EPA / Special edition No. 1 OJ EPO / Edition spéciale n° 1 JO OEB (4) Ist als Frist ein Monat oder eine Anzahl von Monaten bestimmt, so endet die Frist in dem maßgeblichen folgenden Monat an dem Tag, der durch seine Zahl dem Tag entspricht, an dem das Ereignis eingetreten ist; hat der betreffende nachfolgende Monat keinen Tag mit der entsprechenden Zahl, so läuft die Frist am letzten Tag dieses Monats ab. (5) Ist als Frist eine Woche oder eine Anzahl von Wochen bestimmt, so endet die Frist in der maßgeblichen Woche an dem Tag, der durch seine Benennung dem Tag entspricht, an dem das Ereignis eingetreten ist. Regel 132 Vom Europäischen Patentamt bestimmte Fristen (1) Nimmt das Übereinkommen oder diese Ausführungsordnung auf eine "zu bestimmende Frist" Bezug, so wird diese Frist vom Europäischen Patentamt bestimmt. (2) Sofern nichts anderes bestimmt ist, beträgt eine vom Europäischen Patentamt bestimmte Frist nicht weniger als zwei und nicht mehr als vier Monate sowie, wenn besondere Umstände vorliegen, nicht mehr als sechs Monate. In besonderen Fällen kann die Frist vor Ablauf auf Antrag verlängert werden. Regel 133 Verspäteter Zugang von Schriftstücken (1) Ein beim Europäischen Patentamt verspätet eingegangenes Schriftstück gilt als rechtzeitig eingegangen, wenn es nach Maßgabe der vom Präsidenten des Europäischen Patentamts festgelegten Bedingungen rechtzeitig vor Ablauf der Frist bei der Post oder einem anerkannten Übermittlungsdienst aufgegeben wurde, es sei denn, das Schriftstück ist später als drei Monate nach Ablauf der Frist eingegangen. (2) Absatz 1 ist entsprechend anzuwenden, falls Handlungen bei der zuständigen Behörde nach Artikel 75 Absätze 1 b) oder 2 b) vorgenommen werden. (4) When a period is expressed as one month or a certain number of months, it shall expire in the relevant subsequent month on the day which has the same number as the day on which the said event occurred; if the relevant subsequent month has no day with the same number, the period shall expire on the last day of that month. (5) When a period is expressed as one week or a certain number of weeks, it shall expire in the relevant subsequent week on the day having the same name as the day on which the said event occurred. Rule 132 Periods specified by the European Patent Office (1) Where the Convention or these Implementing Regulations refer to "a period to be specified", this period shall be specified by the European Patent Office. (2) Unless otherwise provided, a period specified by the European Patent Office shall be neither less than two months nor more than four months; in certain circumstances it may be up to six months. In special cases, the period may be extended upon request, presented before the expiry of such period. Rule 133 Late receipt of documents (1) A document received late at the European Patent Office shall be deemed to have been received in due time if it was posted, or delivered to a recognised delivery service, in due time before expiry of the period in accordance with the conditions laid down by the President of the European Patent Office, unless the document was received later than three months after expiry of the period. (2) Paragraph 1 shall apply mutatis mutandis to any period where transactions are carried out with the competent authority in accordance with Article 75, paragraphs 1(b) or 2(b). 2007 (4) Lorsqu’un délai est exprimé en un ou plusieurs mois, il expire, dans le mois ultérieur à prendre en considération, le jour ayant le même quantième que le jour où ledit événement a eu lieu ; si le mois ultérieur à prendre en considération n’a pas de jour ayant le même quantième, le délai considéré expire le dernier jour de ce mois. Règle 132 Délais impartis par l’Office européen des brevets (1) Lorsque la convention ou le règlement d’exécution se réfère à un délai "imparti", ce délai est imparti par l’Office européen des brevets. (2) Sauf s’il en est disposé autrement, un délai imparti par l’Office européen des brevets ne peut ni être inférieur à deux mois ni supérieur à quatre mois ; dans certaines circonstances, il peut être porté jusqu’à six mois. Dans certains cas particuliers, le délai peut être prorogé sur requête présentée avant son expiration. Règle 133 Pièces reçues tardivement (1) Une pièce reçue en retard par l’Office européen des brevets est réputée avoir été reçue dans les délais lorsque, avant l’expiration du délai et conformément aux conditions fixées par le Président de l’Office européen des brevets, ladite pièce a, en temps utile, été postée ou remise à une entreprise d’acheminement reconnue, sauf si elle a été reçue plus de trois mois après l’expiration du délai. (2) Le paragraphe 1 est applicable lorsqu’il s’agit d’actes accomplis auprès de l’administration compétente visée à l’article 75, paragraphe 1 b) ou 2 b).

