Kapitel V Europäische Patentschrift Regel 73 Inhalt und Form der Patentschrift (1) Die europäische Patentschrift enthält die Beschreibung, die Patentansprüche und gegebenenfalls die Zeichnungen. Außerdem wird darin die Frist für den Einspruch gegen das europäische Patent angegeben. (2) Der Präsident des Europäischen Patentamts bestimmt, in welcher Form die Patentschrift veröffentlicht wird und welche Angaben sie enthält. (3) In der Patentschrift werden die benannten Vertragsstaaten angegeben. Regel 74 Urkunde über das europäische Patent Sobald die europäische Patentschrift veröffentlicht worden ist, stellt das Europäische Patentamt dem Patentinhaber die Urkunde über das europäische Patent aus. Der Präsident des Europäischen Patentamts bestimmt den Inhalt und die Form der Urkunde sowie die Art und Weise, wie sie übermittelt wird, und legt fest, in welchen Fällen eine Verwaltungsgebühr zu entrichten ist. FÜNFTER TEIL AUSFÜHRUNGSVORSCHRIFTEN ZUM FÜNFTEN TEIL DES ÜBEREINKOMMENS Kapitel I Einspruchsverfahren Regel 75 Verzicht oder Erlöschen des Patents Einspruch kann auch eingelegt werden, wenn in allen benannten Vertragsstaaten auf das europäische Patent verzichtet worden ist oder das Patent in allen diesen Staaten erloschen ist. Rule 72 Grant of the European patent to different applicants Where different persons are recorded in the European Patent Register as applicants in respect of different Contracting States, the European Patent Office shall grant the European patent for each Contracting State accordingly. Chapter V The European patent specification Rule 73 Content and form of the specification (1) The specification of the European patent shall include the description, the claims and any drawings. It shall also indicate the period for opposing the European patent. (2) The President of the European Patent Office shall determine the form of the publication of the specification and the data to be included. (3) The designated Contracting States shall be indicated in the specification. Rule 74 Certificate for a European patent As soon as the specification of the European patent has been published, the European Patent Office shall issue to the proprietor of the patent a certificate for a European patent. The President of the European Patent Office shall prescribe the content, form and means of communication of the certificate and determine the circumstances in which an administrative fee is payable. PART V IMPLEMENTING REGULATIONS TO PART V OF THE CONVENTION Chapter I Opposition procedure Rule 75 Surrender or lapse of the patent An opposition may be filed even if the European patent has been surrendered in all the designated Contracting States or has lapsed in all those States. Chapitre V Fascicule du brevet européen Règle 73 Contenu et forme du fascicule (1) Le fascicule du brevet européen comprend la description, les revendications et, le cas échéant, les dessins. Il mentionne également le délai pendant lequel le brevet européen peut faire l’objet d’une opposition. (2) Le Président de l’Office européen des brevets détermine la forme sous laquelle le fascicule est publié ainsi que les indications qui doivent y figurer. (3) Les Etats contractants désignés sont indiqués dans le fascicule. Règle 74 Certificat de brevet européen Dès que le fascicule du brevet européen a été publié, l’Office européen des brevets délivre au titulaire du brevet un certificat de brevet européen. Le Président de l’Office européen des brevets arrête le contenu, la forme et les moyens de communication du certificat et détermine les cas dans lesquels il y a lieu d’acquitter une taxe d’administration. CINQUIEME PARTIE DISPOSITIONS D’APPLICATION DE LA CINQUIEME PARTIE DE LA CONVENTION Chapitre 1 Procédure d’opposition Règle 75 Renonciation au brevet ou extinction de celui-ci Une opposition peut être formée même s’il a été renoncé au brevet européen dans tous les Etats contractants désignés ou si le brevet s’est éteint dans tous ces Etats.

