Regel 100
Prüfung der Beschwerde

(1) Die Vorschriften für das Verfahren
vor dem Organ, das die mit der
Beschwerde angefochtene Entscheidung
erlassen hat, sind im Beschwerdeverfahren
anzuwenden, sofern nichts
anderes bestimmt ist.
(2) Bei der Prüfung der Beschwerde
fordert die Beschwerdekammer die
Beteiligten so oft wie erforderlich auf,
innerhalb einer zu bestimmenden Frist
eine Stellungnahme zu Mitteilungen der
Beschwerdekammer oder zu den Stellungnahmen
anderer Beteiligter einzureichen.
(3) Unterlässt es der Anmelder, auf eine
Aufforderung nach Absatz 2 rechtzeitig
zu antworten, so gilt die europäische
Patentanmeldung als zurückgenommen,
es sei denn, die angefochtene Entscheidung
ist von der Rechtsabteilung
erlassen worden.
Regel 101
Verwerfung der Beschwerde als
unzulässig
(1) Entspricht die Beschwerde nicht den
Artikeln 106 bis 108, Regel 97 oder
Regel 99 Absatz 1 b) oder c) oder
Absatz 2, so verwirft die Beschwerdekammer
sie als unzulässig, sofern die
Mängel nicht vor Ablauf der Fristen nach
Artikel 108 beseitigt worden sind.
(2) Stellt die Beschwerdekammer fest,
dass die Beschwerde Regel 99 Absatz 1
a) nicht entspricht, so teilt sie dies dem
Beschwerdeführer mit und fordert ihn
auf, innerhalb einer zu bestimmenden
Frist die festgestellten Mängel zu beseitigen.
Werden diese nicht rechtzeitig
beseitigt, so verwirft die Beschwerdekammer
die Beschwerde als unzulässig.
Regel 102
Form der Entscheidung der Beschwerdekammer
Die Entscheidung ist von dem Vorsitzenden
der Beschwerdekammer und
dem dafür zuständigen Bediensteten der
Geschäftsstelle der Beschwerdekammer
durch ihre Unterschrift oder andere
geeignete Mittel als authentisch zu
bestätigen. Die Entscheidung enthält:
a) die Feststellung, dass sie von der
Beschwerdekammer erlassen worden
ist;
b) den Tag, an dem die Entscheidung
erlassen worden ist;
Rule 100
Examination of appeals
(1) Unless otherwise provided, the
provisions relating to proceedings before
the department which has taken the
decision impugned shall apply to appeal
proceedings.
(2) In the examination of the appeal, the
Board of Appeal shall invite the parties,
as often as necessary, to file observations,
within a period to be specified, on
communications issued by itself or
observations submitted by another party.
(3) If the applicant fails to reply in due
time to an invitation under paragraph 2,
the European patent application shall be
deemed to be withdrawn, unless the
decision impugned was taken by the
Legal Division.
Rule 101
Rejection of the appeal as inadmissible
(1) If the appeal does not comply with
Articles 106 to 108, Rule 97 or Rule 99,
paragraph 1(b) or (c) or paragraph 2, the
Board of Appeal shall reject it as inadmissible,
unless any deficiency has been
remedied before the relevant period
under Article 108 has expired.
(2) If the Board of Appeal notes that the
appeal does not comply with Rule 99,
paragraph 1(a), it shall communicate this
to the appellant and shall invite him to
remedy the deficiencies noted within a
period to be specified. If the deficiencies
are not remedied in due time, the Board
of Appeal shall reject the appeal as
inadmissible.
Rule 102
Form of decision of the Board of Appeal
The decision shall be authenticated by
the Chairman of the Board of Appeal
and by the competent employee of the
registry of the Board of Appeal, either by
their signature or by any other appropriate
means. The decision shall
contain:
(a) a statement that it was delivered by
the Board of Appeal;
(b) the date when the decision was
taken;

(1) Sauf s’il en est disposé autrement,
les dispositions régissant la procédure
devant l’instance qui a rendu la décision
attaquée s’appliquent à la procédure de
recours.
(2) Au cours de l’examen du recours, la
chambre de recours invite les parties,
aussi souvent qu’il est nécessaire, à
présenter, dans un délai qu’elle leur
impartit, leurs observations sur les notifications
qu’elle leur a adressées ou sur
les communications qui émanent
d’autres parties.
(3) Si le demandeur ne répond pas dans
les délais à une invitation émise conformément
au paragraphe 2, la demande
de brevet européen est réputée retirée,
àmoinsqueladécisionattaquéen’ait
été rendue par la division juridique.
Règle 101
Rejet du recours pour irrecevabilité
(1) Si le recours n’est pas conforme aux
articles 106 à 108, à la règle 97 ou à la
règle 99, paragraphe 1 b) ou c) ou paragraphe
2, la chambre de recours le
rejette comme irrecevable, à moins qu’il
n’ait été remédié aux irrégularités avant
l’expiration du délai applicable en vertu
de l’article 108.
(2) Si la chambre de recours constate
que le recours n’est pas conforme à la
règle 99, paragraphe 1 a), elle le notifie
au requérant et l’invite à remédier aux
irrégularités constatées dans un délai
qu’elle lui impartit. S’il n’est pas remédié
à ces irrégularités dans les délais, la
chambre de recours rejette le recours
comme irrecevable.
Règle 102
Forme des décisions des chambres de
recours
La décision est authentifiée par le président
de la chambre de recours et l’agent
du greffe de ladite chambre habilité à cet
effet, soit par leur signature, soit par tout
autre moyen approprié. La décision
contient :
a) l’indication qu’elle a été rendue par la
chambre de recours ;
b) la date à laquelle elle a été rendue ;
