Article 9<br />

1. Invalidity pensions shall be awarded, in accordance with the laws and<br />

regulations applying to the person concerned at the time of the accident or when<br />

it is first medically certified that he is suffering from an illness leading to invalidity,<br />

by the institution which is competent under such laws and regulations.<br />

2. Nevertheless, if, at the beginning of the calendar quarter during which<br />

the illness occurred, the invalid person had not been insured for at least one<br />

year under the laws and regulations referred to in paragraph 1, and if, having<br />

regard to the provisions of Article 8, he fulfils the conditions required for entitlement<br />

to an invalidity pension under the laws and regulations of another contracting<br />

country under the scheme of which he was previously insured, he shall<br />

receive from the competent institution of such other country the invalidity<br />

pension provided by the laws and regulations of that country. If, by application<br />

of these provisions, an insured person is entitled to a pension under the laws<br />

and regulations of two or more contracting countries other than the one to the<br />

laws and regulations of which paragraph 1 refers, the laws and regulations under<br />

which he was last insured shall alone apply.<br />

3. The provisions of paragraph 2 above shall not apply where the invalidity<br />

is the result of an accident.<br />

4. The invalidity pension shall be entirely at the cost of the institution<br />

referred to in paragraphs 1 or 2 above.<br />

5. The provisions of paragraphs 1, 2, 3 and 4 of this Article may be derogated<br />

from by agreements between two or more contracting countries and by<br />

virtue of which invalidity pensions, or parts of pensions, to be charged to the<br />

institutions of each of these countries shall be determined in accordance with the<br />

provisions of Article 11 of the present Agreement.<br />

Article 10<br />

1. An invalidity pension shall be converted, if the case arises, into an<br />

old-age pension in accordance with the conditions provided by the laws and<br />

regulations under which it has been awarded. In case of such conversion, the<br />

provisions of Section 3 below shall apply.<br />

2. A German invalidity pension shall be deemed in all cases to be an oldage<br />

pension as from age 65 for the purposes of this Agreement.<br />

Section 3. Old-Age and Death (Pensions)<br />

Article 11<br />

1. In the case of persons who have been insured successively or alternately<br />

under the schemes of two or more contracting countries, periods spent under<br />
