(2) Für die neue Anmeldung sind innerhalb<br />
eines Monats nach ihrer Einreichung<br />
die Anmeldegebühr und die<br />
Recherchengebühr zu entrichten. Wird<br />
die Anmeldegebühr oder die Recherchengebühr<br />
nicht rechtzeitig entrichtet,<br />
so gilt die Anmeldung als zurückgenommen.<br />
(3) Die Benennungsgebühren sind innerhalb<br />
von sechs Monaten nach dem Tag<br />
zu entrichten, an dem im Europäischen<br />
<strong>Patent</strong>blatt auf die Veröffentlichung des<br />
europäischen Recherchenberichts zu<br />
der neuen Anmeldung hingewiesen<br />
worden ist. Regel 39 Absätze 2 und 3 ist<br />
anzuwenden.<br />
Regel 18<br />
Teilweiser Übergang des Rechts auf das<br />
europäische <strong>Patent</strong><br />
(1) Ergibt sich aus einer rechtskräftigen<br />
Entscheidung, dass einem Dritten der<br />
Anspruch auf Erteilung eines europäischen<br />
<strong>Patent</strong>s nur für einen Teil des in<br />
der ursprünglichen europäischen <strong>Patent</strong>anmeldung<br />
offenbarten Gegenstands<br />
zugesprochen worden ist, so sind für<br />
diesen Teil Artikel 61 und die Regeln 16<br />
und 17 anzuwenden.<br />
(2) Soweit erforderlich hat die ursprüngliche<br />
europäische <strong>Patent</strong>anmeldung für<br />
die benannten Vertragsstaaten, in denen<br />
die Entscheidung ergangen oder anerkannt<br />
worden ist oder aufgrund des<br />
Anerkennungsprotokolls anzuerkennen<br />
ist und für die übrigen benannten<br />
Vertragsstaaten unterschiedliche <strong>Patent</strong>ansprüche,<br />
Beschreibungen und Zeichnungen<br />
zu enthalten.<br />
Kapitel II<br />
Erfindernennung<br />
Regel 19<br />
Einreichung der Erfindernennung<br />
(1) Die Erfindernennung hat im Antrag<br />
auf Erteilung eines europäischen<br />
<strong>Patent</strong>s zu erfolgen. Ist jedoch der<br />
Anmelder nicht oder nicht allein der<br />
Erfinder, so ist die Erfindernennung in<br />
einem gesonderten Schriftstück einzureichen.<br />
Sie muss den Namen, die Vornamen<br />
und die vollständige Anschrift<br />
des Erfinders, die in Artikel 81 genannte<br />
Erklärung und die Unterschrift des<br />
Anmelders oder Vertreters enthalten.<br />
(2) Die Richtigkeit der Erfindernennung<br />
wird vom Europäischen <strong>Patent</strong>amt nicht<br />
geprüft.<br />
(2) The filing fee and search fee shall be<br />
paid within one month of filing the new<br />
application. If the filing fee or search fee<br />
is not paid in due time, the application<br />
shall be deemed to be withdrawn.<br />
(3) The designation fees shall be paid<br />
within six months of the date on which<br />
the <strong>European</strong> <strong>Patent</strong> Bulletin mentions<br />
the publication of the <strong>European</strong> search<br />
report drawn up in respect of the new<br />
application. Rule 39, paragraphs 2 and<br />
3, shall apply.<br />
Rule 18<br />
Partial transfer of the right to the<br />
<strong>European</strong> patent<br />
(1) If a final decision determines that a<br />
third party is entitled to the grant of a<br />
<strong>European</strong> patent in respect of only part<br />
of the subject-matter disclosed in the<br />
original <strong>European</strong> patent application,<br />
Article 61 and Rules 16 and 17 shall<br />
apply to such part.<br />
(2) Where appropriate, the original<br />
<strong>European</strong> patent application shall<br />
contain, for the designated Contracting<br />
States in which the decision was taken<br />
or recognised or must be recognised on<br />
the basis of the Protocol on Recognition,<br />
claims, a description and drawings which<br />
are different from those for the other<br />
designated Contracting States.<br />
Chapter II<br />
Mention of the inventor<br />
Rule 19<br />
Designation of the inventor<br />
(1) The request for grant of a <strong>European</strong><br />
patent shall contain the designation of<br />
the inventor. However, if the applicant is<br />
not the inventor or is not the sole<br />
inventor, the designation shall be filed in<br />
a separate document. The designation<br />
shall state the family name, given names<br />
and full address of the inventor, contain<br />
the statement referred to in Article 81<br />
and bear the signature of the applicant<br />
or his representative.<br />
(2) The <strong>European</strong> <strong>Patent</strong> <strong>Office</strong> shall not<br />
verify the accuracy of the designation of<br />
the inventor.<br />
(2) La taxe de dépôt et la taxe de<br />
recherche doivent être acquittées dans<br />
un délai d’un mois à compter du dépôt<br />
de la nouvelle demande. Si la taxe de<br />
dépôt ou la taxe de recherche n’est pas<br />
acquittée dans les délais, la demande<br />
est réputée retirée.<br />
(3) Les taxes de désignation doivent être<br />
acquittées dans un délai de six mois à<br />
compter de la date à laquelle le Bulletin<br />
européen des brevets a mentionné la<br />
publication du rapport de recherche<br />
européenne établi pour la nouvelle<br />
demande. La règle 39, paragraphes 2<br />
et 3, est applicable.<br />
Règle 18<br />
Transfert partiel du droit au brevet<br />
européen<br />
(1) Si une décision passée en force de<br />
chose jugée a reconnu le droit à l’obtention<br />
du brevet européen à un tiers pour<br />
une partie seulement de l’objet de la<br />
demande initiale de brevet européen,<br />
l’article 61 ainsi que les règles 16 et 17<br />
s’appliquent à la partie en cause.<br />
(2) S’il y a lieu, la demande de brevet<br />
européen initiale comporte, pour les<br />
Etats contractants désignés dans<br />
lesquels la décision a été rendue ou<br />
reconnue, ou doit être reconnue en vertu<br />
du protocole sur la reconnaissance, des<br />
revendications, une description et des<br />
dessins différents de ceux que la<br />
demande comporte pour les autres Etats<br />
contractants désignés.<br />
Chapitre II<br />
Mention de l’inventeur<br />
Règle 19<br />
Désignation de l’inventeur<br />
(1) La désignation de l’inventeur doit être<br />
effectuée dans la requête en délivrance<br />
du brevet européen. Toutefois, si le<br />
demandeur n’est pas l’inventeur ou<br />
l’unique inventeur, cette désignation<br />
doit être effectuée dans un document<br />
produit séparément. Elle doit comporter<br />
le nom, les prénoms et l’adresse<br />
complète de l’inventeur, la déclaration<br />
visée à l’article 81 et la signature du<br />
demandeur ou celle de son mandataire.<br />
(2) L’<strong>Office</strong> européen des brevets ne<br />
contrôle pas l’exactitude de la désignation<br />
de l’inventeur.
