EPA / Special edition No. 1 OJ EPO / Edition spéciale n° 1 JO OEB (3) Ist der Anmelder nicht oder nicht allein der Erfinder, so teilt das Europäische Patentamt dem genannten Erfinder die in der Erfindernennung enthaltenen und die folgenden weiteren Angaben mit: a) Nummer der europäischen Patentanmeldung; b) Anmeldetag der europäischen Patentanmeldung und, wenn eine Priorität in Anspruch genommen worden ist, Tag, Staat und Aktenzeichen der früheren Anmeldung; c) Name des Anmelders; d) Bezeichnung der Erfindung; e) die benannten Vertragsstaaten. (4) Der Anmelder und der Erfinder können aus der Unterlassung der Mitteilung nach Absatz 3 und aus darin enthaltenen Fehlern keine Ansprüche herleiten. Regel 20 Bekanntmachung der Erfindernennung (1) Der genannte Erfinder wird auf der veröffentlichten europäischen Patentanmeldung und auf der europäischen Patentschrift vermerkt, sofern er dem Europäischen Patentamt gegenüber nicht schriftlich auf das Recht verzichtet hat, als Erfinder bekannt gemacht zu werden. (2) Absatz 1 ist anzuwenden, wenn ein Dritter beim Europäischen Patentamt eine rechtskräftige Entscheidung einreicht, aus der hervorgeht, dass der Anmelder oder Inhaber eines europäischen Patents verpflichtet ist, ihn als Erfinder zu nennen. Regel 21 Berichtigung der Erfindernennung (1) Eine unrichtige Erfindernennung wird nur auf Antrag und nur mit Zustimmung des zu Unrecht als Erfinder Genannten und, wenn der Antrag von einem Dritten eingereicht wird, mit Zustimmung des Anmelders oder Patentinhabers berichtigt. Regel 19 ist entsprechend anzuwenden. (2) Ist eine unrichtige Erfindernennung in das Europäische Patentregister eingetragen oder im Europäischen Patentblatt bekannt gemacht worden, so wird auch deren Berichtigung oder Löschung darin eingetragen oder bekannt gemacht. (3) If the applicant is not the inventor or is not the sole inventor, the European Patent Office shall communicate to the designated inventor the information in the document designating him and the following data: (a) the number of the European patent application; (b) the date of filing of the European patent application and, if priority has been claimed, the date, State and file number of the previous application; (c) the name of the applicant; (d) the title of the invention; (e) the Contracting States designated. (4) The applicant and the inventor may invoke neither the omission of the communication under paragraph 3 nor any errors contained therein. Rule 20 Publication of the mention of the inventor (1) The designated inventor shall be mentioned in the published European patent application and the European patent specification, unless he informs the European Patent Office in writing that he has waived his right to be thus mentioned. (2) Paragraph 1 shall apply where a third party files with the European Patent Office a final decision determining that the applicant for or proprietor of a European patent is required to designate him as an inventor. Rule 21 Rectification of the designation of an inventor (1) An incorrect designation of an inventor shall be rectified upon request and only with the consent of the wrongly designated person and, where such a request is filed by a third party, the consent of the applicant for or proprietor of the patent. Rule 19 shall apply mutatis mutandis. (2) Where an incorrect designation of the inventor has been recorded in the European Patent Register or published in the European Patent Bulletin, its rectification or cancellation shall also be recorded or published therein. 2007 (3) Si le demandeur n’est pas l’inventeur ou l’unique inventeur, l’Office européen des brevets notifie à l’inventeur désigné les indications contenues dans la désignation et les indications suivantes : a) le numéro de la demande de brevet européen ; b) la date du dépôt de la demande de brevet européen et, si une priorité a été revendiquée, la date, l’Etat et le numéro de dépôt de la demande antérieure ; c) le nom du demandeur ; d) le titre de l’invention ; e) les Etats contractants désignés. (4) Le demandeur ou l’inventeur ne peuvent se prévaloir ni de l’omission de la notification visée au paragraphe 3 ni des erreurs dont elle pourrait être entachée. Règle 20 Publication de la désignation de l’inventeur (1) La personne désignée comme inventeur est mentionnée dans la demande de brevet européen publiée et dans le fascicule du brevet européen, à moins qu’elle ne déclare par écrit à l’Office européen des brevets qu’elle a renoncé au droit d’être mentionnée en tant qu’inventeur. (2) Le paragraphe 1 est applicable lorsqu’un tiers produit auprès de l’Office européen des brevets une décision passée en force de chose jugée en vertu de laquelle le demandeur ou le titulaire d’un brevet européen est tenu de le désigner comme inventeur. Règle 21 Rectification de la désignation d’un inventeur (1) Une désignation erronée de l’inventeur n’est rectifiée sur requête qu’avec le consentement de la personne désignée à tort et, si la requête est présentée par un tiers, le consentement du demandeur ou du titulaire du brevet. La règle 19 est applicable. (2) Si une désignation erronée de l’inventeur a été inscrite au Registre européen des brevets ou publiée au Bulletin européen des brevets, sa rectification ou sa radiation y est également inscrite ou publiée.

