passage de l'extrad6 en transit, h moins<br />

que ladite personne n'ait pas quitt6 le<br />

territoire du gouvernement requ6rant dans<br />

un ddlai d'un mois, h compter du jour de<br />

son 6largissement, ou qu'apr~s avoir quitt6<br />

ce territoire elle y retourne ou soit h nouveau<br />

livrde h ce pays par un gouvernement<br />

tiers.<br />

30 Ils sauvegarderont les droits des tiers<br />

sur les objets remis par le gouvernement<br />

requis et, en cas de reserves formules au<br />

moment de la remise, ils restitueront<br />

immddiatement, sur demande, les objets<br />

qui leur auront 6t6 remis.<br />

40 Ils ne poursuivront ni ne puniront<br />

les personnes, h quelque nationalit6 qu'elles<br />

appartiennent qui, avec l'aide du gouvernement<br />

requis, sont mises h la disposition<br />

des autorit6s du Gouvernement requdrant<br />

ou sont cit6es h comparaitre devant lesdites<br />

autorit6s, en qualit6 d'auteurs, coauteurs,<br />

receleurs ou complices, h raison<br />

de l'infraction faisant l'obj et de l'instruction<br />

ou d'une autre infraction commise avant<br />

que les inculpds aient quitt6 le territoire<br />

du gouvernement requis ; ils ne porteront<br />

non plus pas atteints h la libert6 individuelle<br />

desdites personnes pour toute autre cause<br />

antdrieure, h moins qu'elles n'aient pas<br />

quitt6 le territo,re du gouvernement requdrant<br />

dans un ddlai d'une semaine h<br />

compter du jour oii elles ont 6t6 librdes<br />

et oii elles ont eu la possibilit6 de quitter<br />

le pays.<br />

50 Ils renonceront au remboursement<br />

des frais encourus par les autoritds du gouvernement<br />

requis, h l'exception des frais<br />

du passage en transit ainsi que des 6moluments<br />

et des d~bours affdrents aux experts.<br />

B. Conformdment h l'accord intervenu pr6c6demment,<br />

his extradition or conveyance in transit,<br />

other than that for which it was granted,<br />

nor to interfere with his personal freedom<br />

on other legal grounds which have arisen<br />

prior to his extradition or conveyance in<br />

transit, unless he fails to leave the territory<br />

of the Party making the application within<br />

one month from the date of his release,<br />

or returns after he has left the said territory,<br />

or is again surrendered by a third Government;<br />

(3) To safeguard the rights of third<br />

parties to articles handed over by the<br />

Government applied to, and should reservations<br />

be made at the time they are<br />

handed over to return the said article<br />

immediately upon request;<br />

(4) Not to institute proceedings against<br />

or to punish persons, whatever their<br />

nationality, who, with the assistance of<br />

the Government applied to, are placed<br />

at the disposal of the authorities of the<br />

Government making the application or<br />

summoned to appear before the said<br />

authorities as witnesses or experts, on the<br />

ground that such persons have commited<br />

or participated in the offence forming the<br />

subject of the enquiry or some other<br />

punishable offence committed before they<br />

left the territory of the Party applied<br />

to, or have acted as accessories after the<br />

fact or aided and abetted the offender, and<br />

not to interfere with their personal freedom<br />

on other legal grounds which have previously<br />

arisen, unless such persons fail to<br />

leave the territory of the Party making<br />

the application within one week from the<br />

day on which they are free and it is possible<br />

for them to do so ;<br />

(5) To waive their claims to a refund<br />

of the expenses incurred by the authorities<br />

of the Government applied to, with the<br />

exception of the cost of conveyance in<br />

transit or temporary surrender of the<br />

person in question, and experts' fees and<br />

expenses.<br />

B. In accordance with the previous agreement,<br />

the supreme administrative authorities
