has .and the honour to make the following declaration on behalf of the Government<br />

When depositing its Instrument of Accession, the Government of the Islamic Republic<br />

of Pakistan made a declaration which reads as follows:<br />

"The Government of the Islamic Republic of Pakistan declares that nothing in this<br />

Convention shall be applicable to struggles, including armed struggle, for the realization of<br />

right of self- determination launched against any alien or foreign occupation or domination,<br />

in accordance with the rules of international law. This interpretation is consistent with Article<br />

53 of the Vienna Convention on the Law of Treaties 1969 which provi<strong>des</strong> that an<br />

agreement or treaty concluded in conflict with an existing jus cogen or preemptory norm of<br />

international law is void and, the right of self-determination is universally recognized as a<br />

jus cogen."<br />

In this connection, the Government of Japan draws attention to the provisions of Article<br />

5 of the Convention, according to which each State Party shall adopt such measures as<br />

may be necessary, including, where appropriate, domestic legislation, to ensure that criminal<br />

acts within the scope of this Convention, in particular where they are intended or calculated<br />

to provoke a state of terror in the general public or in a group of persons or<br />

particular persons, are under no circumstances justifiable by considerations of a political,<br />

philosophical, ideological, racial, ethnic, religious or other similar nature and are punished<br />

by penalties consistent with their grave nature.<br />

The Government of Japan considers that the declaration made by the Islamic Republic<br />

of Pakistan seeks to exclude struggles, including armed struggle, for the realization of right<br />

of self-determination launched against any alien or foreign occupation or domination from<br />
