Les requftes des autorit~s allemandes seront adress6es au ministre de la Justice danois h Copenhague et celles des autorit~s danoises aux autorits centrales, figurant h l'annexe, des gouvernements des pays allemands comp~tents dans chaque cas. Les autorit~s administratives supremes de chacune des parties conserveront toutefois la facult6, en ce qui concerne l'envoi desdites requ~tes, de recourir chacune h l'interm~diaire de la ligation de leur pays aupr~s de l'autre partie. La ligation transmettra dans ce cas directement la requ&e h l'autorit6 centrale comp6tente de l'autre partie. C. Les autoritds des deux parties peuvent faire usage de leur propre langue nationale dans la correspondance avec les autorit&s de l'autre partie. D. L'accord ci-dessus, confirm6 par votre note de teneur identique de ce jour, entre imm~diatement en vigueur et peut 6tre d~nonc6 par chacune des deux parties avec un pr6avis de six mois. Au nom de mon gouvernement, j'ai l'honneur de constater qu'entre le Gouvernement danois er le Gouvernement allemand, il a 6t6 convenu ce qui suit: of both Parties shall be free to correspond direct with each other in regard to cases of extradition, the conveyance in transit of persons surrendered and other questions of legal co-operation in criminal matters; the possibility of recourse to the diplomatic channel shall not thereby be affected. The requests of the German authorities shall be sent to the Danish Ministry of Justice at Copenhagen, ant the requests of the Danish authorities to the central authorities of the Government of the German State competent to deal with the case, as indicated in the Annex. The supreme administrative authorities of each Party shall, however, have the right to send such requests through the legation of their country accredited to the other Party. The legation shall then transmit the request direct to the competent central authority of the other Party. C. The authorities of one Party may correspond with the authorities of the other in their own language. D. The foregoing agreement, confirmed by your Note of to-day of like tenor, shall come into force immediately and may be denounced by either Party on giving six months' notice. LE GOUVERNEMENT DANOIS et LE GOU- VERNEMENT ALLEMAND ont pris, en ce qui concerne la coop6ration judiciaire en mati6re p~nale, les engagements ci-apr~s : i o Ils s'assureront la r~ciprocit6 en ce sens que la presentation d'une demande d'extradition, de passage en transit d'un extrad6, de remise d'objets ou de toute autre coop6ration judiciaire en mati~re p6nale comporte co ipso l'assurance qu'inversement la cooperation d~sir6e sera accord~e sur la demande de l'autre partie. 20 Ils ne d~f reront au magistrat instructeur, ne puniront ni ne rtextraderont h un tiers Etat, sans le consentement de la Partie requise, un extrad6 ou un extrad6 passant en transit par leur territoire, en raison d'un acte commis avant l'extradition ou le passage en transit et pour lequel l'extradition ou le passage en transit n'a pas W accord6, et ils ne porteront pas non plus atteinte h la libert6 individuelle de la personne en question pour une cause ant~rieure h l'extradition on au passage de l'extrad6 en transit, h moins que ladite personne n'ait pas quitt6 le territoire du gouvernement requerant dans un d6lai d'un mois, h compter du jour de son 61argissement, ou qu'apr~s avoir quitt6 ce territoire elle y retourne ou soit h nouveau livr~e h ce pays par un gouvernement tiers. 30 Us sauvegarderont les droits des tiers sur les objets remis par le gouvernement requis et, en cas de r6serves formul6es au moment de la remise, ils restitueront imm6diatement, sur demande, les objets qui leur auront W remis. 40 Us ne poursuivront ni ne puniront les personnes, h quelque nationalit6 qu'elles appartiennent qui, avec l'aide du gouvernement requis, sont mises h la disposition des autorit~s du gouvernement requ6rant ou sont cities h comparaitre devant lesdites autorit6s, en qualit6 d'auteurs, co-auteurs, receleurs ou complices, h raison de l'infraction faisant l'objet de l'instruction ou d'une autre infraction commise avant que les inculp6s aient quitt6 le territoire du gouvernement requis ; ils ne porteront non plus pas atteinte h la libert6 individuelle desdites personnes pour toute autre cause ant~rieure, h moins qu'elles n'aient pas quitt6 le territoire du No. 2753 Lea'?ue of Nations - Treaty Series. THE DANISH GOVERNMENT and THE GERMAN GOVERNMENT undertake, as regards legal co-operation in criminal matters: (i) To accord each other reciprocity in as much as the presentation of a requisition for extradition the conveyance in transit of a person surrendered, the handing over of articles or any other form of legal co-operation in criminal matters shall afford an assurance that, in the opposite case, the desired co-operation shall be granted on the request of the other Party ; (2) Not to institute proceedings against, punish, or surrender to a third country, without the consent of the Party applied to, a person surrendered or conveyed in transit, for an offence committed before his extradition or conveyance in transit, other than that for which it was granted, nor to interfere with his personal freedom on other legal grounds which have arisen prior to his extradition or conveyance in transit, unless he fails to leave the territory of the Party making the application within one month from the date of his release, or returns after he has left the said territory, or is again surrendered by a third Government (3) To safeguard the rights of third parties to articles handed over by the Government applied to. And should reservation be made at the time they are handed over to return the said articles immediately upon request; (4) Not to institute proceedings against, or to punish persons, whatever their nationality, who, with the assistance of the Government applied, to, are placed at the disposal of the authorities of the Government making the application or summoned to appear before the said authorities as witnesses or experts, on the ground that such persons have committed or participated in the offence forming the subject of the enquiry or some other punishable offence committed before they left the territory of the Party applied to, or have acted as accessories after the fact or aided and abetted the offender, and not to interfere with their personal
