Reihenfolge abzufassen, sofern nicht<br />
wegen der Art der Erfindung eine andere<br />
Darstellung zu einem besseren<br />
Verständnis führen würde oder knapper<br />
wäre.<br />
Regel 43<br />
Form und Inhalt der <strong>Patent</strong>ansprüche<br />
(1) Der Gegenstand des Schutzbegehrens<br />
ist in den <strong>Patent</strong>ansprüchen durch<br />
Angabe der technischen Merkmale der<br />
Erfindung anzugeben. Wo es zweckdienlich<br />
ist, haben die <strong>Patent</strong>ansprüche<br />
zu enthalten:<br />
a) die Bezeichnung des Gegenstands<br />
der Erfindung und die technischen Merkmale,<br />
die zur Festlegung des beanspruchten<br />
Gegenstands der Erfindung<br />
notwendig sind, jedoch in Verbindung<br />
miteinander zum Stand der Technik<br />
gehören;<br />
b) einen kennzeichnenden Teil, der mit<br />
den Worten "dadurch gekennzeichnet"<br />
oder "gekennzeichnet durch" beginnt<br />
und die technischen Merkmale<br />
bezeichnet, für die in Verbindung mit den<br />
unter Buchstabe a angegebenen Merkmalen<br />
Schutz begehrt wird.<br />
(2) Unbeschadet des Artikels 82 darf<br />
eine europäische <strong>Patent</strong>anmeldung nur<br />
dann mehr als einen unabhängigen<br />
<strong>Patent</strong>anspruch in der gleichen Kategorie<br />
(Erzeugnis, Verfahren, Vorrichtung<br />
oder Verwendung) enthalten, wenn sich<br />
der Gegenstand der Anmeldung auf<br />
einen der folgenden Sachverhalte<br />
bezieht:<br />
a) mehrere miteinander in Beziehung<br />
stehende Erzeugnisse,<br />
b) verschiedene Verwendungen eines<br />
Erzeugnisses oder einer Vorrichtung,<br />
c) Alternativlösungen für eine bestimmte<br />
Aufgabe, sofern es unzweckmäßig ist,<br />
diese Alternativen in einem einzigen<br />
Anspruch wiederzugeben.<br />
(3) Zu jedem <strong>Patent</strong>anspruch, der die<br />
wesentlichen Merkmale der Erfindung<br />
wiedergibt, können ein oder mehrere<br />
<strong>Patent</strong>ansprüche aufgestellt werden, die<br />
sich auf besondere Ausführungsarten<br />
dieser Erfindung beziehen.<br />
(2) The description shall be presented in<br />
the manner and order specified in paragraph<br />
1, unless, owing to the nature of<br />
the invention, a different presentation<br />
would afford a better understanding or<br />
be more concise.<br />
Rule 43<br />
Form and content of claims<br />
(1) The claims shall define the matter for<br />
which protection is sought in terms of<br />
the technical features of the invention.<br />
Wherever appropriate, claims shall<br />
contain:<br />
(a) a statement indicating the designation<br />
of the subjectmatter of the invention<br />
and those technical features which are<br />
necessary for the definition of the<br />
claimed subjectmatter but which, in<br />
combination, form part of the prior art;<br />
(b) a characterising portion, beginning<br />
with the expression "characterised in<br />
that" or "characterised by" and specifying<br />
the technical features for which, in<br />
combination with the features stated<br />
under subparagraph (a), protection is<br />
sought.<br />
(2) Without prejudice to Article 82, a<br />
<strong>European</strong> patent application may contain<br />
more than one independent claim in the<br />
same category (product, process, apparatus<br />
or use) only if the subjectmatter of<br />
the application involves one of the<br />
following:<br />
(a) a plurality of interrelated products,<br />
(b) different uses of a product or apparatus,<br />
(c) alternative solutions to a particular<br />
problem, where it is inappropriate to<br />
cover these alternatives by a single<br />
claim.<br />
(3) Any claim stating the essential<br />
features of an invention may be followed<br />
by one or more claims concerning particular<br />
embodiments of that invention.<br />

(2) La description doit être présentée de<br />

différente ne soit plus concise ou ne<br />
permette une meilleure compréhension.<br />
Règle 43<br />
Forme et contenu des revendications<br />
(1) Les revendications doivent définir, en<br />
indiquant les caractéristiques techniques<br />
de l’invention, l’objet de la demande pour<br />
lequel la protection est recherchée. S’il<br />
y a lieu, les revendications doivent<br />
contenir :<br />
a) un préambule mentionnant la désignation<br />
de l’objet de l’invention et les<br />
caractéristiques techniques qui sont<br />
nécessaires à la définition de l’objet<br />
revendiqué mais qui, combinées entre<br />
elles, font partie de l’état de la technique<br />
;<br />
b) une partie caractérisante introduite<br />
par l’expression "caractérisé en" ou<br />
"caractérisé par" et exposant les caractéristiques<br />
techniques pour lesquelles,<br />
en liaison avec les caractéristiques indiquées<br />
à la lettre a), la protection est<br />
recherchée.<br />
(2) Sans préjudice de l’article 82, une<br />
demande de brevet européen ne peut<br />
contenir plus d’une revendication indépendante<br />
de la même catégorie (produit,<br />
procédé, dispositif ou utilisation) que si<br />
l’objet de la demande se rapporte :<br />
a) à plusieurs produits ayant un lien<br />
entre eux,<br />
b) à différentes utilisations d’un produit<br />
ou d’un dispositif, ou<br />
c) à des solutions alternatives à un<br />
problème particulier dans la mesure où<br />
ces solutions ne peuvent pas être<br />
couvertes de façon appropriée par une<br />
seule revendication.<br />
(3) Toute revendication énonçant les<br />
caractéristiques essentielles de l’invention<br />
peut être suivie d’une ou de<br />
plusieurs revendications concernant des<br />
modes particuliers de réalisation de cette<br />
invention.
