(4) Wurden die <strong>Patent</strong>ansprüche nicht<br />
am Anmeldetag eingereicht, wird dies<br />
bei der Veröffentlichung angegeben.<br />
Sind vor Abschluss der technischen<br />
Vorbereitungen für die Veröffentlichung<br />
der Anmeldung die <strong>Patent</strong>ansprüche<br />
nach Regel 137 Absatz 2 geändert<br />
worden, so werden neben den <strong>Patent</strong>ansprüchen<br />
in der ursprünglich eingereichten<br />
Fassung auch die neuen oder<br />
geänderten <strong>Patent</strong>ansprüche veröffentlicht.<br />
Regel 69<br />
Mitteilungen über die Veröffentlichung<br />
(1) Das Europäische <strong>Patent</strong>amt teilt dem<br />
Anmelder den Tag mit, an dem im Europäischen<br />
<strong>Patent</strong>blatt auf die Veröffentlichung<br />
des europäischen Recherchenberichts<br />
hingewiesen wird, und weist ihn<br />
auf Regel 70 Absatz 1 und Artikel 94<br />
Absatz 2 hin.<br />
(2) Der Anmelder kann aus der Unterlassung<br />
der Mitteilung nach Absatz 1 keine<br />
Ansprüche herleiten. Ist in der Mitteilung<br />
ein späterer Tag der Veröffentlichung<br />
angegeben, so ist für die Frist zur Stellung<br />
des Prüfungsantrags der spätere<br />
Tag maßgebend, wenn der Fehler nicht<br />
ohne Weiteres erkennbar war.<br />
Regel 70<br />
Prüfungsantrag<br />
(1) Der Anmelder kann bis zum Ablauf<br />
von sechs Monaten nach dem Tag, an<br />
dem im Europäischen <strong>Patent</strong>blatt auf die<br />
Veröffentlichung des europäischen<br />
Recherchenberichts hingewiesen<br />
worden ist, die Prüfung der europäischen<br />
<strong>Patent</strong>anmeldung beantragen.<br />
Der Antrag kann nicht zurückgenommen<br />
werden.<br />
(2) Wird der Prüfungsantrag gestellt,<br />
bevor dem Anmelder der europäische<br />
Recherchenbericht übermittelt worden<br />
ist, so fordert das Europäische<br />
<strong>Patent</strong>amt den Anmelder auf, innerhalb<br />
einer zu bestimmenden Frist zu erklären,<br />
ob er die Anmeldung aufrechterhält, und<br />
gibt ihm Gelegenheit, zu dem Recherchenbericht<br />
Stellung zu nehmen und<br />
gegebenenfalls die Beschreibung, die<br />
<strong>Patent</strong>ansprüche und die Zeichnungen<br />
zu ändern.<br />
(3) Unterlässt es der Anmelder, auf die<br />
Aufforderung nach Absatz 2 rechtzeitig<br />
zu antworten, so gilt die Anmeldung als<br />
zurückgenommen.<br />
(4) If the patent claims were not filed on<br />
the date of filing of the application, this<br />
shall be indicated when the application<br />
is published. If, before the termination of<br />
the technical preparations for publication<br />
of the application, the claims have been<br />
amended under Rule 137, paragraph 2,<br />
the new or amended claims shall be<br />
included in the publication in addition to<br />
the claims as filed.<br />
Rule 69<br />
Information about publication<br />
(1) The <strong>European</strong> <strong>Patent</strong> <strong>Office</strong> shall<br />
inform the applicant of the date on which<br />
the <strong>European</strong> <strong>Patent</strong> Bulletin mentions<br />
the publication of the <strong>European</strong> search<br />
report and shall draw his attention to<br />
Rule 70, paragraph 1, and Article 94,<br />
paragraph 2.<br />
(2) The applicant may not invoke the<br />
omission of the communication under<br />
paragraph 1. If a later date of publication<br />
is specified in the communication, that<br />
later date shall be the decisive date as<br />
regards the period for filing the request<br />
for examination, unless the error is<br />
obvious.<br />
Rule 70<br />
Request for examination<br />
(1) The applicant may request examination<br />
of the <strong>European</strong> patent application<br />
up to six months after the date on which<br />
the <strong>European</strong> <strong>Patent</strong> Bulletin mentions<br />
the publication of the <strong>European</strong> search<br />
report. The request may not be withdrawn.<br />
(2) If the request for examination has<br />
been filed before the <strong>European</strong> search<br />
report has been transmitted to the applicant,<br />
the <strong>European</strong> <strong>Patent</strong> <strong>Office</strong> shall<br />
invite the applicant to indicate, within a<br />
period to be specified, whether he<br />
wishes to proceed further with the application,<br />
and shall give him the opportunity<br />
to comment on the search report and to<br />
amend, where appropriate, the description,<br />
claims and drawings.<br />
(3) If the applicant fails to reply in due<br />
time to the invitation under paragraph 2,<br />
the application shall be deemed to be<br />
withdrawn.<br />
(4) Si les revendications n’ont pas été<br />
déposées à la date de dépôt de la<br />
demande, cela est indiqué lors de la<br />
publication. Si, avant la fin des préparatifs<br />
techniques entrepris en vue de la<br />
publication de la demande, les revendications<br />
ont été modifiées en vertu de la<br />
règle 137, paragraphe 2, les revendications<br />
nouvelles ou modifiées figurent<br />
dans la publication en sus des revendications<br />

Règle 69<br />
Renseignements concernant la<br />
publication<br />
(1) L’<strong>Office</strong> européen des brevets notifie<br />
au demandeur la date à laquelle le<br />
Bulletin européen des brevets<br />
mentionne la publication du rapport de<br />
recherche européenne et appelle son<br />
attention sur les dispositions de la<br />
règle 70, paragraphe 1, et de l’article 94,<br />
paragraphe 2.<br />
(2) Le demandeur ne peut se prévaloir<br />
de l’omission de la notification visée au<br />
paragraphe 1. Si la notification indique<br />
une date postérieure à celle de la publication,<br />
la date postérieure est considérée<br />
comme déterminante pour le délai<br />
de présentation de la requête en<br />
examen, à moins que l’erreur ne soit<br />
évidente.<br />
Règle 70<br />
Requête en examen<br />
(1) Le demandeur peut présenter une<br />
requête en examen de la demande de<br />
brevet européen jusqu’à l’expiration d’un<br />
délai de six mois à compter de la date à<br />
laquelle le Bulletin européen des brevets<br />
a mentionné la publication du rapport de<br />
recherche européenne. La requête ne<br />
peut pas être retirée.<br />
(2) Si la requête en examen est<br />
présentée avant que le rapport de<br />
recherche européenne ait été transmis<br />
au demandeur, l’<strong>Office</strong> européen des<br />
brevets invite le demandeur à déclarer,<br />
dans un délai qu’il lui impartit, s’il<br />
souhaite maintenir sa demande, et lui<br />
donne la possibilité de prendre position<br />
sur le rapport de recherche européenne<br />
et de modifier, s’il y a lieu, la description,<br />
les revendications et les dessins.<br />
(3) Si le demandeur ne répond pas dans<br />
les délais à l’invitation émise conformément<br />
au paragraphe 2, la demande est<br />
réputée retirée.
