Kapitel I<br />
Beschwerdeverfahren<br />
Regel 97<br />
Beschwerde gegen Kostenverteilung<br />
und Kostenfestsetzung<br />
(1) Die Verteilung der Kosten des<br />
Einspruchsverfahrens kann nicht<br />
einziger Gegenstand einer Beschwerde<br />
sein.<br />
(2) Eine Entscheidung über die Festsetzung<br />
des Betrags der Kosten des<br />
Einspruchsverfahrens ist mit der<br />
Beschwerde nur anfechtbar, wenn der<br />
Betrag den der Beschwerdegebühr übersteigt.<br />
Regel 98<br />
Verzicht oder Erlöschen des <strong>Patent</strong>s<br />
Beschwerde gegen die Entscheidung<br />
einer Einspruchsabteilung kann auch<br />
eingelegt werden, wenn in allen<br />
benannten Vertragsstaaten auf das<br />
europäische <strong>Patent</strong> verzichtet worden ist<br />
oder das europäische <strong>Patent</strong> in allen<br />
diesen Staaten erloschen ist.<br />
Regel 99<br />
Inhalt der Beschwerdeschrift und der<br />
Beschwerdebegründung<br />
(1) Die Beschwerdeschrift muss<br />
enthalten:<br />
a) den Namen und die Anschrift des<br />
Beschwerdeführers nach Maßgabe der<br />
Regel 41 Absatz 2 c);<br />
b) die Angabe der angefochtenen<br />
Entscheidung und<br />
c) einen Antrag, in dem der Beschwerdegegenstand<br />
festgelegt wird.<br />
(2) In der Beschwerdebegründung hat<br />
der Beschwerdeführer darzulegen, aus<br />
welchen Gründen die angefochtene<br />
Entscheidung aufzuheben oder in<br />
welchem Umfang sie abzuändern ist und<br />
auf welche Tatsachen und Beweismittel<br />
er seine Beschwerde stützt.<br />
(3) Die Vorschriften des Dritten Teils der<br />
Ausführungsordnung sind auf die<br />
Beschwerdeschrift, die Beschwerdebegründung<br />
und die im Beschwerdeverfahren<br />
eingereichten Unterlagen<br />
entsprechend anzuwenden.<br />

Appeals procedure<br />
Rule 97<br />
Appeal against apportionment and fixing<br />
of costs<br />
(1) The apportionment of costs of opposition<br />
proceedings cannot be the sole<br />
subject of an appeal.<br />
(2) A decision fixing the amount of costs<br />
of opposition proceedings cannot be<br />
appealed unless the amount exceeds<br />
that of the fee for appeal.<br />
Rule 98<br />
Surrender or lapse of the patent<br />
ThedecisionofanOppositionDivision<br />
may be appealed even if the <strong>European</strong><br />
patent has been surrendered in all the<br />
designated Contracting States or has<br />
lapsed in all those States.<br />
Rule 99<br />
Content of the notice of appeal and the<br />
statement of grounds<br />
(1) The notice of appeal shall contain:<br />
(a) the name and the address of the<br />
appellant as provided in Rule 41,<br />
paragraph 2(c);<br />
(b) an indication of the decision<br />
impugned; and<br />
(c) a request defining the subject of the<br />
appeal.<br />
(2) In the statement of grounds of appeal<br />
the appellant shall indicate the reasons<br />
for setting aside the decision impugned,<br />
or the extent to which it is to be<br />
amended, and the facts and evidence on<br />
which the appeal is based.<br />
(3) Part III of the Implementing Regulations<br />
shall apply mutatis mutandis to the<br />
notice of appeal, the statement of<br />
grounds and the documents filed in<br />
appeal proceedings.<br />

Procédure de recours<br />
Règle 97<br />
Recours contre la répartition et la fixation<br />
des frais<br />
(1) Aucun recours ne peut avoir pour<br />
seul objet la répartition des frais de la<br />
procédure d’opposition.<br />
(2) Une décision fixant le montant des<br />
frais de la procédure d’opposition ne<br />
peut faire l’objet d’un recours que si le<br />
montant est supérieur à celui de la taxe<br />
de recours.<br />
Règle 98<br />
Renonciation au brevet ou extinction de<br />
celui-ci<br />
Un recours peut être formé contre la<br />
décision d’une division d’opposition<br />
même s’il a été renoncé au brevet européen<br />
dans tous les Etats contractants<br />
désignés ou si le brevet s’est éteint dans<br />
tous ces Etats.<br />
Règle 99<br />
Contenu de l’acte de recours et du<br />
mémoire exposant les motifs du recours<br />
(1) L’acte de recours doit comporter :<br />
a) le nom et l’adresse du requérant<br />
tels que prévus à la règle 41, paragraphe<br />
2 c) ;<br />
b) l’indication de la décision attaquée, et<br />
c) une requête définissant l’objet du<br />
recours.<br />
(2) Dans le mémoire exposant les motifs<br />
du recours, le requérant doit présenter<br />
les motifs pour lesquels il y a lieu<br />
d’annuler la décision attaquée ou la<br />
mesure dans laquelle elle doit être modifiée,<br />
ainsi que les faits et les preuves sur<br />
lesquels le recours est fondé.<br />
(3) La troisième partie du règlement<br />
d’exécution s’applique à l’acte de<br />
recours, au mémoire exposant les motifs<br />
du recours et aux documents produits<br />
pendant la procédure de recours.
