2. Les autorit6s administratives supremes<br />
des deux Etats pourront, d'un commun accord,<br />
admettre des d~rogations h la r~glementation<br />
du paragraphe premier, soit dans des cas<br />
isol6s, soit pour un ensemble de cas.<br />
3. Lorsqu'un accident survenu dans un des<br />
Etats tombe sous les lois d'assurance-accidents<br />
de l'autre Etat, les prescriptions de ces lois<br />
sont 6galement applicables dans la mesure ou<br />
il s'agit d'autres demandes en reparation qui,<br />
en raison de l'accident, sont formul~es conformoment<br />
aux lois du premier Etat; il en va<br />
de m~me lorsqu'une entreprise n'est assujettie<br />

dans l'un des deux Etats. Cette disposition<br />
s'appliquera par analogie aux autres branches<br />
d'assurance sociale 6num6r~es h l'article premier.<br />
4. Lorsque, conform6ment aux dispositions<br />
qui precedent, pour une entreprise (un employeur)<br />
ayant son si~ge (domicile) dans l'un<br />
des Etats, le droit de l'autre Etat est applicable<br />
une occupation dans cet Etat, ladite occupation<br />
sera, au sens dudit droit, assimil~e k une<br />
entreprise.<br />
5. L'application des prescriptions l6gales de<br />
l'un des Etats, conform6ment aux paragraphes<br />
premier, 2 et 4, a 6galement pour effet de donner<br />
competence aux institutions, autorit6s et tribunaux<br />
de l'assurance sociale de cet Etat pour<br />
l'application de l'assurance sociale.<br />
6. Lorsque des cotisations, qui eussent dfi<br />
8tre vers~es h l'institution d'assurance de l'un<br />
des Etats, sont vers~es t l'institution d'assurance<br />
de l'autre Etat, cette derni~re institution<br />
d'assurance demeure comp~tente tant qu'un<br />
litige relatif la competence n'aura pas 6te<br />
l~galement tranch6. Le r~tablissement de l'6tat<br />
juridique n'est effectif que pour l'avenir.<br />
7. Les dispositions du present article ne sont<br />
pas applicables h l'6quipage des bateaux (remorqueurs,<br />
etc.) affect6s la navigation sur<br />
le Danube, ni aux autres personnes occupies<br />
en permanence sur ces bateaux, ni h l'quipage<br />

employees of the heads and members<br />
and other officials of the services or departments<br />
mentioned. Nevertheless, as regards<br />
sickness insurance the legislative provisions<br />
of the State. in which they are employed<br />
shall apply, provided that the employer<br />
requests this.<br />
2. The supreme administrative authorities<br />
of the two States may by mutual agreement<br />
make other regulations differing from those<br />
laid down in No. i for individual cases or for<br />
a group of cases.<br />
3. If an accident occurring in one State is<br />
covered by the accident insurance laws of the<br />
other State, the provisions of the said laws<br />
shall also apply in so far as relates to other<br />
claims for compensation which may be made<br />
on account of the accident in conformity<br />
with the laws of the first State ; this provision<br />
shall also apply when an establishment is<br />
covered by the accident insurance legislation<br />
of only one of the two States. This provision<br />
shall apply to the other branches of social<br />
insurance specified in Article I, mutatis mutandis.<br />
4. If in accordance with the preceding provisions<br />
in the case of an establishment (employer)<br />
which (who) has its head office (his place of<br />
residence) in one State, the law of the other<br />
State is applicable to an employment in that<br />
State, the employment shall be placed on the<br />
same footing as an establishment for the<br />
purposes of that law.<br />
5. The application of the legislative provisions<br />
of one State in pursuance of Nos. I, 2<br />
and 4 shall also entail the competence of the<br />
social insurance carriers, authorities and courts<br />
of that State in connection with the administration<br />
of social insurance.<br />
6. If contributions have been paid to an insurance<br />
carrier in one State although they should<br />
have been paid to an insurance carrier in the<br />
other State, the former insurance carrier shall<br />
be deemed to be competent until such time<br />
as any dispute concerning competence has<br />
been decided in a legally binding manner.<br />
The re-establishment of the statutory position<br />
shall apply as regards the future only.<br />
7. The provisions of this Article shall not<br />
apply to the crews of vessels (tugs, etc.) plying<br />
on the Danube and other persons permanently<br />
employed on such vessels nor to the crews<br />
of aircraft. The supreme administrative autho-
