EPA / Special edition No. 1 OJ EPO / Edition spéciale n° 1 JO OEB (6) Innerhalb eines Monats nach der in Absatz 2 oder 5 letzter Satz genannten Mitteilung kann der Anmelder die eingereichten fehlenden Teile der Beschreibung oder fehlenden Zeichnungen zurücknehmen; in diesem Fall gilt die Neufestsetzung des Anmeldetags als nicht erfolgt. Das Europäische Patentamt unterrichtet den Anmelder entsprechend. Regel 57 Formalprüfung Steht der Anmeldetag einer europäischen Patentanmeldung fest, so prüft das Europäische Patentamt nach Artikel 90 Absatz 3, ob a) eine nach Artikel 14 Absatz 2 oder Regel 40 Absatz 3 Satz 2 erforderliche Übersetzung der Anmeldung rechtzeitig eingereicht worden ist; b) der Antrag auf Erteilung eines europäischen Patents den Erfordernissen der Regel 41 entspricht; c) die Anmeldung einen oder mehrere Patentansprüche nach Artikel 78 Absatz 1 c) oder eine Bezugnahme auf eine früher eingereichte Anmeldung nach Regel 40 Absätze 1 c), 2 und 3 enthält, die zum Ausdruck bringt, dass sie auch die Patentansprüche ersetzt; d) die Anmeldung eine Zusammenfassung nach Artikel 78 Absatz 1 e) enthält; e) die Anmeldegebühr und die Recherchengebühr nach Regel 17 Absatz 2, Regel 36 Absatz 3 oder Regel 38 entrichtet worden sind; f) die Erfindernennung nach Regel 19 Absatz 1 erfolgt ist; g) gegebenenfalls den Erfordernissen der Regeln 52 und 53 für die Inanspruchnahme der Priorität entsprochen worden ist; h) gegebenenfalls den Erfordernissen des Artikels 133 Absatz 2 entsprochen worden ist; i) die Anmeldung den in Regel 46 und Regel 49 Absätze 1 bis 9 und 12 vorgeschriebenen Erfordernissen entspricht; j) die Anmeldung den in Regel 30 oder Regel 163 Absatz 3 vorgeschriebenen Erfordernissen entspricht. (6) Within one month of the notification referred to in paragraph 2 or 5, last sentence, the applicant may withdraw the missing parts of the description or the missing drawings filed, in which case the redating shall be deemed not to have been made. The European Patent Office shall inform the applicant accordingly. Rule 57 Examination as to formal requirements If the European patent application has been accorded a date of filing, the European Patent Office shall examine, in accordance with Article 90, paragraph 3, whether: (a) a translation of the application required under Article 14, paragraph 2, or under Rule 40, paragraph 3, second sentence, has been filed in due time; (b) the request for grant of a European patent satisfies the requirements of Rule 41; (c) the application contains one or more claims in accordance with Article 78, paragraph 1(c), or a reference to a previously filed application in accordance with Rule 40, paragraphs 1(c), 2 and 3, indicating that it replaces also the claims; (d) the application contains an abstract in accordance with Article 78, paragraph 1(e); (e) the filing fee and the search fee have been paid in accordance with Rule 17, paragraph 2, Rule 36, paragraph 3, or Rule 38; (f) the designation of the inventor has been made in accordance with Rule 19, paragraph 1; (g) where appropriate, the requirements laid down in Rules 52 and 53 concerning the claim to priority have been satisfied; (h) where appropriate, the requirements of Article 133, paragraph 2, have been satisfied; (i) the application meets the requirements laid down in Rule 46 and Rule 49, paragraphs 1 to 9 and 12. (j) the application meets the requirementslaiddowninRule30orRule163, paragraph 3. 2007 (6) Dans un délai d’un mois à compter de la notification visée au paragraphe 2 ou 5, dernière phrase, le demandeur peut retirer les parties manquantes de la description ou les dessins manquants déposés, auquel cas la nouvelle date est réputée ne pas avoir été attribuée. Règle 57 Examen quant aux exigences de forme Si une date de dépôt a été accordée à une demande de brevet européen, l’Office européen des brevets examine, conformément à l’article 90, paragraphe 3 : a) si la traduction de la demande requise en vertu de l’article 14, paragraphe 2, ou de la règle 40, paragraphe 3, deuxième phrase, a été produite dans les délais ; b) si la requête en délivrance d’un brevet européen satisfait aux exigences de la règle 41 ; c) si la demande contient une ou plusieurs revendications conformément àl’article 78, paragraphe 1 c), ou un renvoi à une demande déposée antérieurement conformément à la règle 40, paragraphes 1 c), 2 et 3, précisant qu’il remplace également les revendications ; d) si la demande contient un abrégé conformément à l’article 78, paragraphe 1 e) ; e) si la taxe de dépôt et la taxe de recherche ont été acquittées conformément à la règle 17, paragraphe 2, à la règle 36, paragraphe 3, ou à la règle 38 ; f) si la désignation de l’inventeur a été effectuée conformément à la règle 19, paragraphe 1 ; g) le cas échéant, s’il est satisfait aux exigences des règles 52 et 53 concernant la revendication de priorité ; h) le cas échéant, s’il est satisfait aux exigences de l’article 133, paragraphe 2 ; i) si la demande satisfait aux exigences de la règle 46 et de la règle 49, paragraphes1à9et12; j) si la demande satisfait aux exigences de la règle 30 ou de la règle 163, paragraphe 3.

