EPA / Special edition No. 1 OJ EPO / Edition spéciale n° 1 JO OEB (4) Der in Absatz 1 vorgesehene Antrag ist beim Europäischen Patentamt auf einem von diesem anerkannten Formblatt einzureichen. Das Europäische Patentamt bestätigt auf dem Formblatt, dass eine europäische Patentanmeldung eingereicht worden ist, die auf die Hinterlegung des biologischen Materials Bezug nimmt, und dass der Antragsteller oder der von ihm nach Regel 32 benannte Sachverständige Anspruch auf Herausgabe einer Probe dieses Materials hat. Der Antrag ist auch nach Erteilung des europäischen Patents beim Europäischen Patentamt einzureichen. (5) Das Europäische Patentamt übermittelt der Hinterlegungsstelle und dem Anmelder oder Patentinhaber eine Kopie des Antrags mit der in Absatz 4 vorgesehenen Bestätigung. (6) Das Europäische Patentamt veröffentlicht in seinem Amtsblatt das Verzeichnis der Hinterlegungsstellen und Sachverständigen, die für die Anwendung der Regeln 31 bis 34 anerkannt sind. Regel 34 Erneute Hinterlegung von biologischem Material Ist nach Regel 31 hinterlegtes biologisches Material bei der anerkannten Hinterlegungsstelle nicht mehr zugänglich, so gilt die Unterbrechung der Zugänglichkeit als nicht eingetreten, wenn dieses Material bei einer anerkannten Hinterlegungsstelle unter denselben Bedingungen wie denen des Budapester Vertrags über die internationale Anerkennung der Hinterlegung von Mikroorganismen für die Zwecke von Patentverfahren vom 28. April 1977 erneut hinterlegt wird und dem Europäischen Patentamt innerhalb von vier Monaten nach dem Tag der erneuten Hinterlegung eine Kopie der von der Hinterlegungsstelle ausgestellten Empfangsbescheinigung unter Angabe der Nummer der europäischen Patentanmeldung oder des europäischen Patents übermittelt wird. (4) The request referred to in paragraph 1 shall be submitted to the European Patent Office on a form recognised by that Office. The European Patent Office shall certify on the form that a European patent application referring to the deposit of the biological material has been filed, and that the requester or the expert nominated by him under Rule 32 is entitled to the issue of a sample of that material. After grant of the European patent, the request shall also be submitted to the European Patent Office. (5) The European Patent Office shall transmit a copy of the request, with the certification provided for in paragraph 4, to the depositary institution and to the applicant for or the proprietor of the patent. (6) The European Patent Office shall publish in its Official Journal the list of depositary institutions and experts recognised for the purpose of Rules 31 to 34. Rule 34 New deposit of biological material If biological material deposited in accordance with Rule 31 ceases to be available from the recognised depositary institution, an interruption in availability shall be deemed not to have occurred if a new deposit of that material is made with a recognised depositary institution on the same terms as those laid down in the Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure of 28 April 1977, and if a copy of the receipt of the new deposit issued by the depositary institution is forwarded to the European Patent Office within four months of the date of the new deposit, stating the number of the European patent application or of the European patent. 2007 (4) La requête visée au paragraphe 1 est adressée à l’Office européen des brevets au moyen d’un formulaire agréé par lui. L’Office européen des brevets certifie sur ce formulaire qu’une demande de brevet européen faisant état du dépôt de la matière biologique a été déposée et que le requérant ou l’expert qu’il a désigné conformément à la règle 32 a droit à la remise d’un échantillon de cette matière. La requête est également adressée à l’Office européen des brevets après la délivrance du brevet européen. (5) L’Office européen des brevets transmet à l’autorité de dépôt, ainsi qu’au demandeur ou au titulaire du brevet, une copie de la requête assortie de la certification prévue au paragraphe 4. (6) L’Office européen des brevets publie au Journal officiel la liste des autorités de dépôt habilitées et des experts agréés aux fins de l’application des règles 31 à 34. Règle 34 Nouveau dépôt de matière biologique Si de la matière biologique déposée conformément à la règle 31 cesse d’être disponible auprès de l’autorité de dépôt habilitée, l’interruption de l’accessibilité est réputée non avenue à condition qu’un nouveau dépôt de cette matière ait été effectué auprès d’une autorité de dépôt habilitée, dans les mêmes conditions que celles prévues par le Traité de Budapest sur la reconnaissance internationale du dépôt des micro-organismes aux fins de la procédure en matière de brevets du 28 avril 1977, et qu’une copie du récépissé de ce nouveau dépôt délivré par l’autorité de dépôt, accompagnée de l’indication du numéro de la demande de brevet européen ou du brevet européen, ait été communiquée à l’Office européen des brevets dans un délai de quatre mois à compter de la date du nouveau dépôt.

