(2) Wird das Europäische <strong>Patent</strong>amt als<br />
Anmeldeamt nach dem PCT tätig, so ist<br />
die internationale Anmeldung in deutscher,<br />
englischer oder französischer<br />
Sprache einzureichen. Der Präsident<br />
des Europäischen <strong>Patent</strong>amts kann<br />
bestimmen, dass die internationale<br />
Anmeldung und dazugehörige Unterlagen<br />
in mehreren Stücken einzureichen<br />
sind.<br />
(3) Wird eine internationale Anmeldung<br />
bei einer Behörde eines Vertragsstaats<br />
zur Weiterleitung an das Europäische<br />
<strong>Patent</strong>amt als Anmeldeamt eingereicht,<br />
so hat der Vertragsstaat dafür zu sorgen,<br />
dass die Anmeldung beim Europäischen<br />
<strong>Patent</strong>amt spätestens zwei Wochen vor<br />
Ablauf des dreizehnten Monats nach<br />
ihrer Einreichung oder, wenn eine Priorität<br />
in Anspruch genommen wird, nach<br />
dem Prioritätstag eingeht.<br />
(4) Für die internationale Anmeldung ist<br />
die Übermittlungsgebühr innerhalb eines<br />
Monats nach Einreichung der Anmeldung<br />
zu entrichten.<br />
Regel 158<br />
Das Europäische <strong>Patent</strong>amt als Internationale<br />
Recherchenbehörde oder als mit<br />
der internationalen vorläufigen Prüfung<br />
beauftragte Behörde<br />
(1) Im Fall des Artikels 17 Absatz 3 a)<br />
PCT ist für jede weitere Erfindung, für<br />
die eine internationale Recherche durchzuführen<br />
ist, eine zusätzliche internationale<br />
Recherchengebühr zu entrichten.<br />
(2) Im Fall des Artikels 34 Absatz 3 a)<br />
PCT ist für jede weitere Erfindung, für<br />
die eine internationale vorläufige Prüfung<br />
durchzuführen ist, eine zusätzliche<br />
Gebühr für diese Prüfung zu entrichten.<br />
(3) Ist eine zusätzliche Gebühr unter<br />
Widerspruch entrichtet worden, so nimmt<br />
das Europäische <strong>Patent</strong>amt die Prüfung<br />
des Widerspruchs nach Regel 40.2 c)<br />
bis e) oder Regel 68.3 c) bis e) PCT<br />
vorbehaltlich der Zahlung der vorgeschriebenen<br />
Widerspruchsgebühr vor.<br />
Weitere Einzelheiten des Verfahrens<br />
bestimmt der Präsident des Europäischen<br />
<strong>Patent</strong>amts.<br />
(2) Where the <strong>European</strong> <strong>Patent</strong> <strong>Office</strong><br />
acts as a receiving <strong>Office</strong> under the<br />
PCT, the international application shall<br />
be filed in English, French or German.<br />
The President of the <strong>European</strong> <strong>Patent</strong><br />
<strong>Office</strong> may determine that the international<br />
application and any related item<br />
shall be filed in more than one copy.<br />
(3) If an international application is filed<br />
with an authority of a Contracting State<br />
for transmittal to the <strong>European</strong> <strong>Patent</strong><br />
<strong>Office</strong> as the receiving <strong>Office</strong>, the<br />
Contracting State shall ensure that the<br />
application reaches the <strong>European</strong> <strong>Patent</strong><br />
<strong>Office</strong> not later than two weeks before<br />
the end of the thirteenth month from filing<br />
or, if priority is claimed, from the date of<br />
priority.<br />
(4) The transmittal fee for the international<br />
application shall be paid within one<br />
month of filing the application.<br />
Rule 158<br />
The <strong>European</strong> <strong>Patent</strong> <strong>Office</strong> as an International<br />
Searching Authority or International<br />
Preliminary Examining Authority<br />
(1) In the case of Article 17, paragraph 3(a)<br />
PCT, an additional international search<br />
fee shall be paid for each further invention<br />
for which an international search is to be<br />
carried out.<br />
(2) In the case of Article 34, paragraph 3(a)<br />
PCT, an additional fee for international<br />
preliminary examination shall be paid<br />
for each further invention for which the<br />
international preliminary examination is<br />
to be carried out.<br />
(3) Where an additional fee has been<br />
paid under protest, the <strong>European</strong> <strong>Patent</strong><br />
<strong>Office</strong> shall examine the protest in<br />
accordance with Rule 40.2(c) to (e) or<br />
Rule 68.3(c) to (e) PCT, subject to<br />
payment of the prescribed protest fee.<br />
Further details concerning the procedure<br />
shall be determined by the President of<br />
the <strong>European</strong> <strong>Patent</strong> <strong>Office</strong>.<br />
(2) Lorsque l’<strong>Office</strong> européen des<br />
brevets agit en qualité d’office récepteur<br />
au sens du PCT, la demande internationale<br />
doit être déposée en allemand, en<br />
anglais ou en français. Le Président de<br />
l’<strong>Office</strong> européen des brevets peut<br />
décider que la demande internationale et<br />
toute pièce y afférente doivent être<br />
déposées en plus d’un exemplaire.<br />
(3) Si une demande internationale est<br />
déposée auprès d’une administration<br />
d’un Etat contractant en vue de sa transmission<br />
à l’<strong>Office</strong> européen des brevets<br />
agissant en qualité d’office récepteur,<br />
l’Etat contractant prend toutes mesures<br />
utiles pour que la demande parvienne à<br />
l’<strong>Office</strong> européen des brevets au plus<br />
tard deux semaines avant l’expiration du<br />
treizième mois à compter de son dépôt<br />
ou, si une priorité est revendiquée, de la<br />
date de priorité.<br />
(4) La taxe de transmission afférente à<br />
la demande internationale doit être<br />
acquittée dans un délai d’un mois à<br />
compter du dépôt de la demande.<br />
Règle 158<br />
L’<strong>Office</strong> européen des brevets agissant<br />
en qualité d’administration chargée de la<br />
recherche internationale ou d’administration<br />
chargée de l’examen préliminaire<br />
international<br />
(1) Dans le cas visé à l’article 17, paragraphe<br />
3 a) PCT, une taxe additionnelle<br />
de recherche internationale doit être<br />
acquittée pour chacune des autres<br />
inventions devant faire l’objet d’une<br />
recherche internationale.<br />
(2) Dans le cas visé à l’article 34, paragraphe<br />
3 a) PCT, une taxe additionnelle<br />
d’examen préliminaire international doit<br />
être acquittée pour chacune des autres<br />
inventions devant faire l’objet d’un<br />
examen préliminaire international.<br />
(3) Lorsqu’unetaxeadditionnelleaété<br />
acquittée sous réserve, l’<strong>Office</strong> européen<br />
des brevets examine la réserve conformément<br />
à la règle 40.2c) à e) ou à la<br />
règle 68.3c) à e) PCT, moyennant le<br />
paiement de la taxe de réserve prescrite.<br />
Le Président de l’<strong>Office</strong> européen des<br />
brevets arrête les autres modalités de<br />
cette procédure.
