Kapitel I<br />
Entscheidungen und Mitteilungen des<br />
Europäischen <strong>Patent</strong>amts<br />
Regel 111<br />
Form der Entscheidungen<br />
(1) Findet eine mündliche Verhandlung<br />
vor dem Europäischen <strong>Patent</strong>amt statt,<br />
so können die Entscheidungen<br />
verkündet werden. Später sind die<br />
Entscheidungen schriftlich abzufassen<br />
und den Beteiligten zuzustellen.<br />
(2) Entscheidungen des Europäischen<br />
<strong>Patent</strong>amts, die mit der Beschwerde<br />
angefochten werden können, sind zu<br />
begründen und mit einem Hinweis<br />
darüber zu versehen, dass gegen die<br />
Entscheidung die Beschwerde statthaft<br />
ist, wobei die Beteiligten auf die Artikel<br />
106 bis 108 aufmerksam zu machen<br />
sind, deren Wortlaut beizufügen ist. Die<br />
Beteiligten können aus der Unterlassung<br />
des Hinweises keine Ansprüche<br />
herleiten.<br />
Regel 112<br />
Feststellung eines Rechtsverlusts<br />
(1) Stellt das Europäische <strong>Patent</strong>amt<br />
fest, dass ein Rechtsverlust eingetreten<br />
ist, ohne dass eine Entscheidung über<br />
die Zurückweisung der europäischen<br />
<strong>Patent</strong>anmeldung, die Erteilung, den<br />
Widerruf oder die Aufrechterhaltung des<br />
europäischen <strong>Patent</strong>s oder über die<br />
Beweisaufnahme ergangen ist, so teilt<br />
es dies dem betroffenen Beteiligten mit.<br />
(2) Ist der Beteiligte der Auffassung,<br />
dass die Feststellung des Europäischen<br />
<strong>Patent</strong>amts nicht zutrifft, so kann er<br />
innerhalb von zwei Monaten nach der<br />
Mitteilung nach Absatz 1 eine Entscheidung<br />
beantragen. Das Europäische<br />
<strong>Patent</strong>amt trifft eine solche Entscheidung<br />
nur dann, wenn es die Auffassung des<br />
Beteiligten nicht teilt; andernfalls unterrichtet<br />
es ihn.<br />
Rule 110<br />
Reimbursement of the fee for petitions<br />
for review<br />
The Enlarged Board of Appeal shall<br />
order the reimbursement of the fee for a<br />
petition for review if the proceedings<br />
before the Boards of Appeal are<br />
reopened.<br />

Rule 111<br />
Form of decisions<br />
(1) Where oral proceedings are held<br />
before the <strong>European</strong> <strong>Patent</strong> <strong>Office</strong>, the<br />
decision may be given orally. The decision<br />
shall subsequently be put in writing<br />
and notified to the parties.<br />
(2) Decisions of the <strong>European</strong> <strong>Patent</strong><br />
<strong>Office</strong> which are open to appeal shall be<br />
reasoned and shall be accompanied by<br />
a communication pointing out the possibility<br />
of appeal and drawing the attention<br />
of the parties to Articles 106 to 108, the<br />
text of which shall be attached. The<br />
parties may not invoke the omission of<br />
the communication.<br />
Rule 112<br />
Noting of loss of rights<br />
(1) If the <strong>European</strong> <strong>Patent</strong> <strong>Office</strong> notes<br />
that a loss of rights has occurred, without<br />
any decision concerning the refusal of<br />
the <strong>European</strong> patent application or the<br />
grant, revocation or maintenance of the<br />
<strong>European</strong> patent, or the taking of<br />
evidence, it shall communicate this to<br />
the party concerned.<br />
(2) If the party concerned considers that<br />
the finding of the <strong>European</strong> <strong>Patent</strong> <strong>Office</strong><br />
is inaccurate, it may, within two months<br />
of the communication under paragraph<br />
1, apply for a decision on the matter. The<br />
<strong>European</strong> <strong>Patent</strong> <strong>Office</strong> shall take such<br />
decision only if it does not share the<br />
opinion of the party requesting it; otherwise,<br />
it shall inform that party.<br />

européen des brevets<br />
Règle 111<br />
Forme des décisions<br />
(1) Les décisions prises dans le cadre<br />
d’une procédure orale devant l’<strong>Office</strong><br />
européen des brevets peuvent être<br />
prononcées à l’audience. Elles sont<br />
ensuite formulées par écrit et signifiées<br />
aux parties.<br />
(2) Les décisions de l’<strong>Office</strong> européen<br />
des brevets contre lesquelles un recours<br />
est ouvert doivent être motivées et être<br />
accompagnées d’un avertissement<br />
selon lequel la décision en cause peut<br />
faire l’objet d’un recours et qui appelle<br />
l’attention des parties sur les dispositions<br />
des articles 106 à 108 dont le texte est<br />
annexé. Les parties ne peuvent se<br />
prévaloir de l’omission de cet avertissement.<br />
Règle 112<br />
Constatation de la perte d’un droit<br />
(1) Si l’<strong>Office</strong> européen des brevets<br />
constate qu’une perte de droit s’est<br />
produite sans qu’une décision de rejet<br />
de la demande de brevet européen, de<br />
délivrance, de révocation ou de maintien<br />
du brevet européen ou une décision<br />
concernant une mesure d’instruction<br />
n’ait été prise, il le notifie à la partie<br />
intéressée.<br />
(2) Si la partie intéressée estime que les<br />
conclusions de l’<strong>Office</strong> européen des<br />
brevets ne sont pas fondées, elle peut,<br />
dans un délai de deux mois à compter<br />
de la notification visée au paragraphe 1,<br />
requérir une décision en l’espèce.<br />
L’<strong>Office</strong> européen des brevets ne prend<br />
une telle décision que dans le cas où il<br />
ne partage pas le point de vue de la<br />
partie intéressée ; dans le cas contraire,<br />
il en informe cette dernière.
