(3) Anspruchsgebühren, die innerhalb<br />
der Frist nach Absatz 1 entrichtet<br />
werden und die nach Absatz 2 Satz 2<br />
fälligen Gebühren übersteigen, werden<br />
zurückerstattet.<br />
(4) Wird eine Anspruchsgebühr nicht<br />
rechtzeitig entrichtet, so gilt dies als<br />
Verzicht auf den entsprechenden <strong>Patent</strong>anspruch.<br />
Regel 163<br />
Prüfung bestimmter Formerfordernisse<br />
durch das Europäische <strong>Patent</strong>amt<br />
(1) Sind die Angaben über den Erfinder<br />
nach Regel 19 Absatz 1 nicht innerhalb<br />
der Frist nach Regel 159 Absatz 1 mitgeteilt<br />
worden, so fordert das Europäische<br />
<strong>Patent</strong>amt den Anmelder auf, die<br />
Angaben innerhalb von zwei Monaten<br />
zu machen.<br />
(2) Wird die Priorität einer früheren<br />
Anmeldung in Anspruch genommen und<br />
ist das Aktenzeichen der früheren<br />
Anmeldung oder deren Abschrift nach<br />
Regel 52 Absatz 1 und Regel 53 nicht<br />
innerhalb der Frist nach Regel 159<br />
Absatz 1 eingereicht worden, so fordert<br />
das Europäische <strong>Patent</strong>amt den<br />
Anmelder auf, das Aktenzeichen oder<br />
die Abschrift innerhalb von zwei<br />
Monaten einzureichen. Regel 53<br />
Absätze 2 und 3 ist anzuwenden.<br />
(3) Liegt dem Europäischen <strong>Patent</strong>amt<br />
bei Ablauf der in Regel 159 Absatz 1<br />
genannten Frist ein dem Standard der<br />
Verwaltungsvorschriften zum PCT<br />
entsprechendes Sequenzprotokoll nicht<br />
vor, so wird der Anmelder aufgefordert,<br />
innerhalb von zwei Monaten ein<br />
Sequenzprotokoll einzureichen, das den<br />
vom Präsidenten des Europäischen<br />
<strong>Patent</strong>amts erlassenen Vorschriften<br />
entspricht. Regel 30 Absätze 2 und 3 ist<br />
entsprechend anzuwenden.<br />
(4) Liegt bei Ablauf der in Regel 159<br />
Absatz 1 genannten Frist die Anschrift,<br />
die Staatsangehörigkeit oder der Wohnsitz<br />
bzw. Sitz eines Anmelders nicht vor,<br />
so fordert das Europäische <strong>Patent</strong>amt<br />
den Anmelder auf, diese Angaben innerhalb<br />
von zwei Monaten nachzureichen.<br />
(5) Sind bei Ablauf der in Regel 159<br />
Absatz 1 genannten Frist die Erfordernisse<br />
des Artikels 133 Absatz 2 nicht<br />
erfüllt, so fordert das Europäische<br />
<strong>Patent</strong>amt den Anmelder auf, innerhalb<br />
von zwei Monaten einen zugelassenen<br />
Vertreter zu bestellen.<br />
(3) Any claims fees paid within the<br />
period under paragraph 1 and in excess<br />
of those due under paragraph 2, second<br />
sentence, shall be refunded.<br />
(4) Where a claims fee is not paid in due<br />
time, the claim concerned shall be<br />
deemed to be abandoned.<br />
Rule 163<br />
Examination of certain formal requirements<br />
by the <strong>European</strong> <strong>Patent</strong> <strong>Office</strong><br />
(1) Where the designation of the inventor<br />
under Rule 19, paragraph 1, has not yet<br />
been made within the period under Rule<br />
159, paragraph 1, the <strong>European</strong> <strong>Patent</strong><br />
<strong>Office</strong> shall invite the applicant to make<br />
the designation within two months.<br />
(2) Where the priority of an earlier application<br />
is claimed and the file number of<br />
the previous application or the copy<br />
thereof provided for in Rule 52, paragraph<br />
1, and Rule 53 have not yet been<br />
submitted within the period under Rule<br />
159, paragraph 1, the <strong>European</strong> <strong>Patent</strong><br />
<strong>Office</strong> shall invite the applicant to furnish<br />
that number or copy within two months.<br />
Rule 53, paragraphs 2 and 3, shall<br />
apply.<br />
(3) Where, at the expiry of the period<br />
under Rule 159, paragraph 1, a<br />
