308 <strong>United</strong> <strong>Nations</strong> - <strong>Treaty</strong> <strong>Series</strong> 1953<br />

Greece and institutions established in Greece, as also in regard to all other<br />

properties, including shares debentures and other securities belonging to persons<br />

in Greece and to institutions established in Greece, the title to which has<br />

in the meantime been vested in him, provided that such monies or other properties<br />

have not already been -returned to the rightful owners before the coming into<br />

effect of this Agreement.<br />

3. The Custodian shall also furnish the said representatives with particulars<br />

of all claims registered in his office by persons and institutions in India<br />

against persons in Greece and against institutions established in Greece and<br />

of any claims registered in respect of property in Greece belonging to persons<br />

in India and to institutions established in India.<br />

4. The Government of Greece shall make arrangements for the verification<br />

of all particulars supplied to them under paragraph 2 by the Government<br />

of India and shall in due course inform the Custodian which of the items included<br />

in the return of monies and other properties held on behalf of persons in<br />

Greece were registered in the names of German or Japanese nationals, or<br />

nationals of any other State with which the Government of India may for the<br />

time being be at war or was at war on the 31st December 1945.<br />

5. The monies referred to in paragraph 2 which are certified by the Government<br />

of Greece to be free from enemy interest shall be transferred en bloc<br />

to that Government. As far as other properties are concerned the Custodian<br />

of Enemy Property shall release such properties in each case on receipt of a<br />

request to that effect from the Government of Greece accompanied by a certificate<br />

that no enemy interest is involved in the said properties.<br />

6. The Government of Greece hereby agree to indemnify the Custodian<br />

against any claims from any sources whatever in regard to all monies paid over<br />

to that Government and all property, including securities, released by him to<br />

that Government or to persons resident in Greece at that Government's request.<br />

7. The Custodian shall not be held liable for payment to the Greek Government<br />

of monies which have not been deposited with him by the debtors in<br />

India or which have been so deposited but which were released to the owners<br />

before the coming into force of this Agreement. In so far as such monies are<br />

due to institutions established in Greece which, in the opinion of the Government<br />

of India, are not owned by German or Japanese nationals, or nationals of<br />

any other State with which Government of India may for the time being be at<br />

war or was at war on the 31st December 1945, the Custodian undertakes, however,<br />

to assist the Government of Greece to the best of his ability with the collection<br />

of such monies as should have been paid but were not thus paid.<br />
