(7) Für die Erledigung von Rechtshilfeersuchen<br />
dürfen Gebühren und Auslagen<br />
irgendwelcher Art nicht erhoben werden.<br />
Der ersuchte Staat ist jedoch berechtigt,<br />
von der Organisation die Erstattung der<br />
an Sachverständige oder Dolmetscher<br />
gezahlten Entschädigung sowie der<br />
Auslagen zu verlangen, die durch das<br />
Verfahren nach Absatz 6 entstanden<br />
sind.<br />
(8) Haben nach dem von dem zuständigen<br />
Gericht oder der zuständigen<br />
Behörde angewendeten Recht die Beteiligten<br />
selbst für die Aufnahme der<br />
Beweise zu sorgen und ist das Gericht<br />
oder die Behörde zur Erledigung des<br />
Rechtshilfeersuchens außerstande, so<br />
kann das Gericht oder die Behörde mit<br />
Einverständnis des Europäischen<br />
<strong>Patent</strong>amts eine geeignete Person mit<br />
der Erledigung beauftragen. Bei der<br />
Einholung des Einverständnisses gibt<br />
das zuständige Gericht oder die zuständige<br />
Behörde die ungefähre Höhe der<br />
Kosten an, die durch dieses Verfahren<br />
entstehen. Durch das Einverständnis<br />
des Europäischen <strong>Patent</strong>amts wird die<br />
Organisation verpflichtet, die entstehenden<br />
Kosten zu erstatten; andernfalls<br />
ist die Organisation zur Zahlung der<br />
Kosten nicht verpflichtet.<br />
Kapitel XI<br />
Vertretung<br />
Regel 151<br />
Bestellung eines gemeinsamen<br />
Vertreters<br />
(1) Wird eine europäische <strong>Patent</strong>anmeldung<br />
von mehreren Personen eingereicht<br />
und ist im Antrag auf Erteilung<br />
eines europäischen <strong>Patent</strong>s kein<br />
gemeinsamer Vertreter bezeichnet, so<br />
gilt der Anmelder, der im Antrag als<br />
Erster genannt ist, als gemeinsamer<br />
Vertreter. Ist einer der Anmelder jedoch<br />
verpflichtet, einen zugelassenen<br />
Vertreter zu bestellen, so gilt dieser<br />
Vertreter als gemeinsamer Vertreter,<br />
sofern nicht der im Antrag als Erster<br />
genannte Anmelder einen zugelassenen<br />
Vertreter bestellt hat. Entsprechendes<br />
gilt für gemeinsame <strong>Patent</strong>inhaber und<br />
mehrere Personen, die gemeinsam<br />
Einspruch einlegen oder den Beitritt<br />
erklären.<br />
(7) The execution of letters rogatory shall<br />
not give rise to any reimbursement of<br />
fees or costs of any nature. Nevertheless,<br />
the State in which letters rogatory<br />
are executed has the right to require the<br />
Organisation to reimburse any fees paid<br />
to experts or interpreters and the costs<br />
arising from the procedure under paragraph<br />
6.<br />
(8) If the law applied by the competent<br />
court or authority obliges the parties to<br />
secure evidence and the competent<br />
court or authority is not able itself to<br />
execute the letters rogatory, that court or<br />
authority may, with the consent of the<br />
<strong>European</strong> <strong>Patent</strong> <strong>Office</strong>, appoint a<br />
suitable person to do so. When seeking<br />
such consent, the competent court or<br />
authority shall indicate the approximate<br />
costs which would result from this procedure.<br />
If the <strong>European</strong> <strong>Patent</strong> <strong>Office</strong><br />
gives its consent, the Organisation shall<br />
reimburse any costs incurred; otherwise,<br />
the Organisation shall not be liable for<br />
such costs.<br />
Chapter XI<br />
Representation<br />
Rule 151<br />
Appointment of a common<br />
representative<br />
(1) If there is more than one applicant<br />
and the request for grant of a <strong>European</strong><br />
patent does not name a common representative,<br />
the applicant first named in<br />
the request shall be deemed to be the<br />
common representative. However, if one<br />
of the applicants is obliged to appoint a<br />
professional representative, this representative<br />
shall be deemed to be the<br />
common representative, unless the<br />
applicant first named has appointed a<br />
professional representative. The same<br />
shall apply to third parties acting in<br />
common in filing a notice of opposition or<br />
intervention and to joint proprietors of a<br />
<strong>European</strong> patent.<br />

(7) L’exécution de commissions rogatoires<br />
ne peut donner lieu au remboursement<br />
de taxes ou de frais de quelque<br />
nature que ce soit. Toutefois, l’Etat dans<br />
lequel les commissions rogatoires sont<br />
exécutées a le droit d’exiger de l’Organisation<br />
le remboursement des indemnités<br />
payées aux experts ou aux interprètes et<br />
des frais résultant de la procédure<br />
prévue au paragraphe 6.<br />
(8) Si la législation appliquée par la juridiction<br />
ou l’administration compétente<br />
laisse aux parties le soin de réunir les<br />
preuves, et si cette juridiction ou administration<br />
n’est pas en mesure d’exécuter<br />
ellemême la commission rogatoire,<br />
elle peut, avec le consentement de<br />
l’<strong>Office</strong> européen des brevets, en<br />
charger une personne habilitée à cet<br />
effet. En demandant ce consentement,<br />
la juridiction ou l’administration compétente<br />
indique le montant approximatif<br />
des frais qui résulteraient de cette intervention.<br />
Le consentement de l’<strong>Office</strong><br />
européen des brevets implique pour<br />
l’Organisation l’obligation de rembourser<br />
ces frais ; s’il n’a pas donné son consentement,<br />
l’Organisation n’est pas redevable<br />
de ces frais.<br />
Chapitre XI<br />
Représentation<br />
Règle 151<br />
Désignation d’un représentant commun<br />
(1) Si une demande est déposée par<br />
plusieurs personnes et si la requête en<br />
délivrance du brevet européen ne<br />
désigne pas de représentant commun,<br />
le demandeur cité en premier lieu dans<br />
la requête est réputé être le représentant<br />
commun. Toutefois, si un des demandeurs<br />
est soumis à l’obligation de désigner<br />
un mandataire agréé, ce mandataire<br />
est réputé être le représentant<br />
commun, à moins que le demandeur cité<br />
en premier lieu n’ait luimême désigné<br />
un mandataire agréé. Cela vaut également<br />
pour des tiers agissant conjointement<br />
pour former une opposition ou<br />
présenter une déclaration d’intervention,<br />
ainsi que pour des cotitulaires d’un<br />
brevet européen.
