Kapitel I<br />
Allgemeine Vorschriften<br />
Regel 1<br />
Schriftliches Verfahren<br />
Im schriftlichen Verfahren vor dem Europäischen<br />
<strong>Patent</strong>amt ist das Erfordernis<br />
der Schriftform erfüllt, wenn sich der<br />
Inhalt der Unterlagen in lesbarer Form<br />
auf Papier reproduzieren lässt.<br />
Regel 2<br />
Einreichung von Unterlagen; Formvorschriften<br />
(1) Im Verfahren vor dem Europäischen<br />
<strong>Patent</strong>amt können Unterlagen durch<br />
unmittelbare Übergabe, durch die Post<br />
oder durch technische Einrichtungen zur<br />
Nachrichtenübermittlung eingereicht<br />
werden. Der Präsident des Europäischen<br />
<strong>Patent</strong>amts legt die näheren<br />
Einzelheiten und Bedingungen sowie<br />
gegebenenfalls besondere formale und<br />
technische Erfordernisse für die Einreichung<br />
von Unterlagen fest. Er kann<br />
insbesondere bestimmen, dass eine<br />
Bestätigung nachzureichen ist. Wird<br />
diese Bestätigung nicht rechtzeitig<br />
eingereicht, so wird die europäische<br />
<strong>Patent</strong>anmeldung zurückgewiesen;<br />
nachgereichte Unterlagen gelten als<br />
nicht eingegangen.<br />
(2) Wo im Übereinkommen bestimmt ist,<br />
dass ein Schriftstück zu unterzeichnen<br />
ist, kann dessen Authentizität durch<br />
eigenhändige Unterschrift oder andere<br />
geeignete Mittel bestätigt werden, deren<br />
Benutzung vom Präsidenten des Europäischen<br />
<strong>Patent</strong>amts gestattet wurde.<br />
Ein Schriftstück, das durch solche<br />
anderen Mittel authentifiziert worden ist,<br />
erfüllt die rechtlichen Erfordernisse der<br />
Unterschrift ebenso wie ein handschriftlich<br />
unterzeichnetes Schriftstück, das in<br />
Papierform eingereicht wurde.<br />

Chapter I<br />
General provisions<br />
Rule 1<br />
Written proceedings<br />
In written proceedings before the<br />
<strong>European</strong> <strong>Patent</strong> <strong>Office</strong>, the requirement<br />
to use the written form shall be satisfied<br />
if the content of the documents can be<br />
reproduced in a legible form on paper.<br />
Rule 2<br />
Filing of and formal requirements for<br />
documents<br />
(1) In proceedings before the <strong>European</strong><br />
<strong>Patent</strong> <strong>Office</strong>, documents may be filed<br />
by delivery by hand, by post or by technical<br />
means of communication. The<br />
President of the <strong>European</strong> <strong>Patent</strong> <strong>Office</strong><br />
shall lay down the details and conditions<br />
and, where appropriate, any special<br />
formal or technical requirements for the<br />
filing of documents. In particular, he may<br />
specify that confirmation must be<br />
supplied. If such confirmation is not<br />
supplied in due time, the <strong>European</strong><br />
patent application shall be refused;<br />
documents filed subsequently shall be<br />
deemed not to have been received.<br />
(2) Where the Convention provides that<br />
a document must be signed, the authenticity<br />
of the document may be confirmed<br />
by handwritten signature or other appropriate<br />
means the use of which has been<br />
permitted by the President of the<br />
<strong>European</strong> <strong>Patent</strong> <strong>Office</strong>. A document<br />
authenticated by such other means shall<br />
be deemed to meet the legal requirements<br />
of signature in the same way as a<br />
document bearing a handwritten signature<br />
which has been filed in paper form.<br />

Procédure écrite<br />
Dans la procédure écrite devant l’<strong>Office</strong><br />
européen des brevets, il est satisfait à<br />
l’exigence relative à l’utilisation de la<br />
forme écrite si le contenu des documents<br />
peut être reproduit lisiblement sur<br />
papier.<br />
Règle 2<br />
Dépôt des documents et exigences de<br />
forme auxquelles ils doivent satisfaire<br />
(1) Dans la procédure devant l’<strong>Office</strong><br />
européen des brevets, les documents<br />
peuvent être déposés par remise directe,<br />
par voie postale ou par des moyens<br />
techniques de communication. Le Président<br />
de l’<strong>Office</strong> européen des brevets<br />
arrête les modalités d’application et les<br />
conditions requises ainsi que, le cas<br />
échéant, des exigences de forme et<br />
des exigences techniques particulières<br />
régissant le dépôt de documents. Il peut<br />
en particulier prévoir qu’il y a lieu de<br />
produire une confirmation. Si cette<br />
confirmation n’est pas produite dans les<br />
délais, la demande de brevet européen<br />
est rejetée ; les documents produits ultérieurement<br />
sont réputés ne pas avoir été<br />
reçus.<br />
(2) Si la convention prévoit l’obligation<br />
de signer un document, l’authenticité de<br />
celui-ci peut être confirmée par une<br />
signature manuscrite ou par d’autres<br />
moyens appropriés dont l’utilisation a été<br />
autorisée par le Président de l’<strong>Office</strong><br />
européen des brevets. Un document<br />
authentifié par ces autres moyens est<br />
réputé remplir les conditions juridiques<br />
relatives à la signature au même titre<br />
qu’un document portant une signature<br />
manuscrite et déposé sur papier.
