(2) Bei der Zustellung mittels eingeschriebenen<br />
Briefs mit oder ohne Rückschein<br />
gilt dieser mit dem zehnten Tag<br />
nach der Abgabe zur Post als zugestellt,<br />
es sei denn, das zuzustellende Schriftstück<br />
ist nicht oder an einem späteren<br />
Tag zugegangen; im Zweifel hat das<br />
Europäische <strong>Patent</strong>amt den Zugang des<br />
Schriftstücks und gegebenenfalls den<br />
Tag des Zugangs nachzuweisen.<br />
(3) Die Zustellung mittels eingeschriebenen<br />
Briefs mit oder ohne Rückschein<br />
gilt auch dann als bewirkt, wenn die<br />
Annahme des Briefs verweigert wird.<br />
(4) Soweit die Zustellung durch die Post<br />
durch die Absätze 1 bis 3 nicht geregelt<br />
ist, ist das Recht des Staats anzuwenden,<br />
in dem die Zustellung erfolgt.<br />
Regel 127<br />
Zustellung durch technische Einrichtungen<br />
zur Nachrichtenübermittlung<br />
Die Zustellung kann durch technische<br />
Einrichtungen zur Nachrichtenübermittlung<br />
bewirkt werden, die der Präsident<br />
des Europäischen <strong>Patent</strong>amts unter<br />
Festlegung der Bedingungen für ihre<br />
Benutzung bestimmt.<br />
Regel 128<br />
Zustellung durch unmittelbare Übergabe<br />
Die Zustellung kann in den Dienstgebäuden<br />
des Europäischen <strong>Patent</strong>amts<br />
durch unmittelbare Übergabe des<br />
Schriftstücks an den Empfänger bewirkt<br />
werden, der dabei den Empfang zu<br />
bescheinigen hat. Die Zustellung gilt<br />
auch dann als bewirkt, wenn der<br />
Empfänger die Annahme des Schriftstücks<br />
oder die Bescheinigung des<br />
Empfangs verweigert.<br />
Regel 129<br />
Öffentliche Zustellung<br />
(1) Kann der Aufenthaltsort des Empfängers<br />
nicht festgestellt werden oder war<br />
die Zustellung nach Regel 126 Absatz 1<br />
auch nach einem zweiten Versuch<br />
unmöglich, so wird durch öffentliche<br />
Bekanntmachung zugestellt.<br />
(2) Where notification is effected by<br />
registered letter, whether or not with<br />
advice of delivery, such letter shall<br />
be deemed to be delivered to the<br />
addressee on the tenth day following its<br />
posting, unless it has failed to reach the<br />
addressee or has reached him at a later<br />
date; in the event of any dispute, it shall<br />
be incumbent on the <strong>European</strong> <strong>Patent</strong><br />
<strong>Office</strong> to establish that the letter has<br />
reached its destination or to establish<br />
the date on which the letter was<br />
delivered to the addressee, as the<br />
case may be.<br />
(3) Notification by registered letter,<br />
whether or not with advice of delivery,<br />
shall be deemed to have been effected<br />
even if acceptance of the letter has been<br />
refused.<br />
(4) To the extent that notification by post<br />
is not covered by paragraphs 1 to 3, the<br />
law of the State in which the notification<br />
is made shall apply.<br />
Rule 127<br />
Notification by technical means of<br />
communication<br />
Notification may be effected by such<br />
technical means of communication as<br />
are determined by the President of the<br />
<strong>European</strong> <strong>Patent</strong> <strong>Office</strong> and under the<br />
conditions laid down by him.<br />
Rule 128<br />
Notification by delivery by hand<br />
Notification may be effected on the<br />
premises of the <strong>European</strong> <strong>Patent</strong> <strong>Office</strong><br />
by delivery by hand of the document to<br />
the addressee, who shall on delivery<br />
acknowledge its receipt. Notification<br />
shall be deemed to have been effected<br />
even if the addressee refuses to accept<br />
thedocumentortoacknowledgereceipt<br />
thereof.<br />
Rule 129<br />
Public notification<br />
(1) If the address of the addressee<br />
cannot be established, or if notification in<br />
accordance with Rule 126, paragraph 1,<br />
has proved to be impossible even after a<br />
second attempt, notification shall be<br />
effected by public notice.<br />

(2) Lorsque la signification est faite par<br />
lettre recommandée avec ou sans<br />
demande d’avis de réception, cette lettre<br />
est réputée remise à son destinataire le<br />
dixième jour après la remise à la poste,<br />
àmoinsqu’elle ne lui soit pas parvenue<br />
ou ne lui soit parvenue qu’à une date<br />
ultérieure ; en cas de contestation, il<br />
incombe à l’<strong>Office</strong> européen des brevets<br />
d’établir que la lettre est parvenue à<br />
destination ou d’établir, le cas échéant,<br />
la date de sa remise au destinataire.<br />
(3) La signification par lettre recommandée<br />
avec ou sans demande d’avis<br />
de réception est réputée faite même si la<br />
lettre a été refusée.<br />
(4) Si la signification par la poste n’est<br />
pas entièrement réglée par les paragraphes<br />
1 à 3, le droit applicable est celui<br />
de l’Etat dans lequel la signification est<br />
faite.<br />
Règle 127<br />
Signification par des moyens techniques<br />
de communication<br />
La signification peut être faite par des<br />
moyens techniques de communication<br />
que détermine le Président de l’<strong>Office</strong><br />
européen des brevets et dans les conditions<br />
qu’il arrête.<br />
Règle 128<br />
Signification par remise directe<br />
La signification peut être effectuée dans<br />
les locaux de l’<strong>Office</strong> européen des<br />
brevets par remise directe de la pièce à<br />
signifier au destinataire qui en accuse<br />
réception. La signification est réputée<br />
faite même si le destinataire refuse<br />
d’accepter la pièce à signifier ou d’en<br />
accuser réception.<br />
Règle 129<br />
Signification publique<br />
(1) S’il n’est pas possible de connaître<br />
l’adresse du destinataire ou si la signification<br />
prévue à la règle 126, paragraphe<br />
1, s’est révélée impossible<br />
même après une seconde tentative,<br />
la signification est faite sous forme de<br />
publication.
