sind in der veröffentlichten europäischen<br />
<strong>Patent</strong>anmeldung und auf der europäischen<br />
<strong>Patent</strong>schrift zu vermerken.<br />
Regel 53<br />
Prioritätsunterlagen<br />
(1) Ein Anmelder, der eine Priorität in<br />
Anspruch nimmt, hat innerhalb von<br />
sechzehn Monaten nach dem frühesten<br />
Prioritätstag eine Abschrift der früheren<br />
Anmeldung einzureichen. Diese<br />
Abschrift und der Tag der Einreichung<br />
der früheren Anmeldung sind von der<br />
Behörde, bei der die Anmeldung eingereicht<br />
worden ist, zu beglaubigen.<br />
(2) Die Abschrift der früheren Anmeldung<br />
gilt als ordnungsgemäß eingereicht,<br />
wenn eine dem Europäischen<br />
<strong>Patent</strong>amt zugängliche Abschrift dieser<br />
Anmeldung unter den vom Präsidenten<br />
des Europäischen <strong>Patent</strong>amts festgelegten<br />
Bedingungen in die Akte der<br />
europäischen <strong>Patent</strong>anmeldung aufzunehmen<br />
ist.<br />
(3) Ist die frühere Anmeldung nicht in<br />
einer Amtssprache des Europäischen<br />
<strong>Patent</strong>amts abgefasst und ist die Wirksamkeit<br />
des Prioritätsanspruchs für die<br />
Beurteilung der <strong>Patent</strong>ierbarkeit der<br />
Erfindung relevant, so fordert das Europäische<br />
<strong>Patent</strong>amt den Anmelder oder<br />
Inhaber des europäischen <strong>Patent</strong>s auf,<br />
innerhalb einer zu bestimmenden Frist<br />
eine Übersetzung der Anmeldung in<br />
einer der Amtssprachen einzureichen.<br />
Statt der Übersetzung kann eine Erklärung<br />
vorgelegt werden, dass die europäische<br />
<strong>Patent</strong>anmeldung eine vollständige<br />
Übersetzung der früheren Anmeldung<br />
ist. Absatz 2 ist entsprechend<br />
anzuwenden.<br />
Regel 54<br />
Ausstellung von Prioritätsunterlagen<br />
Auf Antrag stellt das Europäische<br />
<strong>Patent</strong>amt für den Anmelder eine<br />
beglaubigte Kopie der europäischen<br />
<strong>Patent</strong>anmeldung (Prioritätsbeleg) aus.<br />
Der Präsident des Europäischen <strong>Patent</strong>amts<br />
bestimmt die erforderlichen Bedingungen<br />
einschließlich der Form des<br />
Prioritätsbelegs und der Fälle, in denen<br />
eine Verwaltungsgebühr zu entrichten<br />
ist.<br />
(5) The particulars of the declaration of<br />
priority shall appear in the published<br />
<strong>European</strong> patent application and the<br />
<strong>European</strong> patent specification.<br />
Rule 53<br />
Priority documents<br />
(1) An applicant claiming priority shall file<br />
a copy of the previous application within<br />
sixteen months of the earliest priority<br />
date claimed. This copy and the date of<br />
filing of the previous application shall be<br />
certified as correct by the authority with<br />
which that application was filed.<br />
(2) The copy of the previous application<br />
shall be deemed to be duly filed if a<br />
copy of that application available to the<br />
<strong>European</strong> <strong>Patent</strong> <strong>Office</strong> is to be included<br />
in the file of the <strong>European</strong> patent application<br />
under the conditions determined<br />
by the President of the <strong>European</strong> <strong>Patent</strong><br />
<strong>Office</strong>.<br />
(3) Where the previous application is not<br />
in an official language of the <strong>European</strong><br />
<strong>Patent</strong> <strong>Office</strong> and the validity of the<br />
priority claim is relevant to the determination<br />
of the patentability of the invention<br />
concerned, the <strong>European</strong> <strong>Patent</strong> <strong>Office</strong><br />
shall invite the applicant for or proprietor<br />
of the <strong>European</strong> patent to file a translation<br />
of that application into one of the official<br />
languages within a period to be<br />
specified. Alternatively, a declaration<br />
may be submitted that the <strong>European</strong><br />
patent application is a complete translation<br />
of the previous application. Paragraph<br />
2 shall apply mutatis mutandis.<br />
Rule 54<br />
Issuing priority documents<br />
On request, the <strong>European</strong> <strong>Patent</strong> <strong>Office</strong><br />
shall issue to the applicant a certified<br />
copy of the <strong>European</strong> patent application<br />
(priority document), under the conditions<br />
determined by the President of the<br />
<strong>European</strong> <strong>Patent</strong> <strong>Office</strong>, including the<br />
form of the priority document and the<br />
circumstances under which an administrative<br />
fee shall be paid.<br />
(5) Les indications contenues dans la<br />
déclaration de priorité sont mentionnées<br />
dans la demande de brevet européen<br />
publiée et dans le fascicule du brevet<br />
européen.<br />
Règle 53<br />
Documents de priorité<br />
(1) Le demandeur qui revendique une<br />
priorité doit produire une copie de la<br />
demande antérieure dans un délai de<br />
seize mois à compter de la date de priorité<br />
la plus ancienne. Cette copie et la<br />
date de dépôt de la demande antérieure<br />
doivent être certifiées par l’administration<br />
auprès de laquelle cette demande a été<br />
déposée.<br />
(2) La copie de la demande antérieure<br />
est réputée dûment produite si une<br />
copie de cette demande, qui est à la<br />
disposition de l’<strong>Office</strong> européen des<br />
brevets, doit être versée au dossier de la<br />
demande de brevet européen dans les<br />
conditions déterminées par le Président<br />
de l’<strong>Office</strong> européen des brevets.<br />
(3) Lorsque la demande antérieure n’est<br />
pas rédigée dans une langue officielle<br />
de l’<strong>Office</strong> européen des brevets et que<br />
la validité de la revendication de priorité<br />
est pertinente pour établir si l’invention<br />
en cause est brevetable, l’<strong>Office</strong> européen<br />
des brevets invite le demandeur<br />
ou le titulaire du brevet européen à<br />
produire, dans un délai qu’il lui impartit,<br />
une traduction de cette demande dans<br />
l’une des langues officielles. Au lieu de<br />
cette traduction, une déclaration peut<br />
être présentée selon laquelle la<br />
demande de brevet européen est une<br />
traduction intégrale de la demande antérieure.<br />
Le paragraphe 2 est applicable.<br />
Règle 54<br />
Délivrance de documents de priorité<br />
Sur requête, l’<strong>Office</strong> européen des<br />
brevets délivre au demandeur une copie<br />
certifiée conforme de la demande de<br />
brevet européen (le document de priorité),<br />
dans les conditions déterminées<br />
par le Président de l’<strong>Office</strong> européen des<br />
brevets, telles que notamment la forme<br />
du document de priorité et les cas dans<br />
lesquels il y a lieu d’acquitter une taxe<br />
d’administration.
