laufenden Fristen mit Ausnahme der<br />
Fristen zur Zahlung der Jahresgebühren<br />
werden durch die Aussetzung gehemmt.<br />
An dem Tag der Fortsetzung des Verfahrens<br />
beginnt der noch nicht verstrichene<br />
Teil einer Frist zu laufen. Die nach der<br />
Fortsetzung verbleibende Frist beträgt<br />
jedoch mindestens zwei Monate.<br />
Regel 15<br />
Beschränkung von Zurücknahmen<br />
Von dem Tag an, an dem ein Dritter<br />
nachweist, dass er ein nationales<br />
Verfahren nach Regel 14 Absatz 1<br />
eingeleitet hat, bis zu dem Tag, an dem<br />
das Erteilungsverfahren fortgesetzt wird,<br />
darf weder die europäische <strong>Patent</strong>anmeldung<br />
noch die Benennung eines<br />
Vertragsstaats zurückgenommen<br />
werden.<br />
Regel 16<br />
Verfahren nach Artikel 61 Absatz 1<br />
(1) Eine Person, die Anspruch auf Erteilung<br />
eines europäischen <strong>Patent</strong>s hat,<br />
kann von den Rechtsbehelfen nach<br />
Artikel 61 Absatz 1 nur Gebrauch<br />
machen, wenn<br />
a) sie dies innerhalb von drei Monaten<br />
nach Eintritt der Rechtskraft der<br />
Entscheidung tut, mit der ihr Anspruch<br />
anerkannt wird, und<br />
b) das europäische <strong>Patent</strong> noch nicht<br />
erteilt worden ist.<br />
(2) Diese Rechtsbehelfe gelten nur in<br />
Bezug auf in der europäischen <strong>Patent</strong>anmeldung<br />
benannte Vertragsstaaten, in<br />
denen die Entscheidung ergangen oder<br />
anerkannt worden ist oder aufgrund des<br />
Anerkennungsprotokolls anzuerkennen<br />
ist.<br />
Regel 17<br />
Einreichung einer neuen europäischen<br />
<strong>Patent</strong>anmeldung durch den Berechtigten<br />
(1) Reicht die Person, der durch rechtskräftige<br />
Entscheidung der Anspruch auf<br />
Erteilung des europäischen <strong>Patent</strong>s<br />
zugesprochen worden ist, nach Artikel<br />
61 Absatz 1 b) eine neue europäische<br />
<strong>Patent</strong>anmeldung ein, so gilt die<br />
ursprüngliche Anmeldung für die darin<br />
benannten Vertragsstaaten, in denen die<br />
Entscheidung ergangen oder anerkannt<br />
worden ist oder aufgrund des Anerkennungsprotokolls<br />
anzuerkennen ist, mit<br />
dem Tag der Einreichung der neuen<br />
Anmeldung als zurückgenommen.<br />
(4) All periods other than those for the<br />
payment of renewal fees, running at the<br />
date of the stay of proceedings, shall be<br />
interrupted by such stay. The time which<br />
has not yet elapsed shall begin to run<br />
from the date on which proceedings are<br />
resumed. However, the time still to run<br />
after such resumption shall not be less<br />
than two months.<br />
Rule 15<br />
Limitation on withdrawals<br />
From the date on which a third party<br />
provides evidence that he has instituted<br />
national proceedings under Rule 14,<br />
paragraph 1, and up to the date on<br />
which the proceedings for grant are<br />
resumed, neither the <strong>European</strong> patent<br />
application nor the designation of any<br />
Contracting State may be withdrawn.<br />
Rule 16<br />
Procedure under Article 61, paragraph 1<br />
(1) A person entitled to the grant of a<br />
<strong>European</strong> patent may only avail himself<br />
of the remedies under Article 61, paragraph<br />
1, if:<br />
(a) he does so no later than three<br />
months after the decision recognising<br />
his entitlement has become final, and<br />
(b) the <strong>European</strong> patent has not yet<br />
been granted.<br />
(2) Such remedies shall only apply in<br />
respect of Contracting States designated<br />
in the <strong>European</strong> patent application in<br />
which the decision has been taken or<br />
recognised or must be recognised on<br />
the basis of the Protocol on Recognition.<br />
Rule 17<br />
Filing of a new <strong>European</strong> patent<br />
application by the entitled person<br />
(1) Where the person adjudged by a final<br />
decision to be entitled to the grant of the<br />
<strong>European</strong> patent files a new <strong>European</strong><br />
patent application under Article 61, paragraph<br />
1(b), the original application shall<br />
be deemed to be withdrawn on the date<br />
of filing the new application for the<br />
Contracting States designated therein in<br />
which the decision has been taken or<br />
recognised or must be recognised on<br />
the basis of the Protocol on Recognition.<br />

(4) La suspension de la procédure<br />
entraîne celle de tous les délais qui<br />
courent à la date de la suspension, à<br />
l’exception des délais de paiement des<br />
taxes annuelles. La partie du délai non<br />
encore expirée commence à courir à la<br />
date de la reprise de la procédure.<br />
Toutefois, le délai restant à courir après<br />
la reprise de la procédure ne peut être<br />
inférieur à deux mois.<br />
Règle 15<br />
Limitation des retraits<br />
A compter du jour où un tiers apporte la<br />
preuve qu’il a introduit une procédure<br />
nationale conformément à la règle 14,<br />
paragraphe 1, et jusqu’au jour où la<br />
procédure de délivrance est reprise, ni<br />
la demande de brevet européen ni la<br />
désignation de tout Etat contractant ne<br />
peuvent être retirées.<br />
Règle 16<br />
Procédure prévue dans les cas visés à<br />
l’article 61, paragraphe 1<br />
(1) La personne qui a droit à l’obtention<br />
du brevet européen ne peut faire usage<br />
des facultés qui lui sont ouvertes par<br />
l’article 61, paragraphe 1, que si :<br />
a) elle agit dans un délai de trois mois<br />
après que la décision qui lui reconnaît<br />
ce droit est passée en force de chose<br />
jugée, et si<br />
b) le brevet européen n’a pas encore été<br />
délivré.<br />
(2) Il ne peut être fait usage de ces<br />
facultés que pour les Etats contractants<br />
désignés dans la demande de brevet<br />
européen dans lesquels la décision a<br />
été rendue ou reconnue, ou doit être<br />
reconnue en vertu du protocole sur la<br />
reconnaissance.<br />
Règle 17<br />
Dépôt d’une nouvelle demande de<br />
brevet européen par la personne<br />
habilitée<br />
(1) Si la personne à laquelle a été<br />
reconnu le droit à l’obtention du brevet<br />
européen en vertu d’une décision<br />
passée en force de chose jugée dépose<br />
une nouvelle demande de brevet européen,<br />
conformément à l’article 61, paragraphe<br />
1 b), la demande initiale est<br />
réputée retirée à compter du dépôt de la<br />
nouvelle demande en ce qui concerne<br />
les Etats contractants désignés dans<br />
lesquels la décision a été rendue ou<br />
reconnue, ou doit être reconnue en vertu<br />
du protocole sur la reconnaissance.
