(2) Zeugen oder Sachverständige, die<br />
vom Europäischen <strong>Patent</strong>amt geladen<br />
worden sind und vor diesem erscheinen,<br />
haben Anspruch auf Erstattung angemessener<br />
Reise- und Aufenthaltskosten.<br />
Es kann ihnen ein Vorschuss auf diese<br />
Kosten gewährt werden. Satz 1 gilt auch<br />
für Personen, die ohne Ladung vor dem<br />
Europäischen <strong>Patent</strong>amt erscheinen und<br />
als Zeugen oder Sachverständige<br />
vernommen werden.<br />
(3) Zeugen, denen nach Absatz 2 ein<br />
Erstattungsanspruch zusteht, haben<br />
Anspruch auf eine angemessene<br />
Entschädigung für Verdienstausfall;<br />
Sachverständige haben Anspruch auf<br />
Vergütung ihrer Tätigkeit. Diese<br />
Entschädigung oder Vergütung wird den<br />
Zeugen und Sachverständigen gezahlt,<br />
nachdem sie ihre Pflicht oder ihren<br />
Auftrag erfüllt haben.<br />
(4) Der Verwaltungsrat legt die Einzelheiten<br />
der Anwendung der Absätze 2<br />
und 3 fest. Das Europäische <strong>Patent</strong>amt<br />
zahlt die nach den Absätzen 2 und 3<br />
fälligen Beträge aus.<br />
Regel 123<br />
Beweissicherung<br />
(1) Das Europäische <strong>Patent</strong>amt kann auf<br />
Antrag zur Sicherung eines Beweises<br />
unverzüglich eine Beweisaufnahme über<br />
Tatsachen vornehmen, die für eine<br />
Entscheidung von Bedeutung sein<br />
können, die das Europäische <strong>Patent</strong>amt<br />
hinsichtlich einer europäischen <strong>Patent</strong>anmeldung<br />
oder eines europäischen<br />
<strong>Patent</strong>s wahrscheinlich zu treffen hat,<br />
wenn zu befürchten ist, dass die Beweisaufnahme<br />
zu einem späteren Zeitpunkt<br />
erschwert oder unmöglich sein wird. Der<br />
Zeitpunkt der Beweisaufnahme ist dem<br />
Anmelder oder <strong>Patent</strong>inhaber so rechtzeitig<br />
mitzuteilen, dass er daran teilnehmen<br />
kann. Er kann sachdienliche<br />
Fragen stellen.<br />
(2) Der Antrag muss enthalten:<br />
a) Angaben zur Person des Antragstellers<br />
nach Maßgabe der Regel 41<br />
Absatz 2 c);<br />
b) eine ausreichende Bezeichnung der<br />
europäischen <strong>Patent</strong>anmeldung oder<br />
des europäischen <strong>Patent</strong>s;<br />
c) die Angabe der Tatsachen, über die<br />
Beweis erhoben werden soll;<br />
d) die Angabe der Beweismittel;<br />
(2) Witnesses or experts who are<br />
summoned by and appear before the<br />
<strong>European</strong> <strong>Patent</strong> <strong>Office</strong> shall be entitled<br />
to appropriate reimbursement of<br />
expenses for travel and subsistence.<br />
An advance for these expenses may<br />
be granted to them. This shall also<br />
apply to persons who appear before the<br />
<strong>European</strong> <strong>Patent</strong> <strong>Office</strong> without being<br />
summoned by it and are heard as<br />
witnesses or experts.<br />
(3) Witnesses entitled to reimbursement<br />
under paragraph 2 shall also be entitled<br />
to appropriate compensation for loss of<br />
earnings, and experts to fees for their<br />
work. These payments shall be made to<br />
the witnesses and experts after they<br />
have fulfilled their duties or tasks.<br />
(4) The Administrative Council shall lay<br />
down the details implementing paragraphs<br />
2 and 3. Any amounts due under<br />
these provisions shall be paid by the<br />
<strong>European</strong> <strong>Patent</strong> <strong>Office</strong>.<br />
Rule 123<br />
Conservation of evidence<br />
(1) On request, the <strong>European</strong> <strong>Patent</strong><br />
<strong>Office</strong> may, without delay, take measures<br />
to conserve evidence of facts liable to<br />
affect a decision which it may be called<br />
upon to take with regard to a <strong>European</strong><br />
patent application or a <strong>European</strong> patent,<br />
where there is reason to fear that it might<br />
subsequently become more difficult or<br />
even impossible to take evidence. The<br />
date on which the measures are to be<br />
taken shall be communicated to the<br />
applicant for or proprietor of the patent in<br />
sufficient time to allow him to attend. He<br />
may ask relevant questions.<br />
(2) The request shall contain:<br />
(a) particulars of the requester as<br />
provided in Rule 41, paragraph 2(c);<br />
(b) sufficient identification of the<br />
<strong>European</strong> patent application or<br />
<strong>European</strong> patent in question;<br />
(c) an indication of the facts in respect of<br />
which evidence is to be taken;<br />
(d) particulars of the means of giving or<br />
obtaining evidence;<br />
(2) Les témoins ou les experts qui ont<br />
été cités par l’<strong>Office</strong> européen des<br />
brevets et comparaissent devant lui ont<br />
droit à un remboursement adéquat de<br />
leurs frais de déplacement et de séjour.<br />
Une avance peut leur être accordée sur<br />
ces frais. Ceci vaut également pour les<br />
personnes qui comparaissent devant<br />
l’<strong>Office</strong> européen des brevets sans qu’il<br />
les ait citées et sont entendues comme<br />
témoins ou experts.<br />
(3) Les témoins qui ont droit à un<br />
remboursement en application du paragraphe<br />
2 ont en outre droit à une indemnité<br />
adéquate pour manque à gagner ;<br />
les experts ont droit à des honoraires<br />
pour la rémunération de leurs travaux.<br />
Ces indemnités ou honoraires sont<br />
payés aux témoins ou experts après<br />
l’accomplissement de leurs devoirs ou<br />
de leur mission.<br />
(4) Le Conseil d’administration détermine<br />
les modalités d’application des<br />
paragraphes 2 et 3. Les sommes dues<br />
en vertu de ces dispositions sont acquittées<br />
par l’<strong>Office</strong> européen des brevets.<br />
Règle 123<br />
Conservation de la preuve<br />
(1) L’<strong>Office</strong> européen des brevets peut,<br />
sur requête, procéder sans délai à<br />
une mesure d’instruction, en vue de<br />
conserver la preuve de faits qui peuvent<br />
affecter une décision qu’il sera vraisemblablement<br />
appelé à prendre au sujet<br />
d’une demande de brevet européen ou<br />
d’un brevet européen, lorsqu’il y a lieu<br />
d’appréhender que l’instruction ne<br />
devienne ultérieurement plus difficile<br />
ou même impossible. La date de la<br />
mesure d’instruction doit être notifiée au<br />
demandeur ou au titulaire du brevet en<br />
temps utile pour lui permettre de participer<br />
à l’instruction. Il peut poser toutes<br />
questions pertinentes.<br />
(2) La requête doit contenir :<br />
a) les indications concernant le requérant<br />
telles que prévues à la règle 41,<br />
paragraphe 2 c) ;<br />
b) des indications suffisantes pour<br />
permettre l’identification de la demande<br />
de brevet européen ou du brevet européen<br />
en cause ;<br />
c) l’indication des faits qui nécessitent la<br />
mesure d’instruction ;<br />
d) l’indication de la mesure d’instruction ;
