Kapitel IV<br />
Zustellungen<br />
Regel 125<br />
Allgemeine Vorschriften<br />
(1) In den Verfahren vor dem Europäischen<br />
<strong>Patent</strong>amt wird entweder das<br />
Originalschriftstück, eine vom Europäischen<br />
<strong>Patent</strong>amt beglaubigte oder mit<br />
Dienstsiegel versehene Abschrift dieses<br />
Schriftstücks oder ein mit Dienstsiegel<br />
versehener Computerausdruck zugestellt.<br />
Abschriften von Schriftstücken, die<br />
von Beteiligten eingereicht werden,<br />
bedürfen keiner solchen Beglaubigung.<br />
(2) Die Zustellung wird bewirkt:<br />
a) durch die Post nach Regel 126;<br />
b) durch technische Einrichtungen zur<br />
Nachrichtenübermittlung nach Regel 127;<br />
c) durch Übergabe im Europäischen<br />
<strong>Patent</strong>amt nach Regel 128 oder<br />
d) durch öffentliche Bekanntmachung<br />
nach Regel 129.<br />
(3) Die Zustellung durch Vermittlung der<br />
Zentralbehörde für den gewerblichen<br />
Rechtsschutz eines Vertragsstaats<br />
erfolgt nach dem von dieser Behörde in<br />
nationalen Verfahren anzuwendenden<br />
Recht.<br />
(4) Kann das Europäische <strong>Patent</strong>amt die<br />
formgerechte Zustellung eines Schriftstücks<br />
nicht nachweisen oder ist das<br />
Schriftstück unter Verletzung von Zustellungsvorschriften<br />
zugegangen, so gilt<br />
das Schriftstück als an dem Tag zugestellt,<br />
den das Europäische <strong>Patent</strong>amt<br />
als Tag des Zugangs nachweist.<br />
Regel 126<br />
Zustellung durch die Post<br />
(1) Entscheidungen, durch die eine<br />
Beschwerdefrist oder die Frist für einen<br />
Antrag auf Überprüfung in Lauf gesetzt<br />
wird, Ladungen und andere vom Präsidenten<br />
des Europäischen <strong>Patent</strong>amts<br />
bestimmte Schriftstücke werden durch<br />
eingeschriebenen Brief mit Rückschein<br />
zugestellt. Alle anderen Zustellungen<br />
durch die Post erfolgen mittels eingeschriebenen<br />
Briefs.<br />
Chapter IV<br />
Notifications<br />
Rule 125<br />
General provisions<br />
(1) In proceedings before the <strong>European</strong><br />
<strong>Patent</strong> <strong>Office</strong>, any notification to be<br />
made shall take the form of the original<br />
document, a copy thereof certified by or<br />
bearing the seal of the <strong>European</strong> <strong>Patent</strong><br />
<strong>Office</strong>, or a computer printout bearing<br />
such seal. Copies of documents<br />
emanating from the parties themselves<br />
shall not require such certification.<br />
(2) Notification shall be made:<br />
(a) by post in accordance with Rule 126;<br />
(b) by technical means of communication<br />
in accordance with Rule 127;<br />
(c) by delivery on the premises of the<br />
<strong>European</strong> <strong>Patent</strong> <strong>Office</strong> in accordance<br />
with Rule 128; or<br />
(d) by public notice in accordance with<br />
Rule 129.<br />
(3) Notification through the central industrial<br />
property office of a Contracting State<br />
shall be made in accordance with the<br />
law applicable to that office in national<br />
proceedings.<br />
(4) Where a document has reached the<br />
addressee, if the <strong>European</strong> <strong>Patent</strong> <strong>Office</strong><br />
is unable to prove that it has been duly<br />
notified, or if provisions relating to its<br />
notification have not been observed, the<br />
document shall be deemed to have been<br />
notified on the date established by the<br />
<strong>European</strong> <strong>Patent</strong> <strong>Office</strong> as the date of<br />
receipt.<br />
Rule 126<br />
Notification by post<br />
(1) Decisions incurring a period for<br />
appeal or a petition for review,<br />
summonses and other such documents<br />
as determined by the President of the<br />
<strong>European</strong> <strong>Patent</strong> <strong>Office</strong> shall be notified<br />
by registered letter with advice of<br />
delivery. All other notifications by post<br />
shall be by registered letter.<br />
Chapitre IV<br />
Significations<br />
Règle 125<br />
Dispositions générales<br />
(1) Les significations prévues dans les<br />
procédures devant l’<strong>Office</strong> européen des<br />
brevets portent soit sur l’original de la<br />
pièce, soit sur une copie de cette pièce<br />
certifiée conforme ou portant le sceau de<br />
l’<strong>Office</strong> européen des brevets, soit sur<br />
un imprimé établi par ordinateur et<br />
portant un tel sceau. Les copies de<br />
pièces produites par les parties ellesmêmes<br />
ne requièrent pas une telle certification.<br />
(2) La signification directe est faite, soit :<br />
a) par la poste conformément à la<br />
règle 126 ;<br />
b) par des moyens techniques de<br />
communication conformément à la<br />
règle 127 ;<br />
c) par remise dans les locaux de l’<strong>Office</strong><br />
européen des brevets conformément à<br />
la règle 128 ;<br />
d) par publication conformément à la<br />
règle 129.<br />
(3) La signification par l’intermédiaire du<br />
service central de la propriété industrielle<br />
d’un Etat contractant est faite conformément<br />
au droit applicable à ce service<br />
dans les procédures nationales.<br />
(4) Si, une pièce étant parvenue à son<br />
destinataire, l’<strong>Office</strong> européen des<br />
brevets n’est pas en mesure de prouver<br />
qu’elle a été régulièrement signifiée, ou<br />
si les dispositions relatives à la signification<br />
n’ont pas été observées, la pièce<br />
est réputée signifiée à la date à laquelle<br />
l’<strong>Office</strong> européen des brevets prouve<br />
qu’elle a été reçue.<br />
Règle 126<br />
Signification par la poste<br />
(1) Les décisions qui font courir un délai<br />
pour former un recours ou présenter une<br />
requête en révision, les citations et<br />
toutes autres pièces pour lesquelles le<br />
Président de l’<strong>Office</strong> européen des<br />
brevets prescrit qu’il sera fait usage de<br />
ce mode de signification sont signifiées<br />
par lettre recommandée avec demande<br />
d’avis de réception. Les autres significations<br />
par la poste sont faites par lettre<br />
recommandée.
