Dezember 2006 ERSTER TEIL AUSFÜHRUNGSVORSCHRIFTEN ZUM ERSTEN TEIL DES ÜBEREINKOMMENS Kapitel I Allgemeine Vorschriften Regel 1 Schriftliches Verfahren Im schriftlichen Verfahren vor dem Europäischen Patentamt ist das Erfordernis der Schriftform erfüllt, wenn sich der Inhalt der Unterlagen in lesbarer Form auf Papier reproduzieren lässt. Regel 2 Einreichung von Unterlagen; Formvorschriften (1) Im Verfahren vor dem Europäischen Patentamt können Unterlagen durch unmittelbare Übergabe, durch die Post oder durch technische Einrichtungen zur Nachrichtenübermittlung eingereicht werden. Der Präsident des Europäischen Patentamts legt die näheren Einzelheiten und Bedingungen sowie gegebenenfalls besondere formale und technische Erfordernisse für die Einreichung von Unterlagen fest. Er kann insbesondere bestimmen, dass eine Bestätigung nachzureichen ist. Wird diese Bestätigung nicht rechtzeitig eingereicht, so wird die europäische Patentanmeldung zurückgewiesen; nachgereichte Unterlagen gelten als nicht eingegangen. (2) Wo im Übereinkommen bestimmt ist, dass ein Schriftstück zu unterzeichnen ist, kann dessen Authentizität durch eigenhändige Unterschrift oder andere geeignete Mittel bestätigt werden, deren Benutzung vom Präsidenten des Europäischen Patentamts gestattet wurde. Ein Schriftstück, das durch solche anderen Mittel authentifiziert worden ist, erfüllt die rechtlichen Erfordernisse der Unterschrift ebenso wie ein handschriftlich unterzeichnetes Schriftstück, das in Papierform eingereicht wurde. Implementing Regulations to the European Patent Convention 2000 as adopted by decision of the Administrative Council of 7 December 2006 PART I IMPLEMENTING REGULATIONS TO PART I OF THE CONVENTION Chapter I General provisions Rule 1 Written proceedings In written proceedings before the European Patent Office, the requirement to use the written form shall be satisfied if the content of the documents can be reproduced in a legible form on paper. Rule 2 Filing of and formal requirements for documents (1) In proceedings before the European Patent Office, documents may be filed by delivery by hand, by post or by technical means of communication. The President of the European Patent Office shall lay down the details and conditions and, where appropriate, any special formal or technical requirements for the filing of documents. In particular, he may specify that confirmation must be supplied. If such confirmation is not supplied in due time, the European patent application shall be refused; documents filed subsequently shall be deemed not to have been received. (2) Where the Convention provides that a document must be signed, the authenticity of the document may be confirmed by handwritten signature or other appropriate means the use of which has been permitted by the President of the European Patent Office. A document authenticated by such other means shall be deemed to meet the legal requirements of signature in the same way as a document bearing a handwritten signature which has been filed in paper form. Règlement d’exécution de la Convention sur le brevet européen 2000 tel qu’adopté par le Conseil d’administration dans sa décision du 7 décembre 2006 PREMIERE PARTIE DISPOSITIONS D’APPLICATION DE LA PREMIERE PARTIE DE LA CONVENTION Chapitre I Dispositions générales Règle 1 Procédure écrite Dans la procédure écrite devant l’Office européen des brevets, il est satisfait à l’exigence relative à l’utilisation de la forme écrite si le contenu des documents peut être reproduit lisiblement sur papier. Règle 2 Dépôt des documents et exigences de forme auxquelles ils doivent satisfaire (1) Dans la procédure devant l’Office européen des brevets, les documents peuvent être déposés par remise directe, par voie postale ou par des moyens techniques de communication. Le Président de l’Office européen des brevets arrête les modalités d’application et les conditions requises ainsi que, le cas échéant, des exigences de forme et des exigences techniques particulières régissant le dépôt de documents. Il peut en particulier prévoir qu’il y a lieu de produire une confirmation. Si cette confirmation n’est pas produite dans les délais, la demande de brevet européen est rejetée ; les documents produits ultérieurement sont réputés ne pas avoir été reçus. (2) Si la convention prévoit l’obligation de signer un document, l’authenticité de celui-ci peut être confirmée par une signature manuscrite ou par d’autres moyens appropriés dont l’utilisation a été autorisée par le Président de l’Office européen des brevets. Un document authentifié par ces autres moyens est réputé remplir les conditions juridiques relatives à la signature au même titre qu’un document portant une signature manuscrite et déposé sur papier.