EPA / Special edition No. 1 OJ EPO / Edition spéciale n° 1 JO OEB 123 DRITTER TEIL AUSFÜHRUNGSVORSCHRIFTEN ZUM DRITTEN TEIL DES ÜBEREINKOMMENS Kapitel I Einreichung der europäischen Patentanmeldung Regel 35 Allgemeine Vorschriften (1) Europäische Patentanmeldungen können schriftlich beim Europäischen Patentamt in München, Den Haag oder Berlin oder bei den in Artikel 75 Absatz 1 b) genannten Behörden eingereicht werden. (2) Die Behörde, bei der die europäische Patentanmeldung eingereicht wird, vermerkt auf den Unterlagen der Anmeldung den Tag des Eingangs dieser Unterlagen und erteilt dem Anmelder unverzüglich eine Empfangsbescheinigung, die zumindest die Nummer der Anmeldung, die Art und Zahl der Unterlagen und den Tag ihres Eingangs enthält. (3) Wird die europäische Patentanmeldung bei einer in Artikel 75 Absatz 1 b) genannten Behörde eingereicht, so unterrichtet diese Behörde das Europäische Patentamt unverzüglich vom Eingang der Anmeldung und teilt ihm insbesondere die Art der Unterlagen und den Tag ihres Eingangs, die Nummer der Anmeldung und gegebenenfalls jeden beanspruchten Prioritätstag mit. (4) Hat das Europäische Patentamt eine europäische Patentanmeldung durch Vermittlung der Zentralbehörde für den gewerblichen Rechtsschutz eines Vertragsstaats erhalten, so teilt es dies dem Anmelder unter Angabe des Tages mit, an dem sie bei ihm eingegangen ist. Regel 36 Europäische Teilanmeldungen (1) Der Anmelder kann eine Teilanmeldung zu jeder anhängigen früheren europäischen Patentanmeldung einreichen. (2) Eine Teilanmeldung ist in der Verfahrenssprache der früheren Anmeldung abzufassen und beim Europäischen Patentamt in München, Den Haag oder Berlin einzureichen. PART III IMPLEMENTING REGULATIONS TO PART III OF THE CONVENTION Chapter I Filing of the European patent application Rule 35 General provisions (1) European patent applications may be filed in writing with the European Patent Office in Munich, The Hague or Berlin, or the authorities referred to in Article 75, paragraph 1(b). (2) The authority with which the European patent application is filed shall mark the documents making up the application with the date of their receipt, and issue without delay a receipt to the applicant including at least the application number and the nature, number and date of receipt of the documents. (3) If the European patent application is filed with an authority referred to in Article 75, paragraph 1(b), such authority shall without delay inform the European Patent Office of the receipt of the application, and, in particular, of the nature and date of receipt of the documents, the application number and any priority date claimed. (4) Upon receipt of a European patent application forwarded by the central industrial property office of a Contracting State, the European Patent Office shall inform the applicant accordingly, indicating the date of its receipt. Rule 36 European divisional applications (1) The applicant may file a divisional application relating to any pending earlier European patent application. (2) A divisional application shall be in the language of the proceedings for the earlier application and shall be filed with the European Patent Office in Munich, The Hague or Berlin. TROISIEME PARTIE DISPOSITIONS D’APPLICATION DE LA TROISIEME PARTIE DE LA CONVENTION Chapitre I Dépôt de la demande de brevet européen Règle 35 Dispositions générales (1) Les demandes de brevet européen peuvent être déposées par écrit auprès de l’Office européen des brevets à Munich, La Haye ou Berlin, ou auprès des administrations visées à l’article 75, paragraphe 1 b). (2) L’administration auprès de laquelle la demande de brevet européen est déposée appose sur les pièces de cette demande la date de leur réception et délivre sans délai au demandeur un récépissé indiquant au moins le numéro de la demande, la nature et le nombre des pièces ainsi que la date de leur réception. (3) Si la demande de brevet européen est déposée auprès d’une administration visée à l’article 75, paragraphe 1 b), celleci informe sans délai l’Office européen des brevets de la réception de la demande, et indique en particulier la nature des pièces déposées, le jour de leur réception, le numéro donné à la demande et, le cas échéant, la date de toute priorité revendiquée. (4) Lorsque l’Office européen des brevets reçoit une demande de brevet européen par l’intermédiaire du service central de la propriété industrielle d’un Etat contractant, il en informe le demandeur en lui indiquant la date à laquelle il a reçu la demande. Règle 36 Demandes divisionnaires européennes (1) Le demandeur peut déposer une demande divisionnaire relative à toute demande de brevet européen antérieure encore en instance. (2) Une demande divisionnaire doit être rédigée dans la langue de la procédure de la demande antérieure et être déposée auprès de l’Office européen des brevets à Munich, La Haye ou Berlin.
