(5) Unbeschadet des Absatzes 4 werden<br />
die Akten von Anmeldungen, die Gegenstand<br />
von Teilanmeldungen nach<br />
Artikel 76 oder einer neuen Anmeldung<br />
nach Artikel 61 Absatz 1 b) waren,<br />
zumindest für dieselbe Zeitdauer wie die<br />
Akten der letztgenannten Anmeldungen<br />
aufbewahrt. Das Gleiche gilt für die<br />
Akten von europäischen <strong>Patent</strong>en, die<br />
aufgrund dieser Anmeldungen erteilt<br />
worden sind.<br />
Kapitel X<br />
Rechts- und Amtshilfe<br />
Regel 148<br />
Verkehr des Europäischen <strong>Patent</strong>amts<br />
mit Behörden der Vertragsstaaten<br />
(1) Bei Mitteilungen, die sich aus der<br />
Anwendung dieses Übereinkommens<br />
ergeben, verkehren das Europäische<br />
<strong>Patent</strong>amt und die Zentralbehörden für<br />
den gewerblichen Rechtsschutz der<br />
Vertragsstaaten unmittelbar miteinander.<br />
Das Europäische <strong>Patent</strong>amt und die<br />
Gerichte sowie die übrigen Behörden<br />
der Vertragsstaaten können miteinander<br />
durch Vermittlung dieser Zentralbehörden<br />
verkehren.<br />
(2) Die Kosten, die durch die Mitteilungen<br />
nach Absatz 1 entstehen, sind von<br />
der Behörde zu tragen, die die Mitteilungen<br />
gemacht hat; diese Mitteilungen<br />
sind gebührenfrei.<br />
Regel 149<br />
Akteneinsicht durch Gerichte und<br />
Behörden der Vertragsstaaten oder<br />
durch deren Vermittlung<br />
(1) Die Einsicht in die Akten einer europäischen<br />
<strong>Patent</strong>anmeldung oder eines<br />
europäischen <strong>Patent</strong>s durch Gerichte<br />
und Behörden der Vertragsstaaten wird<br />
in das Original oder in eine Kopie<br />
gewährt; Regel 145 ist nicht anzuwenden.<br />
(2) Gerichte und Staatsanwaltschaften<br />
der Vertragsstaaten können in<br />
Verfahren, die bei ihnen anhängig sind,<br />
Dritten Einsicht in die vom Europäischen<br />
<strong>Patent</strong>amt übermittelten Akten oder<br />
Kopien der Akten gewähren. Die Akteneinsicht<br />
wird nach Maßgabe des Artikels<br />
128 gewährt und ist gebührenfrei.<br />
(5) Without prejudice to paragraph 4,<br />
files relating to applications which have<br />
given rise to divisional applications under<br />
Article 76 or new applications under<br />
Article 61, paragraph 1(b), shall be<br />
preserved for at least the same period<br />
as the files relating to any one of these<br />
last applications. The same shall apply<br />
to files relating to any resulting <strong>European</strong><br />
patents.<br />
Chapter X<br />
Legal and administrative cooperation<br />
Rule 148<br />
Communications between the <strong>European</strong><br />
<strong>Patent</strong> <strong>Office</strong> and the authorities of the<br />
Contracting States<br />
(1) Communications between the<br />
<strong>European</strong> <strong>Patent</strong> <strong>Office</strong> and the central<br />
industrial property offices of the<br />
Contracting States which arise out of the<br />
application of this Convention shall be<br />
effected directly between these authorities.<br />
Communications between the<br />
<strong>European</strong> <strong>Patent</strong> <strong>Office</strong> and the courts<br />
or other authorities of the Contracting<br />
States may be effected through the intermediary<br />
of the said central industrial<br />
property offices.<br />
(2) Expenditure in respect of communications<br />
under paragraph 1 shall be<br />
borne by the authority making the<br />
communications, which shall be exempt<br />
from fees.<br />
Rule 149<br />
Inspection of files by or via courts or<br />
authorities of the Contracting States<br />
(1) Inspection of the files of <strong>European</strong><br />
patent applications or of <strong>European</strong><br />
patents by courts or authorities of the<br />
Contracting States shall be of the<br />
original documents or of copies thereof;<br />
Rule 145 shall not apply.<br />
(2) Courts or Public Prosecutors’ offices<br />
of the Contracting States may, in the<br />
course of their proceedings, communicate<br />
to third parties files or copies<br />
thereof transmitted to them by the<br />
<strong>European</strong> <strong>Patent</strong> <strong>Office</strong>. Such communications<br />
shall be effected in accordance<br />
with Article 128 and shall not be subject<br />
to any fee.<br />

(5) Sans préjudice du paragraphe 4, les<br />
dossiers relatifs aux demandes ayant<br />
donné lieu au dépôt de demandes<br />
divisionnaires au sens de l’article 76,<br />
ou à de nouvelles demandes au sens<br />
de l’article 61, paragraphe 1 b), sont<br />
conservés pendant au moins la même<br />
durée que le dossier correspondant à<br />
l’une quelconque de ces dernières. Cela<br />
vaut également pour les dossiers relatifs<br />
aux brevets auxquels ces demandes ont<br />
donné lieu.<br />

Assistance judiciaire et<br />
administrative<br />
Règle 148<br />
Communications entre l’<strong>Office</strong> européen<br />
des brevets et les administrations des<br />
Etats contractants<br />
(1) L’<strong>Office</strong> européen des brevets et les<br />
services centraux de la propriété industrielle<br />
des Etats contractants correspondent<br />
directement lorsque les communications<br />
qu’ils échangent découlent de<br />
l’application de la présente convention.<br />
L’<strong>Office</strong> européen des brevets et les juridictions<br />
ou les autres administrations<br />
des Etats contractants peuvent correspondre<br />
par l’intermédiaire de ces<br />
services centraux.<br />
(2) Les frais résultant de toute communication<br />
au titre du paragraphe 1 sont à la<br />
charge de l’administration qui a fait la<br />
communication ; ces communications ne<br />
donnent lieu à la perception d’aucune<br />
taxe.<br />
Règle 149<br />
Communication de dossiers aux<br />
juridictions et administrations des Etats<br />
contractants ou par leur intermédiaire<br />
(1) La communication des dossiers de<br />
demandes de brevet européen ou de<br />
brevets européens aux juridictions et<br />
administrations des Etats contractants<br />
porte soit sur les pièces originales,<br />
soit sur des copies de ces pièces ; la<br />
règle 145 n’est pas applicable.<br />
(2) Les juridictions et ministères publics<br />
des Etats contractants peuvent, au cours<br />
de procédures en instance devant eux,<br />
communiquer à des tiers les dossiers ou<br />
copies de dossiers qui leur sont transmis<br />
par l’<strong>Office</strong> européen des brevets. Ces<br />
communications sont faites conformément<br />
à l’article 128 et ne donnent lieu au<br />
paiement d’aucune taxe.
