102 United Nations - Treaty Series 1953 ANNEXE Article 1 La r~gle g~n6rale 6tablie par les paragraphes 3 et 4 de l'article 11 de l'Accord doit 6tre interpr&te comme permettant aux institutions d'assurance-pension de la R~publique f~drale d'Allemagne de calculer les prestations h leur charge en proc~dant de la mani~re suivante : a) les prestations ou 6lments de prestations variables avec le temps pass6 en assurance, et qui sont fixes exclusivement en fonction des p~riodes accomplies sous la 16gislation allemande, ne subissent pas de reduction; b) les prestations ou 6lments de prestations fixes ind~pendamment du temps pass6 en assurance seront r~duits au prorata de la dur~e des p&iodes entrant en compte pour le calcul des prestations d'aprs la lgislation allemande par rapport h la dur~e totale des p~riodes entrant en compte pour le calcul des prestations d'apr~s les 16gislations de toutes les institutions int~ress~es. Article 2 Pour l'interpr&ation des paragraphes 3 et 4 de l'article 8 et des paragraphes 3 et 4 de l'article 11 de l'Accord, les p~riodes d'assurance ou assimil~es pass~es dans un autre pays contractant doivent 6tre consid~r~es comme des p~riodes de cotisations au regard de la legislation n~erlandaise. 1953 Nations Unies - Recuei des Traitds 103 ANNEX Article 1 The general rule laid down by paragraphs 3 and 4 of Article 11 of the Agreement shall be interpreted as permitting the pension insurance institutions of the Federal Republic of Germany to calculate the benefits for which they are liable by proceeding as follows : (a) benefits or benefit components which vary with the time spent in insurance and are determined with sole regard to the period spent under German laws and regulations shall be payable without reduction; and (b) benefits or benefit components which are determined independently of the time spent in insurance shall be reduced in the ratio of the periods counted for the purpose of reckoning benefits according to German laws and regulations to the total of the periods counted for the purpose of reckoning benefits according to the laws and regulations governing all the institutions concerned. Article 2 For the interpretation of paragraphs 3 and 4 of Article 8 and of paragraphs 3 and 4 of Article 11 of the Agreement, insurance periods or equivalent periods spent in another contracting country shall be deemed to be periods of contribution for the purposes of the laws and regulations of the Netherlands. ANNEX<br />
Article 1<br />
The general rule laid down by paragraphs 3 and 4 of Article 11 of the Agreement<br />
