EPA / Special edition No. 1 OJ EPO / Edition spéciale n° 1 JO OEB (2) Ist ein Beteiligter mit der von der Einspruchsabteilung mitgeteilten Fassung nicht einverstanden, so kann das Einspruchsverfahren fortgesetzt werden. Andernfalls fordert die Einspruchsabteilung den Patentinhaber nach Ablauf der Frist nach Absatz 1 auf, innerhalb einer Frist von drei Monaten die vorgeschriebene Gebühr zu entrichten und eine Übersetzung der geänderten Patentansprüche in den Amtssprachen des Europäischen Patentamts einzureichen, die nicht die Verfahrenssprache sind. In dieser Aufforderung werden die benannten Vertragsstaaten angegeben, die eine Übersetzung nach Artikel 65 Absatz 1 verlangen. (3) Werden die nach Absatz 2 erforderlichen Handlungen nicht rechtzeitig vorgenommen, so können sie noch innerhalb von zwei Monaten nach der Mitteilung über die Fristversäumung vorgenommen werden, sofern innerhalb dieser Frist eine Zuschlagsgebühr entrichtet wird. Andernfalls wird das Patent widerrufen. (4) In der Entscheidung, durch die das europäische Patent in geändertem Umfang aufrechterhalten wird, ist die ihr zugrunde liegende Fassung des Patents anzugeben. Regel 83 Anforderung von Unterlagen Unterlagen, die von einem am Einspruchsverfahren Beteiligten genannt werden, sind zusammen mit dem Einspruch oder dem schriftlichen Vorbringen einzureichen. Sind solche Unterlagen nicht beigefügt und werden sie nach Aufforderung durch das Europäische Patentamt nicht rechtzeitig nachgereicht, so braucht das Europäische Patentamt das darauf gestützte Vorbringen nicht zu berücksichtigen. Regel 84 Fortsetzung des Einspruchsverfahrens von Amts wegen (1) Hat der Patentinhaber in allen benannten Vertragsstaaten auf das europäische Patent verzichtet oder ist das Patent in allen diesen Staaten erloschen, so kann das Einspruchsverfahren fortgesetzt werden, wenn der Einsprechende dies innerhalb von zwei Monaten nach einer Mitteilung des Europäischen Patentamts über den Verzicht oder das Erlöschen beantragt. (2) If a party disapproves of the text communicated by the Opposition Division, examination of the opposition may be continued. Otherwise, the Opposition Division shall, on expiry of the period under paragraph 1, invite the proprietor of the patent to pay the prescribed fee and to file a translation of any amended claims in the official languages of the European Patent Office other than the language of the proceedings, within a period of three months. This invitation shall indicate the designated Contracting States which require a translation under Article 65, paragraph 1. (3) If the acts required under paragraph 2 are not performed in due time, they may still be performed within two months of a communication concerning the failure to observe the time limit, provided that a surcharge is paid within this period. Otherwise, the patent shall be revoked. (4) The decision to maintain the European patent as amended shall state which text of the patent forms the basis for the decision. Rule 83 Request for documents Documents referred to by a party to opposition proceedings shall be filed together with the notice of opposition or the written submissions. If such documents are neither enclosed nor filed in due time upon invitation by the European Patent Office, it may decide nottotakeintoaccountanyarguments based on them. Rule 84 Continuation of the opposition proceedings by the European Patent Office of its own motion (1) If the European patent has been surrendered in all the designated Contracting States or has lapsed in all those States, the opposition proceedings may be continued at the request of the opponent filed within two months of a communication from the European Patent Office informing him of the surrender or lapse. 2007 (2) Si une partie n’est pas d’accord avec le texte notifié par la division d’opposition, l’examen de l’opposition peut être poursuivi. Dans le cas contraire, la division d’opposition, à l’expiration du délai visé au paragraphe 1, invite le titulaire du brevet européen à acquitter la taxe prescrite et à produire une traduction des revendications modifiées dans les langues officielles de l’Office européen des brevets autres que celle de la procédure, dans un délai de trois mois. Dans le cas contraire, le brevet est révoqué. (4) La décision de maintenir le brevet européen sous une forme modifiée indique le texte du brevet sur la base duquel elle a été prise. Règle 83 Demande de documents Les documents mentionnés par une partie à la procédure d’opposition doivent être déposés avec l’acte d’opposition ou les conclusions écrites. Si ces documents ne sont pas joints audit acte ou auxdites conclusions ou déposés en temps utile à l’invitation de l’Office européen des brevets, celui-ci peut ne pas tenir compte des arguments à l’appui desquels ils sont invoqués. Règle 84 Poursuite d’office de la procédure d’opposition (1) Si le titulaire du brevet a renoncé au brevet européen dans tous les Etats contractants désignés ou si le brevet s’est éteint dans tous ces Etats, la procédure d’opposition peut être poursuivie sur requête de l’opposant ; cette requête doit être présentée dans un délai de deux mois à compter de la notification de l’Office européen des brevets informant l’opposant de la renonciation ou de l’extinction.