EPA / Special edition No. 1 OJ EPO / Edition spéciale n° 1 JO OEB 115 Kapitel III Eintragung von Rechtsübergängen, Lizenzen und anderen Rechten Regel 22 Eintragung von Rechtsübergängen (1) Der Rechtsübergang einer europäischen Patentanmeldung wird auf Antrag eines Beteiligten in das Europäische Patentregister eingetragen, wenn er durch Vorlage von Dokumenten nachgewiesen wird. (2) Der Antrag gilt erst als gestellt, wenn eine Verwaltungsgebühr entrichtet worden ist. Er kann nur zurückgewiesen werden, wenn die Erfordernisse des Absatzes 1 nicht erfüllt sind. (3) Ein Rechtsübergang wird dem Europäischen Patentamt gegenüber erst und nur insoweit wirksam, als er ihm durch Vorlage von Dokumenten nach Absatz 1 nachgewiesen wird. Regel 23 Eintragung von Lizenzen und anderen Rechten (1) Regel 22 Absätze 1 und 2 ist auf die Eintragung der Erteilung oder des Übergangs einer Lizenz, der Bestellung oder des Übergangs eines dinglichen Rechts an einer europäischen Patentanmeldung und von Zwangsvollstreckungsmaßnahmen in Bezug auf eine solche Anmeldung entsprechend anzuwenden. (2) Eintragungen nach Absatz 1 werden auf Antrag gelöscht; dem Antrag sind Nachweise, dass das Recht nicht mehr besteht, oder eine schriftliche Einwilligung des Rechtsinhabers in die Löschung der Eintragung beizufügen. Regel 22 Absatz 2 ist entsprechend anzuwenden. Regel 24 Besondere Angaben bei der Eintragung von Lizenzen Eine Lizenz an einer europäischen Patentanmeldung wird eingetragen a) als ausschließliche Lizenz, wenn der Anmelder und der Lizenznehmer dies beantragen; b) als Unterlizenz, wenn sie von einem Lizenznehmer erteilt wird, dessen Lizenz im Europäischen Patentregister eingetragen ist. Chapter III Registration of transfers, licences and other rights Rule 22 Registration of transfers (1) The transfer of a European patent application shall be recorded in the European Patent Register at the request of an interested party, upon production of documents providing evidence of such transfer. (2) The request shall not be deemed to have been filed until an administrative fee has been paid. It may be rejected only if paragraph 1 has not been complied with. (3) A transfer shall have effect vis-à-vis the European Patent Office only at the date when and to the extent that the documents referred to in paragraph 1 have been produced. Rule 23 Registration of licences and other rights (1) Rule 22, paragraphs 1 and 2, shall apply mutatis mutandis to the registration of the grant or transfer of a licence, the establishment or transfer of a right in rem in respect of a European patent application and any legal means of execution affecting such an application. (2) A registration under paragraph 1 shall be cancelled upon request, supported by documents providing evidence that the right has lapsed, or by the written consent of the proprietor of the right to the cancellation of the registration. Rule 22, paragraph 2, shall apply mutatis mutandis. Rule 24 Special entries for licence registrations A licence in respect of a European patent application shall be recorded (a) as an exclusive licence if the applicant and the licensee so request; (b) as a sublicence where it is granted by a licensee whose licence is recorded in the European Patent Register. Chapitre III Inscription au Registre des transferts, licences et autres droits Règle 22 Inscription des transferts (1) Le transfert d’une demande de brevet européen est inscrit au Registre européen des brevets à la requête de toute partie intéressée, sur production de documents prouvant ce transfert. (2) La requête n’est réputée présentée qu’après le paiement d’une taxe d’administration. Elle ne peut être rejetée que s’il n’a pas été satisfait aux dispositions du paragraphe 1. (3) Un transfert n’a d’effet à l’égard de l’Office européen des brevets que dans la mesure où les documents visés au paragraphe 1 lui ont été fournis et à partir de la date à laquelle ils ont été produits. Règle 23 Inscription de licences et d’autres droits (1) La règle 22, paragraphes 1 et 2, est applicable à l’inscription de la concession ou du transfert d’une licence ainsi qu’à l’inscription de la constitution ou du transfert d’un droit réel sur une demande de brevet européen et de l’exécution forcée sur une telle demande. (2) Les inscriptions visées au paragraphe 1 sont radiées sur requête accompagnée soit des documents prouvant que le droit s’est éteint, soit de la déclaration écrite du titulaire du droit par laquelle il consent à la radiation de l’inscription. La règle 22, paragraphe 2, est applicable. Règle 24 Mentions spéciales pour l’inscription d’une licence Une licence sur une demande de brevet européen est inscrite : a) en tant que licence exclusive si le demandeur et le licencié le requièrent ; b) en tant que souslicence, lorsqu’elle est concédée par le titulaire d’une licence inscrite au Registre européen des brevets.