EPA / Special edition No. 1 OJ EPO / Edition spéciale n° 1 JO OEB 143 Regel 58 Beseitigung von Mängeln in den Anmeldungsunterlagen Entspricht die europäische Patentanmeldung nicht den Erfordernissen der Regel 57 a) bis d), h) und i), so teilt das Europäische Patentamt dies dem Anmelder mit und fordert ihn auf, die festgestellten Mängel innerhalb von zwei Monaten zu beseitigen. Die Beschreibung, die Patentansprüche und die Zeichnungen können nur insoweit geändert werden, als es erforderlich ist, um diese Mängel zu beseitigen. Regel 59 Mängel bei der Inanspruchnahme der Priorität Ist das Aktenzeichen der früheren Anmeldung nach Regel 52 Absatz 1 oder die Abschrift dieser Anmeldung nach Regel 53 Absatz 1 nicht rechtzeitig eingereicht worden, so teilt das Europäische Patentamt dem Anmelder dies mit und fordert ihn auf, das Aktenzeichen oder die Abschrift innerhalb einer zu bestimmenden Frist einzureichen. Regel 60 Nachholung der Erfindernennung (1) Ist die Erfindernennung nach Regel 19 nicht erfolgt, so teilt das Europäische Patentamt dem Anmelder mit, dass die europäische Patentanmeldung zurückgewiesen wird, wenn die Erfindernennung nicht innerhalb von sechzehn Monaten nach dem Anmeldetag oder, wenn eine Priorität in Anspruch genommen worden ist, nach dem Prioritätstag nachgeholt wird; diese Frist gilt als eingehalten, wenn die Information vor Abschluss der technischen Vorbereitungen für die Veröffentlichung der europäischen Patentanmeldung mitgeteilt wird. (2) Ist in einer Teilanmeldung oder einer neuen Anmeldung nach Artikel 61 Absatz 1 b) die Erfindernennung nach Regel 19 nicht erfolgt, so fordert das Europäische Patentamt den Anmelder auf, die Erfindernennung innerhalb einer zu bestimmenden Frist nachzuholen. Rule 58 Correction of deficiencies in the application documents If the European patent application does not comply with the requirements of Rule 57(a) to (d), (h) and (i), the European Patent Office shall inform the applicant accordingly and invite him to correct the deficiencies noted within two months. The description, claims and drawings may be amended only to an extent sufficient to remedy such deficiencies. Rule 59 Deficiencies in claiming priority If the file number of the previous application under Rule 52, paragraph 1, or the copy of that application under Rule 53, paragraph 1, have not been filed in due time, the European Patent Office shall inform the applicant accordingly and invite him to file them within a period to be specified. Rule 60 Subsequent designation of the inventor (1) If the designation of the inventor has not been made in accordance with Rule 19, the European Patent Office shall inform the applicant that the European patent application will be refused unless the designation is made within sixteen months of the date of filing of the application or, if priority is claimed, of the date of priority, this period being deemed to have been observed if the information is communicated before completion of the technical preparations for the publication of the European patent application. (2) Where, in a divisional application or a new application under Article 61, paragraph 1(b), the designation of the inventor has not been made in accordance with Rule 19, the European Patent Office shall invite the applicant to make the designation within a period to be specified. Règle 58 Correction d’irrégularités dans les pièces de la demande Si la demande de brevet européen n’est pas conforme aux exigences de la règle 57 a), b), c), d), h) et i), l’Office européen des brevets le notifie au demandeur et l’invite à remédier, dans un délai de deux mois, aux irrégularités constatées. La description, les revendications et les dessins ne peuvent être modifiés que dans la mesure nécessaire pour remédier à ces irrégularités. Règle 59 Irrégularités dans la revendication de priorité Si le numéro de dépôt de la demande antérieure visé à la règle 52, paragraphe 1, ou la copie de cette demande visée à la règle 53, paragraphe 1, n’a pas été produit dans les délais, l’Office européen des brevets le notifie au demandeur et l’invite à les produire dans un délai qu’il lui impartit. Règle 60 Désignation ultérieure de l’inventeur (1) Si la désignation de l’inventeur n’a pas été effectuée conformément à la règle 19, l’Office européen des brevets notifie au demandeur que la demande de brevet européen sera rejetée si cette désignation n’est pas effectuée dans un délai de seize mois à compter de la date de dépôt ou, si une priorité a été revendiquée, de la date de priorité, étant entendu que ce délai est réputé avoir été respecté si l’information est communiquée avant la fin des préparatifs techniques en vue de la publication de la demande de brevet européen. (2) Si la désignation de l’inventeur n’a pas été effectuée conformément à la règle 19 dans une demande divisionnaire ou une nouvelle demande déposée conformément à l’article 61, paragraphe 1b),l’Office européen des brevets invite le demandeur à effectuer cette désignation dans un délai qu’il lui impartit.
