Regel 80<br />
Änderung des europäischen <strong>Patent</strong>s<br />
Unbeschadet der Regel 138 können die<br />
Beschreibung, die <strong>Patent</strong>ansprüche und<br />
die Zeichnungen geändert werden,<br />
soweit die Änderungen durch einen<br />
Einspruchsgrund nach Artikel 100 veranlasst<br />
sind, auch wenn dieser vom<br />
Einsprechenden nicht geltend gemacht<br />
worden ist.<br />
Regel 81<br />
Prüfung des Einspruchs<br />
(1) Die Einspruchsabteilung prüft die<br />
Einspruchsgründe, die in der Erklärung<br />
des Einsprechenden nach Regel 76<br />
Absatz 2 c) geltend gemacht worden<br />
sind. Sie kann von Amts wegen auch<br />
vom Einsprechenden nicht geltend<br />
gemachte Einspruchsgründe prüfen,<br />
wenn diese der Aufrechterhaltung des<br />
europäischen <strong>Patent</strong>s entgegenstehen<br />
würden.<br />
(2) Bescheide nach Artikel 101 Absatz 1<br />
Satz 2 und alle hierzu eingehenden Stellungnahmen<br />
werden den Beteiligten<br />
übersandt. Die Einspruchsabteilung<br />
fordert, wenn sie dies für sachdienlich<br />
erachtet, die Beteiligten auf, sich innerhalb<br />
einer zu bestimmenden Frist hierzu<br />
zu äußern.<br />
(3) In den Bescheiden nach Artikel 101<br />
Absatz 1 Satz 2 wird dem <strong>Patent</strong>inhaber<br />
gegebenenfalls Gelegenheit gegeben,<br />
soweit erforderlich die Beschreibung, die<br />
<strong>Patent</strong>ansprüche und die Zeichnungen<br />
zu ändern. Die Bescheide sind soweit<br />
erforderlich zu begründen, wobei die<br />
Gründe zusammengefasst werden<br />
sollen, die der Aufrechterhaltung des<br />
europäischen <strong>Patent</strong>s entgegenstehen.<br />
Regel 82<br />
Aufrechterhaltung des europäischen<br />
<strong>Patent</strong>s in geändertem Umfang<br />
(1) Bevor die Einspruchsabteilung die<br />
Aufrechterhaltung des europäischen<br />
<strong>Patent</strong>s in geändertem Umfang<br />
beschließt, teilt sie den Beteiligten mit, in<br />
welcher Fassung sie das <strong>Patent</strong><br />
aufrechtzuerhalten beabsichtigt, und<br />
fordert sie auf, innerhalb von zwei<br />
Monaten Stellung zu nehmen, wenn sie<br />
mit dieser Fassung nicht einverstanden<br />
sind.<br />
Rule 80<br />
Amendment of the <strong>European</strong> patent<br />
Without prejudice to Rule 138, the<br />
description, claims and drawings may be<br />
amended, provided that the amendments<br />
are occasioned by a ground for<br />
opposition under Article 100, even if that<br />
ground has not been invoked by the<br />
opponent.<br />
Rule 81<br />
Examination of opposition<br />
(1) The Opposition Division shall<br />
examine those grounds for opposition<br />
which are invoked in the opponent’s<br />
statement under Rule 76, paragraph 2(c).<br />
Grounds for opposition not invoked by<br />
the opponent may be examined by the<br />
Opposition Division of its own motion if<br />
they would prejudice the maintenance of<br />
the <strong>European</strong> patent.<br />
(2) Communications under Article 101,<br />
paragraph 1, second sentence, and all<br />
replies thereto shall be sent to all parties.<br />
If the opposition division considers this<br />
expedient, it shall invite the parties to<br />
reply within a period to be specified.<br />
(3) In any communication under Article<br />
101, paragraph 1, second sentence, the<br />
proprietor of the <strong>European</strong> patent shall,<br />
where necessary, be given the opportunity<br />
to amend, where appropriate, the<br />
description, claims and drawings. Where<br />
necessary, the communication shall<br />
contain a reasoned statement covering<br />
the grounds against the maintenance of<br />
the <strong>European</strong> patent.<br />
Rule 82<br />
Maintenance of the <strong>European</strong> patent in<br />
amended form<br />
(1) Before the Opposition Division<br />
decides to maintain the <strong>European</strong> patent<br />
as amended, it shall inform the parties of<br />
the text in which it intends to maintain<br />
the patent, and shall invite them to file<br />
their observations within two months if<br />
they disapprove of that text.<br />

Modification du brevet européen<br />
Sans préjudice de la règle 138, la<br />
description, les revendications et les<br />
dessins peuvent être modifiés dans la<br />
mesure où ces modifications sont apportées<br />
pour pouvoir répondre à un motif<br />
d’opposition visé à l’article 100, même<br />
si ce motif n’a pas été invoqué par<br />
l’opposant.<br />
Règle 81<br />
Examen de l’opposition<br />
(1)Ladivisiond’opposition examine les<br />
motifs d’opposition qui sont invoqués<br />
dans la déclaration de l’opposant visée à<br />
la règle 76, paragraphe 2 c). Elle peut<br />
également examiner d’office les motifs<br />
d’opposition qui n’ont pas été invoqués<br />
par l’opposant s’ils sont susceptibles de<br />
s’opposer au maintien du brevet européen.<br />
(2) Les notifications émises conformément<br />
à l’article 101, paragraphe 1,<br />
deuxième phrase, ainsi que les<br />
réponses à ces notifications sont<br />
envoyées à toutes les parties. Si la division<br />
d’opposition le juge opportun, elle<br />
invite les parties à répliquer dans un<br />
délai qu’elle leur impartit.<br />
(3) Dans toute notification émise conformément<br />
à l’article 101, paragraphe 1,<br />
deuxième phrase, il doit, si nécessaire,<br />
être donné au titulaire du brevet la possibilité<br />
de modifier, s’il y a lieu, la description,<br />
les revendications et les dessins. Si<br />
nécessaire, la notification est motivée et<br />
indique les motifs qui s’opposent au<br />
maintien du brevet européen.<br />
Règle 82<br />
Maintien du brevet européen sous une<br />
forme modifiée<br />
(1) Avant de prendre la décision de<br />
maintenir le brevet européen sous une<br />
forme modifiée, la division d’opposition<br />
notifie aux parties le texte dans lequel<br />
elle envisage de maintenir le brevet et<br />
les invite à présenter leurs observations<br />
dans un délai de deux mois si elles ne<br />
sont pas d’accord avec ce texte.
