(3) Das Europäische <strong>Patent</strong>amt weist<br />
bei der Übermittlung der Akten auf die<br />
Beschränkungen hin, denen die Akteneinsicht<br />
durch Dritte nach Artikel 128<br />
Absätze 1 und 4 unterworfen sein kann.<br />
Regel 150<br />
Verfahren bei Rechtshilfeersuchen<br />
(1) Jeder Vertragsstaat bestimmt eine<br />
zentrale Behörde, die vom Europäischen<br />
<strong>Patent</strong>amt ausgehende Rechtshilfeersuchen<br />
entgegenzunehmen und dem<br />
zuständigen Gericht oder der zuständigen<br />
Behörde zur Erledigung zuzuleiten<br />
hat.<br />
(2) Das Europäische <strong>Patent</strong>amt fasst<br />
Rechtshilfeersuchen in der Sprache des<br />
zuständigen Gerichts oder der zuständigen<br />
Behörde ab oder fügt den Rechtshilfeersuchen<br />
eine Übersetzung in dieser<br />
Sprache bei.<br />
(3) Vorbehaltlich der Absätze 5 und 6<br />
hat das zuständige Gericht oder die<br />
zuständige Behörde bei der Erledigung<br />
eines Ersuchens und insbesondere bei<br />
der Anwendung geeigneter Zwangsmittel<br />
in den Formen zu verfahren, die<br />
das nationale Recht vorsieht.<br />
(4) Ist das ersuchte Gericht oder die<br />
ersuchte Behörde nicht zuständig, so ist<br />
das Rechtshilfeersuchen von Amts<br />
wegen unverzüglich an die in Absatz 1<br />
genannte zentrale Behörde zurückzusenden.<br />
Die zentrale Behörde übermittelt<br />
das Rechtshilfeersuchen, wenn ein<br />
anderes Gericht oder eine andere<br />
Behörde in diesem Staat zuständig ist,<br />
diesem Gericht oder dieser Behörde<br />
oder, wenn kein Gericht oder keine<br />
Behörde in diesem Staat zuständig ist,<br />
dem Europäischen <strong>Patent</strong>amt.<br />
(5) Das Europäische <strong>Patent</strong>amt ist von<br />
Zeit und Ort der durchzuführenden<br />
Beweisaufnahme oder der anderen<br />
vorzunehmenden gerichtlichen Handlungen<br />
zu benachrichtigen und unterrichtet<br />
seinerseits die betreffenden Beteiligten,<br />
Zeugen und Sachverständigen.<br />
(6) Auf Ersuchen des Europäischen<br />
<strong>Patent</strong>amts gestattet das zuständige<br />
Gericht oder die zuständige Behörde die<br />
Teilnahme von Mitgliedern des betreffenden<br />
Organs und erlaubt diesen, an<br />
vernommene Personen über das Gericht<br />
oder die Behörde oder unmittelbar<br />
Fragen zu richten.<br />
(3) The <strong>European</strong> <strong>Patent</strong> <strong>Office</strong> shall,<br />
when transmitting the files, draw attention<br />
to the restrictions which may, under<br />
Article 128, paragraphs 1 and 4, apply to<br />
file inspection by third parties.<br />
Rule 150<br />
Procedure for letters rogatory<br />
(1) Each Contracting State shall designate<br />
a central authority to receive letters<br />
rogatory issued by the <strong>European</strong> <strong>Patent</strong><br />
<strong>Office</strong> and to transmit them to the court<br />
or authority competent to execute them.<br />
(2) The <strong>European</strong> <strong>Patent</strong> <strong>Office</strong> shall<br />
draw up letters rogatory in the language<br />
of the competent court or authority or<br />
shall attach to such letters rogatory a<br />
translation into that language.<br />
(3) Subject to paragraphs 5 and 6, the<br />
competent court or authority shall apply<br />
national law as to the procedures to be<br />
followed in executing such requests and,<br />
in particular, as to the appropriate<br />
measures of compulsion.<br />
(4) If the court or authority to which the<br />
letters rogatory are transmitted is not<br />
competent to execute them, the letters<br />
rogatory shall be sent forthwith to the<br />
central authority referred to in paragraph<br />
1. That authority shall transmit the letters<br />
rogatory either to the competent court or<br />
authority in that State, or to the<br />
<strong>European</strong> <strong>Patent</strong> <strong>Office</strong> where no court<br />
or authority is competent in that State.<br />
(5) The <strong>European</strong> <strong>Patent</strong> <strong>Office</strong> shall be<br />
informed of the time when, and the place<br />
where, the enquiry or other legal<br />
measure is to take place and shall inform<br />
the parties, witnesses and experts<br />
concerned.<br />
(6) If so requested by the <strong>European</strong><br />
<strong>Patent</strong> <strong>Office</strong>, the competent court or<br />
authority shall permit the attendance of<br />
members of the department concerned<br />
and allow them to question any person<br />
giving evidence either directly or through<br />
the competent court or authority.<br />
(3) Lorsqu’il transmet des dossiers,<br />
l’<strong>Office</strong> européen des brevets signale<br />
les restrictions auxquelles peut être<br />
soumise, conformément à l’article 128,<br />
paragraphes 1 et 4, la communication à<br />
des tiers d’un dossier.<br />
Règle 150<br />
Procédure des commissions rogatoires<br />
(1) Chaque Etat contractant désigne une<br />
administration centrale chargée de recevoir<br />
les commissions rogatoires émanant<br />
de l’<strong>Office</strong> européen des brevets et de<br />
les transmettre à la juridiction ou à<br />
l’administration compétente aux fins<br />
d’exécution.<br />
(2) L’<strong>Office</strong> européen des brevets rédige<br />
les commissions rogatoires dans la<br />
langue de la juridiction ou de l’administration<br />
compétente ou joint une traduction<br />
dans cette langue.<br />
(3) Sans préjudice des paragraphes 5 et<br />
6, la juridiction ou l’administration<br />
compétente applique la législation nationale<br />
en ce qui concerne la procédure à<br />
suivre pour l’exécution des commissions<br />
rogatoires et notamment les moyens de<br />
contrainte appropriés.<br />
(4) En cas d’incompétence de la juridiction<br />
ou de l’administration requise, la<br />
commission rogatoire est remise d’office<br />
et sans retard à l’administration centrale<br />
prévue au paragraphe 1. Celleci<br />
transmet la commission rogatoire à une<br />
autre juridiction ou administration<br />
compétente de cet Etat, ou à l’<strong>Office</strong><br />
européen des brevets si aucune juridiction<br />
ou administration n’est compétente<br />
dans cet Etat.<br />
(5) L’<strong>Office</strong> européen des brevets est<br />
informé de la date et du lieu où il sera<br />
procédé à l’instruction ou à toute autre<br />
mesure judiciaire, et il en informe les<br />
parties, témoins et experts concernés.<br />
(6) Sur requête de l’<strong>Office</strong> européen des<br />
brevets, la juridiction ou l’administration<br />
compétente autorise les membres de<br />
l’instance concernée à assister à l’exécution<br />
et à interroger toute personne<br />
faisant une déposition soit directement,<br />
soit par l’intermédiaire de cette juridiction<br />
ou administration.