EPA / Special edition No. 1 OJ EPO / Edition spéciale n° 1 JO OEB 175 Regel 134 Verlängerung von Fristen (1) Läuft eine Frist an einem Tag ab, an dem eine der Annahmestellen des Europäischen Patentamts nach Regel 35 Absatz 1 zur Entgegennahme von Schriftstücken nicht geöffnet ist oder an dem die Post aus anderen als den in Absatz 2 genannten Gründen dort nicht zugestellt wird, so erstreckt sich die Frist auf den nächstfolgenden Tag, an dem alle Annahmestellen zur Entgegennahme von Schriftstücken geöffnet sind und an dem die Post zugestellt wird. Satz 1 ist entsprechend anzuwenden, wenn Schriftstücke, die durch vom Präsidenten des Europäischen Patentamts gemäß Regel 2 Absatz 1 zugelassene technische Einrichtungen zur Nachrichtenübermittlung eingereicht werden, nicht entgegengenommen werden können. (2) Läuft eine Frist an einem Tag ab, an dem die Zustellung oder Übermittlung der Post in einem Vertragsstaat allgemein gestört war, so erstreckt sich die Frist für Beteiligte, die in diesem Staat ihren Wohnsitz oder Sitz haben oder einen Vertreter mit Geschäftssitz in diesem Staat bestellt haben, auf den ersten Tag nach Beendigung der Störung. Ist der betreffende Staat der Sitzstaat des Europäischen Patentamts, so gilt diese Vorschrift für alle Beteiligten und ihre Vertreter. Satz 1 ist auf die Frist nach Regel 37 Absatz 2 entsprechend anzuwenden. (3) Die Absätze 1 und 2 sind entsprechend anzuwenden, wenn Handlungen bei der zuständigen Behörde nach Artikel 75 Absätze 1 b) oder 2 b) vorgenommen werden. (4) Der Tag des Beginns und des Endes einer Störung nach Absatz 2 wird vom Europäischen Patentamt bekannt gemacht. Rule 134 Extension of periods (1) If a period expires on a day on which one of the filing offices of the European Patent Office under Rule 35, paragraph 1, is not open for receipt of documents or on which, for reasons other than those referred to in paragraph 2, mail is not delivered there, the period shall extend to the first day thereafter on which all the filing offices are open for receipt of documents and on which mail is delivered. The first sentence shall apply mutatis mutandis if documents filed by one of the technical means of communication permitted by the President of the European Patent Office under Rule 2, paragraph 1, cannot be received. (2) If a period expires on a day on which there is a general dislocation in the delivery or transmission of mail in a Contracting State, the period shall extend to the first day following the end of the interval of dislocation for parties which are resident in the State concerned or have appointed representatives with a place of business in that State. Where the State concerned is the State in which the European Patent Office is located, this provision shall apply to all parties and their representatives. This paragraph shall apply mutatis mutandis to the period referred to in Rule 37, paragraph 2. (3) Paragraphs 1 and 2 shall apply mutatis mutandis where acts are performed with the competent authority in accordance with Article 75, paragraphs 1(b) or 2(b). (4) The date of commencement and the end of any dislocation under paragraph 2 shall be published by the European Patent Office. Règle 134 Prorogation des délais (1) Si un délai expire soit un jour où l’un des bureaux de réception de l’Office européen des brevets au sens de la règle 35, paragraphe 1, n’est pas ouvert pour recevoir des documents, soit un jour où le courrier n’y est pas distribué, pour des raisons autres que celles indiquées au paragraphe 2, le délai est prorogé jusqu’au premier jour suivant où tous les bureaux de réception sont ouverts pour recevoir ces documents et où le courrier est distribué. La première phrase est applicable si des documents déposés par l’un des moyens techniques de communication autorisés par le Président de l’Office européen des brevets en vertu de la règle 2, paragraphe 1, ne peuvent pas être reçus. (2) Si un délai expire un jour où se produit une perturbation générale concernant la distribution ou l’acheminement du courrier dans un Etat contractant, le délai est prorogé jusqu’au premier jour suivant la fin de cette période de perturbation pour les parties qui ont leur domicile ou leur siège dans cet Etat ou qui ont désigné des mandataires ayant leur domicile professionnel dans cet Etat. Lorsque l’Etat concerné est l’Etat où l’Office européen des brevets a son siège, la présente disposition est applicable à toutes les parties et à leurs mandataires. Le présent paragraphe est applicable au délai prévu à la règle 37, paragraphe 2. (3) Les paragraphes 1 et 2 sont applicables lorsqu’il s’agit d’actes accomplis auprès de l’administration compétente visée à l’article 75, paragraphe 1 b) ou 2 b). (4) Les dates de début et de fin d’une éventuelle perturbation au sens du paragraphe 2 sont publiées par l’Office européen des brevets.
