Av~ar mur<strong>de</strong>r case poses disturbing questions<br />

ANKARA- The trial of the six suspects involved in the kid-<br />
napping and killing of Serif A v~ar continues at Diyarbakir<br />
Cnminal Court No. 3. "<br />
The <strong>de</strong>ath sentence for Orner Güngör, the actual killer, and<br />
20 years each for government infonner Mesut Mehm<strong>et</strong>oglu<br />
and village guards Fevzi Gökçek, y~ar Günbal1, Aziz Erbey<br />
and Zevat Akçil has been requested by the chief prosecutor.<br />
A court case against the seventh person, claImed to ~e a<br />
hilJh level security officer has not been filed. The mystenous<br />
"s~venth man" was claimed to be a member of the<br />
Gendarmerie Intelligence and Anti-Terrorism (IITEM) organization<br />
by c!ose relatives of the victim. This. is why ?is i<strong>de</strong>ntity<br />
has remamed a secr<strong>et</strong>, they say. They claIm that It was he<br />
su~rvised the operation. .<br />
Orner Güngör, the head of the team of Village ~ards, ~ho<br />
shot the victim twice in the head, gave the followms versIOn<br />
in his <strong>de</strong>fence: "We arrived in Diyarbakir one day pnor to the<br />
inci<strong>de</strong>nt. After spending the night at the guest house of the<br />
Gendarmerie, we went to the Police <strong>de</strong>partment. There I m<strong>et</strong><br />
a man called Ferit Akçay.<br />
I knew him from before and he infonned me where Av~ar<br />
was to be found. We went to the so-called shop to pick up<br />
Av~ar but he resisted and wanted u~ to call the police. F~vzi<br />
Gökçek and Aziz Erbey went outsi<strong>de</strong> and calleâ the police.<br />
Mesut Mehm<strong>et</strong>oglu and another p,erson came in, showed their<br />
official ID and took Av~ar away. ' .<br />
First' Mehm<strong>et</strong> ~erif Av~ar was taken to the GendarI?ene<br />
Provincial headquarters, Güngör said .."Later ~e took him. to<br />
a shabby building locateq 19 km outsl~e the City on the Lice<br />
highway, and here the seventh man, who wore glasses,<br />

talked with him. Then Mesut called me in and wanted me to<br />

The head of the village guards did not mention anything<br />
more about the "seventh man".<br />
The chairman of the Contemporary Jurists' Association,<br />
~enal Saruhan, who has taken up the case on behalf of the<br />
Av~arfamily, requested the transfer of the case to Anb.ra in a<br />
written statement sent to the Justice Ministry.<br />
Saruhan claimed that both witnesses and <strong>de</strong>fendants had<br />
been subjected to pressure and threats.<br />
The ~erif A v~ar case has brought some of the sinister<br />
aspects of ..mystery mur<strong>de</strong>rs into the light of day, and the testimony<br />
of Orner Güngör has raised many question marks, and<br />
not only in the minds of the relatives of the mur<strong>de</strong>red man.<br />
In a previous statement the A v~ar family had given to the<br />
TON, they spoke of the contradictory statements on where<br />
exactly Av~ar had been taken and, especially, of the i<strong>de</strong>ntity<br />
of the crucial "seventh man".<br />
~erif Av~ar had been taken away by this uni<strong>de</strong>ntified person<br />
and also by a former member of the PKK turned<br />
infonner.<br />
This raises the question as to wh<strong>et</strong>her ex-PKK members<br />
are being employed in covert government operations. Other<br />
questions inclu<strong>de</strong>: Where did the special ID cards come<br />
from? What is the real role of Mesut Mehm<strong>et</strong>oglu in all this?<br />
Can VillalJe Guards be used to make arrests for the security<br />
forces? my did the Village Guards accompany the group<br />
when it left the Gendarmerie HQ?<br />
All of these questions need answers. The trial continues.<br />

ANKARA, 9 juil (AFP) - 58 personnes ont été tuées <strong>de</strong>puis jeudi dans le<br />
sud-est anatolien dans <strong>de</strong>s accrochages avec <strong>de</strong>s séparatistes kur<strong>de</strong>s ou <strong>de</strong>s<br />
attaques <strong>de</strong> rebelles kur<strong>de</strong>s contre <strong>de</strong>s villages, a-t-on appris samedi <strong>de</strong><br />
sources officielles.<br />
Il s'agit <strong>de</strong> 45 membres du Parti <strong>de</strong>s travailleurs du Kurdistan (PKK,<br />
séparatiste), <strong>de</strong> huit membres <strong>de</strong>s forces <strong>de</strong> l'ordre <strong>et</strong> <strong>de</strong> 5 civils. Les<br />
inci<strong>de</strong>nts meurtriers ont eu lieu dans les régions <strong>de</strong> Diyarbakir, Bitlis,<br />
Hakkari, Siirt <strong>et</strong> Mardin, selon la super-préfecture <strong>de</strong> Diyarbakir (sud-est),<br />
responsable <strong>de</strong> la lutte contre le PKK.<br />
Au total 103 personnes - 86 rebelles, 9 civils <strong>et</strong> 8 membres <strong>de</strong>s forces <strong>de</strong><br />
l'ordre - ont été tuées <strong>de</strong>puis le début du mois dans c<strong>et</strong>te région à majorité<br />
kur<strong>de</strong>, selon une compilation <strong>de</strong> l'AFP <strong>de</strong>puis <strong>de</strong>s chiffres officiels.<br />