sequence listing complying with the<br />
standard provided for in the Administrative<br />
Instructions under the PCT is not<br />
available to the <strong>European</strong> <strong>Patent</strong> <strong>Office</strong>,<br />
the applicant shall be invited to file a<br />
sequence listing complying with the rules<br />
laid down by the President of the<br />
<strong>European</strong> <strong>Patent</strong> <strong>Office</strong> within two<br />
months. Rule 30, paragraphs 2 and 3,<br />
shall apply mutatis mutandis.<br />
(4) Where, at the expiry of the period<br />
under Rule 159, paragraph 1, the<br />
address, the nationality or the State in<br />
which his residence or principal place of<br />
business is located is missing in respect<br />
of any applicant, the <strong>European</strong> <strong>Patent</strong><br />
<strong>Office</strong> shall invite the applicant to furnish<br />
these indications within two months.<br />
(5) Where, at the expiry of the period<br />
under Rule 159, paragraph 1, the<br />
requirements of Article 133, paragraph<br />
2, have not been satisfied, the <strong>European</strong><br />
<strong>Patent</strong> <strong>Office</strong> shall invite the applicant to<br />
appoint a professional representative<br />
within two months.<br />
2007<br />
(3) Les taxes de revendication acquittées<br />
dans le délai prévu au paragraphe<br />
1 en sus de celles exigibles conformément<br />
au paragraphe 2, deuxième<br />
phrase, sont remboursées.<br />
(4) Si une taxe de revendication n’est<br />
pas acquittée dans les délais, la revendication<br />
correspondante est réputée<br />
abandonnée.<br />
Règle 163<br />
Examen de certaines conditions de<br />
forme par l’<strong>Office</strong> européen des brevets<br />
(1) Si la désignation de l’inventeur<br />
prévue à la règle 19, paragraphe 1, n’a<br />
pas été effectuée dans le délai prévu à<br />
la règle 159, paragraphe 1, l’<strong>Office</strong> européen<br />
des brevets invite le demandeur à<br />
effectuer cette désignation dans un délai<br />
de deux mois.<br />
(2) Si la priorité d’une demande antérieure<br />
est revendiquée et que le numéro<br />
de dépôt ou la copie de la demande<br />
antérieure prévus à la règle 52, paragraphe<br />
1, et à la règle 53 n’ont pas<br />
encore été produits dans le délai prévu<br />
à la règle 159, paragraphe 1, l’<strong>Office</strong><br />
européen des brevets invite le demandeur<br />
à produire ce numéro ou cette<br />
copie dans un délai de deux mois.<br />
La règle 53, paragraphes 2 et 3, est<br />
applicable.<br />
(3) Si, à l’expiration du délai prévu à la<br />
règle 159, paragraphe 1, un listage de<br />
séquences établi conformément à la<br />
norme fixée dans les Instructions administratives<br />
du PCT n’est pas parvenu à<br />
l’<strong>Office</strong> européen des brevets, le demandeur<br />
est invité à déposer dans un délai<br />
de deux mois un listage de séquences<br />
établi conformément aux règles arrêtées<br />
par le Président de l’<strong>Office</strong> européen des<br />
brevets. La règle 30, paragraphes 2 et 3,<br />
est applicable.<br />
(4) Si, à l’expiration du délai prévu à la<br />
règle 159, paragraphe 1, l’adresse, la<br />
nationalité, ou l’Etat du domicile ou du<br />
siège d’un demandeur font défaut,<br />
l’<strong>Office</strong> européen des brevets invite le<br />
demandeur à fournir ces indications<br />
dans un délai de deux mois.<br />
(5) Si, à l’expiration du délai prévu à la<br />
règle 159, paragraphe 1, il n’a pas été<br />
satisfait aux exigences de l’article 133,<br />
paragraphe 2, l’<strong>Office</strong> européen des<br />
brevets invite le demandeur à constituer<br />
un mandataire agréé dans un délai de<br />
deux mois.
