No. 3598. AGREEMENT 3 BETWEEN THE NETHERLANDS<br />

AND ITALY FOR THE ESTABLISHMENT AND OPERA-<br />

TION OF SCHEDULED AIR TRANSPORT SERVICES.<br />

SIGNED AT ROME, ON 4 MARCH 1950<br />

The Government of the Netherlands and the Government of the Italian<br />

Republic desiring to conclude an agreement for the purpose of establishing, on<br />

a basis of reciprocity, scheduled air services between their respective territories,<br />

have agreed as follows :<br />

Article 1<br />

For the purposes of the present Agreement and its Annex, 4 except as otherwise<br />

provided in the text :<br />

(a) the term " aeronautical authorities " shall mean:<br />

in the case of Italy<br />

the " Ministero della Difesa - Aeronautica - Direzione Generale dell'-<br />

Aviazione Civile e del Traffico Aereo " or any person or body authorized to<br />

perform the functions presently exercised by the " Ministero della Difesa -<br />

Aeronautica - Direzione Generale dell'Aviazione Civile e Traffico Aereo ",<br />

in the case of the Netherlands<br />

the " Directeur Generaal van de Rijksluchtvaartdienst " or any person or<br />

body authorized to perform the functions presently exercised by the " Directeur<br />

Generaal van de Rijksluchtvaartdienst ";<br />

(b) the term " designated airline " shall mean an airline which the aeronautical<br />

authorities of one of the Contracting Parties have notified, in writing, to the<br />

aeronautical authorities of the other Contracting Party as being the airline<br />

designated by that Party, subject to the provisions of Article III of the present<br />

Agreement, to operate the routes mentioned in said notification;<br />

(c) the term " territory " shall have the meaning specified in Article 2 of the<br />

Chicago Convention on International Civil Aviation (December 7th, 1944);5<br />

(d) the definitions given in paragraphs a), b) and d) of Article 96 of the<br />

Chicago Convention on International Civil Aviation (December 7th, 1944) shall<br />

apply to the present Agreement.<br />