EPA / Special edition No. 1 OJ EPO / Edition spéciale n° 1 JO OEB 155 (2) Stirbt ein Einsprechender oder verliert er seine Geschäftsfähigkeit, so kann das Einspruchsverfahren auch ohne die Beteiligung seiner Erben oder gesetzlichen Vertreter von Amts wegen fortgesetzt werden. Das Verfahren kann auch fortgesetzt werden, wenn der Einspruch zurückgenommen wird. Regel 85 Rechtsübergang des europäischen Patents Regel 22 ist auf einen Rechtsübergang des europäischen Patents während der Einspruchsfrist oder der Dauer des Einspruchsverfahrens anzuwenden. Regel 86 Unterlagen im Einspruchsverfahren Die Vorschriften des Dritten Teils der Ausführungsordnung sind auf die im Einspruchsverfahren eingereichten Unterlagen entsprechend anzuwenden. Regel 87 Inhalt und Form der neuen europäischen Patentschrift Die neue europäische Patentschrift enthält die Beschreibung, Patentansprüche und Zeichnungen in der geänderten Fassung. Regel 73 Absätze 2 und 3 und Regel 74 sind anzuwenden. Regel 88 Kosten (1) Die Kostenverteilung wird in der Entscheidung über den Einspruch angeordnet. Berücksichtigt werden nur die Kosten, die zur zweckentsprechenden Wahrung der Rechte notwendig waren. Zu den Kosten gehört die Vergütung für die Vertreter der Beteiligten. (2) Die Einspruchsabteilung setzt auf Antrag den Betrag der Kosten fest, die aufgrund einer rechtskräftigen Entscheidung über deren Verteilung zu erstatten sind. Dem Antrag sind eine Kostenberechnung und die Belege beizufügen. Zur Festsetzung der Kosten genügt es, dass sie glaubhaft gemacht werden. (3) Innerhalb eines Monats nach Mitteilung der Kostenfestsetzung nach Absatz 2 kann eine Entscheidung der Einspruchsabteilung über die Kostenfestsetzung beantragt werden. Der Antrag ist schriftlich einzureichen und zu begründen. Er gilt erst als gestellt, wenn die vorgeschriebene Gebühr entrichtet worden ist. (2) In the event of the death or legal incapacity of an opponent, the opposition proceedings may be continued by the European Patent Office of its own motion, even without the participation of the heirs or legal representatives. The same shall apply where the opposition is withdrawn. Rule 85 Transfer of the European patent Rule 22 shall apply to any transfer of the European patent made during the opposition period or during opposition proceedings. Rule 86 Documents in opposition proceedings Part III of the Implementing Regulations shall apply mutatis mutandis to documents filed in opposition proceedings. Rule 87 Content and form of the new specification of the European patent The new specification of the European patent shall include the description, claims and drawings as amended. Rule 73, paragraphs 2 and 3, and Rule 74 shall apply. Rule 88 Costs (1) The apportionment of costs shall be dealt with in the decision on the opposition. Such apportionment shall only take into consideration the expenses necessary to assure proper protection of the rights involved. The costs shall include the remuneration of the representatives of the parties. (2) The Opposition Division shall, on request, fix the amount of costs to be paid under a final decision apportioning them. A bill of costs, with supporting evidence, shall be attached to the request. Costs may be fixed once their credibility is established. (3) A request for a decision by the Opposition Division may be filed within one month of the communication on the fixing of costs under paragraph 2. The request shall be filed in writing and state the grounds on which it is based. It shall not be deemed to be filed until the prescribed fee has been paid. Règle 87 Contenu et forme du nouveau fascicule du brevet européen Le nouveau fascicule du brevet européen comprend la description, les revendications et les dessins tels que modifiés. La règle 73, paragraphes 2 et 3, et la règle 74 sont applicables. Règle 88 Frais (1) La répartition des frais est ordonnée dans la décision rendue sur l’opposition. Seules sont prises en considération les dépenses nécessaires pour assurer une défense adéquate des droits en cause. Les frais incluent la rémunération des représentants des parties. (2)Ladivisiond’opposition fixe sur requête le montant des frais à rembourser en vertu d’une décision de répartition des frais passée en force de chose jugée. La requête doit être présentée par écrit et motivée. Elle n’est réputée présentée qu’après le paiement de la taxe prescrite.
