(3) Wird ein Prüfungsantrag gestellt,<br />
bevor dem Anmelder der europäische<br />
Recherchenbericht übermittelt wurde, so<br />
ist die Prüfungsabteilung vorbehaltlich<br />
des Absatzes 4 ab dem Zeitpunkt<br />
zuständig, an dem die Erklärung nach<br />
Regel 70 Absatz 2 beim Europäischen<br />
<strong>Patent</strong>amt eingeht.<br />
(4) Wird ein Prüfungsantrag gestellt,<br />
bevor dem Anmelder der europäische<br />
Recherchenbericht übermittelt wurde,<br />
und hat der Anmelder auf das Recht<br />
nach Regel 70 Absatz 2 verzichtet, so ist<br />
die Prüfungsabteilung ab dem Zeitpunkt<br />
zuständig, an dem der Recherchenbericht<br />
dem Anmelder übermittelt wird.<br />
Regel 11<br />
Geschäftsverteilung für die erste Instanz<br />
(1) Die technisch vorgebildeten Prüfer,<br />
die in Recherchen, Prüfungs oder<br />
Einspruchsabteilungen tätig sind,<br />
werden Direktionen zugewiesen. Auf<br />
diese Direktionen verteilt der Präsident<br />
des Europäischen <strong>Patent</strong>amts die<br />
Geschäfte in Anwendung der Internationalen<br />
Klassifikation.<br />
(2) Der Präsident des Europäischen<br />
<strong>Patent</strong>amts kann der Eingangsstelle,<br />
den Recherchen, Prüfungs und<br />
Einspruchsabteilungen sowie der<br />
Rechtsabteilung über die Zuständigkeit<br />
hinaus, die ihnen durch das Übereinkommen<br />
zugewiesen ist, weitere<br />
Aufgaben übertragen.<br />
(3) Der Präsident des Europäischen<br />
<strong>Patent</strong>amts kann mit der Wahrnehmung<br />
von den Recherchen, Prüfungs oder<br />
Einspruchsabteilungen obliegenden<br />
Geschäften, die technisch oder rechtlich<br />
keine Schwierigkeiten bereiten, auch<br />
Bedienstete betrauen, die keine technisch<br />
vorgebildeten oder rechtskundigen<br />
Prüfer sind.<br />
(3) If a request for examination is filed<br />
before the <strong>European</strong> search report has<br />
been transmitted to the applicant, the<br />
Examining Division shall, subject to<br />
paragraph 4, be responsible from the<br />
time when the <strong>European</strong> <strong>Patent</strong> <strong>Office</strong><br />
receives the indication under Rule 70,<br />
paragraph 2.<br />
(4) If a request for examination is filed<br />
before the <strong>European</strong> search report has<br />
been transmitted to the applicant, and if<br />
the applicant has waived the right under<br />
Rule 70, paragraph 2, the Examining<br />
Division shall be responsible from the<br />
time when the search report is transmitted<br />
to the applicant.<br />
Rule 11<br />
Allocation of duties to the departments of<br />
first instance<br />
(1) Technically qualified examiners<br />
acting as members of Search, Examining<br />
or Opposition Divisions shall be<br />
assigned to Directorates. The President<br />
of the <strong>European</strong> <strong>Patent</strong> <strong>Office</strong> shall<br />
allocate duties to these Directorates<br />
by reference to the international<br />
classification.<br />
(2) The President of the <strong>European</strong><br />
<strong>Patent</strong> <strong>Office</strong> may allocate further duties<br />
to the Receiving Section, the Search,<br />
Examining and Opposition Divisions,<br />
and the Legal Division, in addition to the<br />
responsibilities vested in them under the<br />
Convention.<br />
(3) The President of the <strong>European</strong><br />
<strong>Patent</strong> <strong>Office</strong> may entrust to employees<br />
who are not technically or legally qualified<br />
examiners the execution of duties<br />
falling to the Search, Examining or<br />
Opposition Divisions and involving no<br />
technical or legal difficulties.<br />

(3) Si une requête en examen est<br />

(4) Si une requête en examen est<br />
présentée avant que le rapport de<br />
recherche européenne ait été transmis<br />
au demandeur, et si ce dernier a<br />
renoncé au droit découlant de la règle<br />
70, paragraphe 2, la division d’examen<br />
est compétente dès que le rapport de<br />
recherche est transmis au demandeur.<br />
Règle 11<br />
Répartition des attributions entre les<br />
instances du premier degré<br />
(1) Les examinateurs techniciens agissant<br />
en qualité de membres des divisions<br />
de la recherche, d’examen ou<br />
d’opposition sont rattachés à des directions.<br />
Le Président de l’<strong>Office</strong> européen<br />
des brevets répartit les attributions entre<br />
ces directions par référence à la classification<br />
internationale.<br />
(2) Le Président de l’<strong>Office</strong> européen<br />
des brevets peut confier à la section de<br />
dépôt, aux divisions de la recherche,<br />
d’examen et d’opposition, ainsi qu’à la<br />
division juridique d’autres attributions en<br />
plus de celles qui leur sont dévolues par<br />
la convention.<br />
(3) Le Président de l’<strong>Office</strong> européen<br />
des brevets peut confier à des agents<br />
qui ne sont pas des examinateurs techniciens<br />
ou juristes des tâches incombant<br />
aux divisions de la recherche, d’examen<br />
ou d’opposition et ne présentant aucune<br />
difficulté technique ou juridique particulière.
