Regel 63<br />
Unvollständige Recherche<br />
Ist das Europäische <strong>Patent</strong>amt der<br />
Auffassung, dass die europäische<br />
<strong>Patent</strong>anmeldung diesem Übereinkommen<br />
so wenig entspricht, dass es<br />
unmöglich ist, auf der Grundlage des<br />
gesamten beanspruchten Gegenstands<br />
oder eines Teils desselben sinnvolle<br />
Ermittlungen über den Stand der Technik<br />
durchzuführen, so stellt es dies in einer<br />
begründeten Erklärung fest oder erstellt,<br />
soweit dies durchführbar ist, einen teilweisen<br />
Recherchenbericht. Diese Erklärung<br />
oder dieser Bericht gelten für das<br />
weitere Verfahren als europäischer<br />
Recherchenbericht.<br />
Regel 64<br />
Europäischer Recherchenbericht bei<br />
mangelnder Einheitlichkeit<br />
(1) Entspricht die europäische <strong>Patent</strong>anmeldung<br />
nach Auffassung des Europäischen<br />
<strong>Patent</strong>amts nicht den Anforderungen<br />
an die Einheitlichkeit der Erfindung,<br />
so erstellt es einen teilweisen<br />
Recherchenbericht für die Teile der<br />
Anmeldung, die sich auf die in den<br />
<strong>Patent</strong>ansprüchen zuerst erwähnte<br />
Erfindung oder Gruppe von Erfindungen<br />
im Sinne des Artikels 82 beziehen. Es<br />
teilt dem Anmelder mit, dass für jede<br />
weitere Erfindung innerhalb einer zu<br />
bestimmenden Frist, die nicht kürzer als<br />
zwei Wochen sein und sechs Wochen<br />
nicht übersteigen darf, eine weitere<br />
Recherchengebühr zu entrichten ist,<br />
wenn der europäische Recherchenbericht<br />
diese Erfindung erfassen soll. Der<br />
europäische Recherchenbericht wird für<br />
die Teile der Anmeldung erstellt, die sich<br />
auf die Erfindungen beziehen, für die<br />
Recherchengebühren entrichtet worden<br />
sind.<br />
(2) Eine nach Absatz 1 gezahlte Recherchengebühr<br />
wird zurückgezahlt, wenn<br />
der Anmelder dies im Verlauf der Prüfung<br />
der europäischen <strong>Patent</strong>anmeldung<br />
beantragt und die Prüfungsabteilung<br />
feststellt, dass die Mitteilung nach<br />
Absatz 1 nicht gerechtfertigt war.<br />
Regel 65<br />
Übermittlung des europäischen<br />
Recherchenberichts<br />
Der europäische Recherchenbericht wird<br />
unmittelbar nach seiner Erstellung dem<br />
Anmelder zusammen mit den<br />
Abschriften aller angeführten Schriftstücke<br />
übermittelt.<br />
Rule 63<br />
Incomplete search<br />
If the <strong>European</strong> <strong>Patent</strong> <strong>Office</strong> considers<br />
that the <strong>European</strong> patent application<br />
does not comply with this Convention to<br />
such an extent that it is impossible to<br />
carry out a meaningful search into the<br />
state of the art on the basis of all or<br />
some of the subject-matter claimed, it<br />
shall either issue a reasoned declaration<br />
to that effect or, as far as is practicable,<br />
draw up a partial search report. The<br />
declaration or the partial report shall be<br />
considered, for the purposes of subsequent<br />
proceedings, as the <strong>European</strong><br />
search report.<br />
Rule 64<br />
<strong>European</strong> search report where the<br />
invention lacks unity<br />
(1) If the <strong>European</strong> <strong>Patent</strong> <strong>Office</strong><br />
considers that the <strong>European</strong> patent<br />
application does not comply with the<br />
requirement of unity of invention, it shall<br />
draw up a partial search report on those<br />
parts of the application which relate to<br />
the invention, or the group of inventions<br />
within the meaning of Article 82, first<br />
mentioned in the claims. It shall inform<br />
the applicant that for the <strong>European</strong><br />
search report to cover the other inventions,<br />
a further search fee must be paid,<br />
in respect of each invention involved,<br />
within a period to be specified, which<br />
shall neither be shorter than two weeks<br />
nor exceed six weeks. The <strong>European</strong><br />
search report shall be drawn up for the<br />
parts of the application relating to inventions<br />
in respect of which search fees<br />
have been paid.<br />
(2) Any fee paid under paragraph 1 shall<br />
be refunded if, during the examination of<br />
the <strong>European</strong> patent application, the<br />
applicant requests a refund and the<br />
Examining Division finds that the<br />
communication under paragraph 1 was<br />
not justified.<br />
Rule 65<br />
Transmittal of the <strong>European</strong> search<br />
report<br />
Immediately after it has been drawn up,<br />
the <strong>European</strong> search report shall be<br />
transmitted to the applicant together with<br />
copies of any cited documents.<br />

Recherche incomplète<br />
Si l’<strong>Office</strong> européen des brevets estime<br />
que la demande de brevet européen<br />
n’est pas conforme aux dispositions de<br />
la convention, au point qu’une recherche<br />
significative sur l’état de la technique ne<br />
peut être effectuée au regard de tout ou<br />
partie de l’objet revendiqué, il établit soit<br />
une déclaration motivée à cet effet, soit,<br />
dans la mesure du possible, un rapport<br />
partiel de recherche européenne. La<br />
déclaration ou le rapport partiel est<br />
considéré, aux fins de la procédure ultérieure,<br />
comme le rapport de recherche<br />
européenne.<br />
Règle 64<br />
Rapport de recherche européenne en<br />
cas d’absence d’unité d’invention<br />
(1) Si l’<strong>Office</strong> européen des brevets<br />
estime que la demande de brevet européen<br />
ne satisfait pas à l’exigence d’unité<br />
d’invention, il établit un rapport partiel de<br />
recherche pour les parties de la<br />
demande qui se rapportent à l’invention,<br />
ou à la pluralité d’inventions au sens de<br />
l’article 82, mentionnée en premier lieu<br />
dans les revendications. Il notifie au<br />
demandeur que si le rapport de<br />
recherche européenne doit couvrir les<br />
autres inventions, une nouvelle taxe de<br />
recherche doit être acquittée pour<br />
chaque invention concernée dans un<br />
délai qu’il lui impartit et qui ne doit être ni<br />
inférieur à deux semaines ni supérieur à<br />
six semaines. Le rapport de recherche<br />
européenne est établi pour les parties de<br />
la demande qui se rapportent aux inventions<br />
pour lesquelles les taxes de<br />
recherche ont été acquittées.<br />
(2) Toute taxe acquittée en vertu du<br />
paragraphe 1 est remboursée si, au<br />
cours de l’examen de la demande de<br />
brevet européen, le demandeur le<br />
requiert et si la division d’examen<br />
constate que la notification émise conformément<br />
au paragraphe 1 n’était pas<br />
justifiée.<br />
Règle 65<br />
Transmission du rapport de recherche<br />
européenne<br />
Dès qu’il est établi, le rapport de<br />
recherche européenne est transmis au<br />
demandeur avec les copies de tous les<br />
documents cités.
