106 Regel 6 Einreichung von Übersetzungen und Gebührenermäßigung Sonderausgabe Nr. 1 ABl. EPA / Special edition No. 1 OJ EPO / Edition spéciale n° 1 JO OEB (1) Eine Übersetzung nach Artikel 14 Absatz 2 ist innerhalb von zwei Monaten nach Einreichung der europäischen Patentanmeldung einzureichen. (2) Eine Übersetzung nach Artikel 14 Absatz 4 ist innerhalb eines Monats nach Einreichung des Schriftstücks einzureichen. Dies gilt auch für Anträge nach Artikel 105a. Ist das Schriftstück ein Einspruch, eine Beschwerdeschrift, eine Beschwerdebegründung oder ein Antrag auf Überprüfung, so kann die Übersetzung innerhalb der Einspruchsoder Beschwerdefrist, der Frist für die Einreichung der Beschwerdebegründung oder der Frist für die Stellung des Überprüfungsantrags eingereicht werden, wenn die entsprechende Frist später abläuft. (3) Reicht eine in Artikel 14 Absatz 4 genannte Person eine europäische Patentanmeldung, einen Prüfungsantrag, einen Einspruch, eine Beschwerde, einen Überprüfungsantrag oder einen Antrag auf Beschränkung oder Widerruf in einer dort zugelassenen Sprache ein, so werden die Anmeldegebühr, die Prüfungsgebühr, die Einspruchsgebühr, die Beschwerdegebühr, die Gebühr für den Überprüfungsantrag oder die Beschränkungs oder Widerrufsgebühr nach Maßgabe der Gebührenordnung ermäßigt. Regel 7 Rechtliche Bedeutung der Übersetzung der europäischen Patentanmeldung Das Europäische Patentamt geht, soweit nicht der Gegenbeweis erbracht wird, für die Bestimmung, ob der Gegenstand der europäischen Patentanmeldung oder des europäischen Patents über den Inhalt der Anmeldung in der ursprünglich eingereichten Fassung hinausgeht, davon aus, dass die nach Artikel 14 Absatz 2 oder Regel 40 Absatz 3 eingereichte Übersetzung mit dem ursprünglichen Text der Anmeldung übereinstimmt. Rule 6 Filing of translations and reduction of fees (1) A translation under Article 14, paragraph 2, shall be filed within two months of filing the European patent application. (2) A translation under Article 14, paragraph 4, shall be filed within one month of filing the document. This shall also apply to requests under Article 105a. Where the document is a notice of opposition or appeal, or a statement of grounds of appeal, or a petition for review, the translation may be filed within the period for filing such a notice or statement or petition, if that period expires later. (3) Where a person referred to in Article 14, paragraph 4, files a European patent application, a request for examination, an opposition, an appeal, a petition for review or a request for limitation or revocation in a language admitted in that provision, the filing fee, examination fee, opposition fee, appeal fee, fee for the petition for review or the limitation or revocation fee shall be reduced in accordance with the Rules relating to Fees. Rule 7 Legal authenticity of the translation of the European patent application Unless evidence is provided to the contrary, the European Patent Office shall assume, for the purpose of determining whether the subject-matter of the European patent application or European patent extends beyond the content of the application as filed, that the translation filed under Article 14, paragraph 2, or Rule 40, paragraph 3, is in conformity with the original text of the application. 2007 Règle 6 Production des traductions et réduction des taxes (1)Latraductionprévueàl’article 14, paragraphe 2, doit être produite dans un délai de deux mois à compter du dépôt de la demande de brevet européen. (3) Lorsqu’unepersonneviséeàl’article 14, paragraphe 4, dépose une demande de brevet européen, présente une requête en examen, forme une opposition ou un recours ou présente une requête en révision, en limitation ou en révocation dans une langue autorisée dans cette disposition, la taxe de dépôt, la taxe d’examen, la taxe d’opposition, la taxe de recours, la taxe de requête en révision, la taxe de limitation ou la taxe de révocation est réduite conformément au règlement relatif aux taxes. Règle 7 Valeur juridique de la traduction de la demande de brevet européen Sauf preuve contraire, l’Office européen des brevets présume, pour déterminer si l’objet de la demande de brevet européen ou du brevet européen s’étend audelà du contenu de la demande telle qu’elle a été déposée, que la traduction produite conformément à l’article 14, paragraphe 2, ou à la règle 40, paragraphe 3, est conforme au texte original de la demande.