(2) Die Einspruchsschrift muss enthalten: a) Angaben zur Person des Einsprechenden nach Maßgabe der Regel 41 Absatz 2 c); b) die Nummer des europäischen Patents, gegen das der Einspruch eingelegt wird, sowie den Namen des Patentinhabers und die Bezeichnung der Erfindung; c) eine Erklärung darüber, in welchem Umfang gegen das europäische Patent Einspruch eingelegt und auf welche Einspruchsgründe der Einspruch gestützt wird, sowie die Angabe der zur Begründung vorgebrachten Tatsachen und Beweismittel; d) falls ein Vertreter des Einsprechenden bestellt ist, Angaben zur Person nach Maßgabe der Regel 41 Absatz 2 d). (3) Die Vorschriften des Dritten Teils der Ausführungsordnung sind auf die Einspruchsschrift entsprechend anzuwenden. Regel 77 Verwerfung des Einspruchs als unzulässig (1) Stellt die Einspruchsabteilung fest, dass der Einspruch Artikel 99 Absatz 1 oder Regel 76 Absatz 2 c) nicht entspricht oder das europäische Patent, gegen das Einspruch eingelegt worden ist, nicht hinreichend bezeichnet ist, so verwirft sie den Einspruch als unzulässig, sofern die Mängel nicht bis zum Ablauf der Einspruchsfrist beseitigt worden sind. (2) Stellt die Einspruchsabteilung fest, dass der Einspruch anderen als den in Absatz 1 bezeichneten Vorschriften nicht entspricht, so teilt sie dies dem Einsprechenden mit und fordert ihn auf, innerhalb einer zu bestimmenden Frist die festgestellten Mängel zu beseitigen. Werden diese nicht rechtzeitig beseitigt, so verwirft die Einspruchsabteilung den Einspruch als unzulässig. (3) Die Entscheidung, durch die ein Einspruch als unzulässig verworfen wird, wird dem Patentinhaber mit einer Abschrift des Einspruchs mitgeteilt. Rule 76 Form and content of the opposition (1) Notice of opposition shall be filed in a written reasoned statement. (2) The notice of opposition shall contain: (a) particulars of the opponent as provided in Rule 41, paragraph 2(c); (b) the number of the European patent against which opposition is filed, the name of the proprietor of the patent and the title of the invention; (c) a statement of the extent to which the European patent is opposed and of the grounds on which the opposition is based, as well as an indication of the facts and evidence presented in support of these grounds; (d) if the opponent has appointed a representative, particulars as provided in Rule 41, paragraph 2(d). (3) Part III of the Implementing Regulations shall apply mutatis mutandis to the notice of opposition. Rule 77 Rejection of the opposition as inadmissible (1) If the Opposition Division notes that the notice of opposition does not comply with the provisions of Article 99, paragraph 1, or Rule 76, paragraph 2(c), or does not sufficiently identify the patent against which opposition has been filed, it shall reject the opposition as inadmissible, unless these deficiencies have been remedied before expiry of the opposition period. (2) If the Opposition Division notes that the notice of opposition does not comply with provisions other than those referred to in paragraph 1, it shall communicate this to the opponent and shall invite him to remedy the deficiencies noted within a period to be specified. If the deficiencies are not remedied in due time, the Opposition Division shall reject the opposition as inadmissible. (3) The decision to reject an opposition as inadmissible shall be communicated to the proprietor of the patent, together with a copy of the notice of opposition. Règle 76 Forme et contenu de l’opposition (1) L’opposition doit être formée par écrit et motivée. (2) L’acte d’opposition doit contenir : a) les indications concernant l’opposant telles que prévues à la règle 41, paragraphe 2 c) ; b) le numéro du brevet européen contre lequel l’opposition est formée, ainsi que le nom du titulaire du brevet et le titre de l’invention ; c) une déclaration précisant la mesure dans laquelle le brevet européen est mis en cause par l’opposition, les motifs sur lesquels l’opposition se fonde ainsi que les faits et les preuves invoqués à l’appui de ces motifs ; d) si l’opposant a constitué un mandataire, les indications concernant le mandataire telles que prévues à la règle 41, paragraphe 2 d). (3) La troisième partie du règlement d’exécution s’applique à l’acte d’opposition. Règle 77 Rejet de l’opposition pour irrecevabilité (1) Si la division d’opposition constate que l’opposition n’est pas conforme à l’article 99, paragraphe 1, ou à la règle 76, paragraphe 2 c), ou ne désigne pas le brevet en cause de manière suffisante, elle rejette l’opposition comme irrecevable, à moins qu’il n’ait été remédié à ces irrégularités avant l’expiration du délai d’opposition. (2) Si la division d’opposition constate que l’opposition n’est pas conforme aux dispositions autres que celles visées au paragraphe 1, elle le notifie à l’opposant et l’invite à remédier, dans un délai qu’elle lui impartit, aux irrégularités constatées. S’il n’est pas remédié à ces irrégularités dans les délais, la division d’opposition rejette l’opposition comme irrecevable. (3) La décision par laquelle une opposition est rejetée pour irrecevabilité est notifiée, avec une copie de l’acte d’opposition, au titulaire du brevet.
