(2) Ist ein Beteiligter mit der von der<br />
Einspruchsabteilung mitgeteilten<br />
Fassung nicht einverstanden, so kann<br />
das Einspruchsverfahren fortgesetzt<br />
werden. Andernfalls fordert die<br />
Einspruchsabteilung den <strong>Patent</strong>inhaber<br />
nach Ablauf der Frist nach Absatz 1 auf,<br />
innerhalb einer Frist von drei Monaten<br />
die vorgeschriebene Gebühr zu<br />
entrichten und eine Übersetzung der<br />
geänderten <strong>Patent</strong>ansprüche in den<br />
Amtssprachen des Europäischen<br />
<strong>Patent</strong>amts einzureichen, die nicht<br />
die Verfahrenssprache sind. In dieser<br />
Aufforderung werden die benannten<br />
Vertragsstaaten angegeben, die eine<br />
Übersetzung nach Artikel 65 Absatz 1<br />
verlangen.<br />
(3) Werden die nach Absatz 2 erforderlichen<br />
Handlungen nicht rechtzeitig<br />
vorgenommen, so können sie noch<br />
innerhalb von zwei Monaten nach der<br />
Mitteilung über die Fristversäumung<br />
vorgenommen werden, sofern innerhalb<br />
dieser Frist eine Zuschlagsgebühr<br />
entrichtet wird. Andernfalls wird das<br />
<strong>Patent</strong> widerrufen.<br />
(4) In der Entscheidung, durch die das<br />
europäische <strong>Patent</strong> in geändertem<br />
Umfang aufrechterhalten wird, ist die ihr<br />
zugrunde liegende Fassung des <strong>Patent</strong>s<br />
anzugeben.<br />
Regel 83<br />
Anforderung von Unterlagen<br />
Unterlagen, die von einem am<br />
Einspruchsverfahren Beteiligten genannt<br />
werden, sind zusammen mit dem<br />
Einspruch oder dem schriftlichen<br />
Vorbringen einzureichen. Sind solche<br />
Unterlagen nicht beigefügt und werden<br />
sie nach Aufforderung durch das Europäische<br />
<strong>Patent</strong>amt nicht rechtzeitig<br />
nachgereicht, so braucht das Europäische<br />
<strong>Patent</strong>amt das darauf gestützte<br />
Vorbringen nicht zu berücksichtigen.<br />
Regel 84<br />
Fortsetzung des Einspruchsverfahrens<br />
von Amts wegen<br />
(1) Hat der <strong>Patent</strong>inhaber in allen<br />
benannten Vertragsstaaten auf das<br />
europäische <strong>Patent</strong> verzichtet oder ist<br />
das <strong>Patent</strong> in allen diesen Staaten erloschen,<br />
so kann das Einspruchsverfahren<br />
fortgesetzt werden, wenn der Einsprechende<br />
dies innerhalb von zwei Monaten<br />
nach einer Mitteilung des Europäischen<br />
<strong>Patent</strong>amts über den Verzicht oder das<br />
Erlöschen beantragt.<br />
(2) If a party disapproves of the text<br />
communicated by the Opposition Division,<br />
examination of the opposition may<br />
be continued. Otherwise, the Opposition<br />
Division shall, on expiry of the period<br />
under paragraph 1, invite the proprietor<br />
of the patent to pay the prescribed fee<br />
and to file a translation of any amended<br />
claims in the official languages of the<br />
<strong>European</strong> <strong>Patent</strong> <strong>Office</strong> other than the<br />
language of the proceedings, within a<br />
period of three months. This invitation<br />
shall indicate the designated Contracting<br />
States which require a translation under<br />
Article 65, paragraph 1.<br />
(3) If the acts required under paragraph<br />
2 are not performed in due time, they<br />
may still be performed within two months<br />
of a communication concerning the<br />
failure to observe the time limit, provided<br />
that a surcharge is paid within this<br />
period. Otherwise, the patent shall be<br />
revoked.<br />
(4) The decision to maintain the<br />
<strong>European</strong> patent as amended shall state<br />
which text of the patent forms the basis<br />
for the decision.<br />
Rule 83<br />
Request for documents<br />
Documents referred to by a party to<br />
opposition proceedings shall be filed<br />
together with the notice of opposition or<br />
the written submissions. If such documents<br />
are neither enclosed nor filed in<br />
due time upon invitation by the<br />
<strong>European</strong> <strong>Patent</strong> <strong>Office</strong>, it may decide<br />
nottotakeintoaccountanyarguments<br />
based on them.<br />
Rule 84<br />
Continuation of the opposition proceedings<br />
by the <strong>European</strong> <strong>Patent</strong> <strong>Office</strong> of its<br />
own motion<br />
(1) If the <strong>European</strong> patent has been<br />
surrendered in all the designated<br />
Contracting States or has lapsed in all<br />
those States, the opposition proceedings<br />
may be continued at the request of the<br />
opponent filed within two months of a<br />
communication from the <strong>European</strong><br />
<strong>Patent</strong> <strong>Office</strong> informing him of the<br />
surrender or lapse.<br />

(2) Si une partie n’est pas d’accord avec<br />
le texte notifié par la division d’opposition,<br />
l’examen de l’opposition peut être<br />
poursuivi. Dans le cas contraire, la division<br />
d’opposition, à l’expiration du délai<br />
visé au paragraphe 1, invite le titulaire<br />
du brevet européen à acquitter la taxe<br />
prescrite et à produire une traduction<br />
des revendications modifiées dans les<br />
langues officielles de l’<strong>Office</strong> européen<br />
des brevets autres que celle de la procédure,<br />
dans un délai de trois mois. Cette<br />
invitation indique les Etats contractants<br />
désignés qui exigent une traduction en<br />
vertu de l’article 65, paragraphe 1.<br />
(3) Si les actes requis au paragraphe 2<br />
ne sont pas accomplis dans les délais,<br />
ils peuvent encore être accomplis dans<br />
un délai de deux mois à compter de la<br />
notification signalant que le délai prévu<br />
n’a pasétéobservé,sousréservedu<br />
paiement d’une surtaxe dans ce délai.<br />
Dans le cas contraire, le brevet est<br />
révoqué.<br />
(4) La décision de maintenir le brevet<br />
européen sous une forme modifiée<br />
indique le texte du brevet sur la base<br />
duquel elle a été prise.<br />
Règle 83<br />
Demande de documents<br />
Les documents mentionnés par une<br />
partie à la procédure d’opposition<br />
doivent être déposés avec l’acte d’opposition<br />
ou les conclusions écrites. Si ces<br />
documents ne sont pas joints audit acte<br />
ou auxdites conclusions ou déposés en<br />
temps utile à l’invitation de l’<strong>Office</strong> européen<br />
des brevets, celui-ci peut ne pas<br />
tenir compte des arguments à l’appui<br />
desquels ils sont invoqués.<br />
Règle 84<br />
Poursuite d’office de la procédure<br />
d’opposition<br />
(1) Si le titulaire du brevet a renoncé au<br />
brevet européen dans tous les Etats<br />
contractants désignés ou si le brevet<br />
s’est éteint dans tous ces Etats, la<br />
procédure d’opposition peut être poursuivie<br />
sur requête de l’opposant ; cette<br />
requête doit être présentée dans un<br />
délai de deux mois à compter de la notification<br />
de l’<strong>Office</strong> européen des brevets<br />
informant l’opposant de la renonciation<br />
ou de l’extinction.