Abschnitt Allgemeines Regel 8 Patentklassifikation Das Europäische Patentamt benutzt die in Artikel 1 des Straßburger Abkommens über die Internationale Patentklassifikation vom 24. März 1971 vorgesehene Patentklassifikation, nachstehend als Internationale Klassifikation bezeichnet. Regel 9 Verwaltungsmäßige Gliederung des Europäischen Patentamts (1) Das Europäische Patentamt wird verwaltungsmäßig in Generaldirektionen untergliedert, denen die in Artikel 15 genannten Organe, die für Rechtsfragen und die für die innere Verwaltung des Amts geschaffenen Dienststellen zugeordnet werden. (2) Jede Generaldirektion wird von einem Vizepräsidenten geleitet. Der Verwaltungsrat entscheidet nach Anhörung des Präsidenten des Europäischen Patentamts über die Zuweisung eines VizepräsidentenaneineGeneraldirektion. Regel 10 Zuständigkeit der Eingangsstelle und der Prüfungsabteilung (1) Die Eingangsstelle ist so lange für die Eingangs und Formalprüfung einer europäischen Patentanmeldung zuständig, bis die Prüfungsabteilung für die Prüfung der europäischen Patentanmeldung nach Artikel 94 Absatz 1 zuständig wird. (2) Vorbehaltlich der Absätze 3 und 4 ist die Prüfungsabteilung ab dem Zeitpunkt für die Prüfung einer europäischen Patentanmeldung nach Artikel 94 Absatz 1 zuständig, an dem ein Prüfungsantrag gestellt wird. Chapter II Organisation of the European Patent Office Section 1 General matters Rule 8 Patent classification The European Patent Office shall use the classification referred to in Article 1 of the Strasbourg Agreement concerning the International Patent Classification of 24 March 1971, hereinafter referred to as the international classification. Rule 9 Administrative structure of the European Patent Office (1) The European Patent Office shall be divided administratively into DirectoratesGeneral, to which the departments specified in Article 15, and the services set up to deal with legal matters and the internal administration of the Office, shall be assigned. (2) Each Directorate-General shall be directed by a VicePresident. The assignment of a Vice-President to a DirectorateGeneral shall be decided by the Administrative Council, after the President of the European Patent Office has been consulted. Rule 10 Responsibility of the Receiving Section and the Examining Division (1) The Receiving Section shall be responsible for the examination on filing and the examination as to formal requirements of a European patent application up to the time when the Examining Division becomes responsible for the examination of the European patent application under Article 94, paragraph 1. (2) Subject to paragraphs 3 and 4, the Examining Division shall be responsible for the examination of a European patent application under Article 94, paragraph 1, from the time when a request for examination is filed. Chapitre II Organisation de l’Office européen des brevets Section I Dispositions générales Règle 8 Classification des brevets L’Office européen des brevets utilise la classification des brevets prévue à l’article premier de l’Arrangement de Strasbourg du 24 mars 1971 concernant la classification internationale des brevets, ciaprès dénommée classification internationale. Règle 9 Structure administrative de l’Office européen des brevets (1) L’Office européen des brevets est organisé sur le plan administratif en directions générales, auxquelles sont rattachés les instances visées à l’article 15 ainsi que les services créés pour traiter les questions juridiques et l’administration interne de l’Office. (2) Chaque direction générale est dirigée par un VicePrésident. L’affectation d’un VicePrésident à une direction générale est décidée par le Conseil d’administration, le Président de l’Office européen des brevets entendu. Règle 10 Compétences de la section de dépôt et de la division d’examen (1) La section de dépôt est compétente pour examiner une demande de brevet européen lors du dépôt et quant aux exigences de forme jusqu’au moment où la division d’examen devient compétente pour examiner la demande de brevet européen conformément à l’article 94, paragraphe 1. (2) Sous réserve des paragraphes 3 et 4, la division d’examen est compétente pour examiner une demande de brevet européen conformément à l’article 94, paragraphe 1, dès qu’une requête en examen est présentée.
