Regel 113<br />
Unterschrift, Name, Dienstsiegel<br />
(1) Entscheidungen, Ladungen, Mitteilungen<br />
und Bescheide des Europäischen<br />
<strong>Patent</strong>amts sind mit der Unterschrift<br />
und dem Namen des zuständigen<br />
Bediensteten zu versehen.<br />
(2) Wird ein in Absatz 1 genanntes<br />
Schriftstück von dem zuständigen<br />
Bediensteten mit Hilfe eines Computers<br />
erstellt, so kann die Unterschrift durch<br />
ein Dienstsiegel ersetzt werden. Wird<br />
das Schriftstück automatisch durch<br />
einen Computer erstellt, so kann auch<br />
die Namensangabe des zuständigen<br />
Bediensteten entfallen. Dies gilt auch<br />
für vorgedruckte Bescheide und Mitteilungen.<br />

Regel 114<br />
Einwendungen Dritter<br />
(1) Einwendungen Dritter sind schriftlich<br />
in einer Amtssprache des Europäischen<br />
<strong>Patent</strong>amts einzureichen und zu<br />
begründen. Regel 3 Absatz 3 ist anzuwenden.<br />
(2) Die Einwendungen werden dem<br />
Anmelder oder <strong>Patent</strong>inhaber mitgeteilt,<br />
der dazu Stellung nehmen kann.<br />

Mündliche Verhandlung und<br />
Beweisaufnahme<br />
Regel 115<br />
Ladung zur mündlichen Verhandlung<br />
(1) Zur mündlichen Verhandlung nach<br />
Artikel 116 werden die Beteiligten unter<br />
Hinweis auf Absatz 2 geladen. Die<br />
Ladungsfrist beträgt mindestens zwei<br />
Monate, sofern die Beteiligten nicht mit<br />
einer kürzeren Frist einverstanden sind.<br />
(2) Ist ein zu einer mündlichen Verhandlung<br />
ordnungsgemäß geladener Beteiligter<br />
vor dem Europäischen <strong>Patent</strong>amt<br />
nicht erschienen, so kann das Verfahren<br />
ohne ihn fortgesetzt werden.<br />
Rule 113<br />
Signature, name, seal<br />
(1) Any decisions, summonses, notices<br />
and communications from the <strong>European</strong><br />
<strong>Patent</strong> <strong>Office</strong> shall be signed by, and<br />
state the name of, the employee<br />
responsible.<br />
(2)Whereadocumentreferredtoin<br />
paragraph 1 is produced by the<br />
employee responsible using a computer,<br />
a seal may replace the signature. Where<br />
the document is produced automatically<br />
by a computer, the employee’s name<br />
may also be dispensed with. The same<br />
shall apply to pre-printed notices and<br />
communications.<br />

Rule 114<br />
Observations by third parties<br />
(1) Any observations by a third party<br />
shall be filed in writing in an official<br />
language of the <strong>European</strong> <strong>Patent</strong> <strong>Office</strong><br />
and state the grounds on which they are<br />
based. Rule 3, paragraph 3, shall apply.<br />
(2) Any such observations shall be<br />
communicated to the applicant for or<br />
proprietor of the patent, who may<br />
comment on them.<br />

Oral proceedings and taking of<br />
evidence<br />
Rule 115<br />
Summons to oral proceedings<br />
(1) The parties shall be summoned to<br />
oral proceedings under Article 116,<br />
drawing their attention to paragraph 2 of<br />
this Rule. At least two months’ notice of<br />
the summons shall be given, unless the<br />
parties agree to a shorter period.<br />
(2) If a party duly summoned to oral<br />
proceedings before the <strong>European</strong> <strong>Patent</strong><br />
<strong>Office</strong> does not appear as summoned,<br />
the proceedings may continue without<br />
that party.<br />

(1) Toute décision, citation, communication<br />
et notification de l’<strong>Office</strong> européen<br />
des brevets doit être revêtue de la signature<br />
et du nom de l’agent responsable.<br />
(2) Si un document mentionné au paragraphe<br />
1 est produit par l’agent responsable<br />
à l’aide d’un ordinateur, un sceau<br />
peut remplacer la signature. Si ce document<br />
est produit automatiquement par<br />
ordinateur, il n’est pas non plus nécessaire<br />
d’indiquer le nom de l’agent<br />
responsable. Ceci vaut également pour<br />
les notifications et communications<br />
préimprimées.<br />

Observations des tiers<br />
(1) Les observations des tiers doivent<br />
être présentées par écrit dans une<br />
langue officielle de l’<strong>Office</strong> européen<br />
des brevets et être motivées. La règle 3,<br />
paragraphe 3, est applicable.<br />
(2) Ces observations sont notifiées au<br />
demandeur ou au titulaire du brevet, qui<br />
peut prendre position.<br />

Procédure orale et instruction<br />
Règle 115<br />
Citation à une procédure orale<br />
(1) La citation des parties à une procédure<br />
orale conformément à l’article 116<br />
fait mention du paragraphe 2 de la<br />
présente règle. Elle comporte un délai<br />
minimum de deux mois, à moins que les<br />
parties ne conviennent d’un délai plus<br />
bref.<br />
(2) Si une partie régulièrement citée à<br />
une procédure orale devant l’<strong>Office</strong> européen<br />
des brevets n’a pas comparu, la<br />
procédure peut être poursuivie en son<br />
absence.
