas remédié aux<br />
irrégularités constatées au titre des<br />
paragraphes 1, 4 ou 5 dans les délais,<br />
la demande de brevet européen est<br />
rejetée. Lorsqu’il n’est pas remédié à<br />
l’irrégularité constatée au titre du paragraphe<br />
2 dans les délais, le droit de<br />
priorité est perdu pour la demande.<br />
Règle 164<br />
Examen de l’unité par l’<strong>Office</strong> européen<br />
des brevets<br />
(1) Si l’<strong>Office</strong> européen des brevets<br />
estime que les pièces de la demande<br />
qui doivent servir de base à la recherche<br />
complémentaire ne satisfont pas aux<br />
exigences d’unité d’invention, un rapport<br />
complémentaire de recherche est établi<br />
pour les parties de la demande qui se<br />
rapportent à l’invention, ou à la pluralité<br />
d’inventions au sens de l’article 82,<br />
mentionnée en premier lieu dans les<br />
revendications.<br />
(2) Si la division d’examen constate que<br />
les pièces de la demande sur lesquelles<br />
la procédure de délivrance européenne<br />
doit se fonder ne satisfont pas aux<br />
exigences d’unité d’invention, ou que la<br />
protection est demandée pour une<br />
invention qui n’est pas couverte par le<br />
rapport de recherche internationale ou,<br />
le cas échéant, par le rapport complémentaire<br />
de recherche, elle invite le<br />
demandeur à limiter la demande à une<br />
seule invention couverte par le rapport<br />
de recherche internationale ou par le<br />
rapport complémentaire de recherche.<br />
Règle 165<br />
La demande euroPCT en tant que<br />
demande interférente au sens de<br />
l’article 54, paragraphe 3<br />
Une demande euroPCT est considérée<br />
comme comprise dans l’état de la technique<br />
au sens de l’article 54, paragraphe<br />
3, si les conditions prévues à<br />
l’article 153, paragraphe 3 ou 4 sont<br />
remplies, et si la taxe de dépôt visée à la<br />
règle 159, paragraphe 1 c) a été payée.
