Av~ar murder case poses disturbing questions

ANKARA- The trial of the six suspects involved in the kid-
napping and killing of Serif A v~ar continues at Diyarbakir
Cnminal Court No. 3. "
The death sentence for Orner Güngör, the actual killer, and
20 years each for government infonner Mesut Mehmetoglu
and village guards Fevzi Gökçek, y~ar Günbal1, Aziz Erbey
and Zevat Akçil has been requested by the chief prosecutor.
A court case against the seventh person, claImed to ~e a
hilJh level security officer has not been filed. The mystenous
"s~venth man" was claimed to be a member of the
Gendarmerie Intelligence and Anti-Terrorism (IITEM) organization
by c!ose relatives of the victim. This. is why ?is identity
has remamed a secret, they say. They claIm that It was he
su~rvised the operation. .
Orner Güngör, the head of the team of Village ~ards, ~ho
shot the victim twice in the head, gave the followms versIOn
in his defence: "We arrived in Diyarbakir one day pnor to the
incident. After spending the night at the guest house of the
Gendarmerie, we went to the Police department. There I met
a man called Ferit Akçay.
I knew him from before and he infonned me where Av~ar
was to be found. We went to the so-called shop to pick up
Av~ar but he resisted and wanted u~ to call the police. F~vzi
Gökçek and Aziz Erbey went outside and calleâ the police.
Mesut Mehmetoglu and another p,erson came in, showed their
official ID and took Av~ar away. ' .
First' Mehmet ~erif Av~ar was taken to the GendarI?ene
Provincial headquarters, Güngör said .."Later ~e took him. to
a shabby building locateq 19 km outsl~e the City on the Lice
highway, and here the seventh man, who wore glasses,

talked with him. Then Mesut called me in and wanted me to
shoot Av~ar and I obeyed orders."
The head of the village guards did not mention anything
more about the "seventh man".
The chairman of the Contemporary Jurists' Association,
~enal Saruhan, who has taken up the case on behalf of the
Av~arfamily, requested the transfer of the case to Anb.ra in a
written statement sent to the Justice Ministry.
Saruhan claimed that both witnesses and defendants had
been subjected to pressure and threats.
The ~erif A v~ar case has brought some of the sinister
aspects of ..mystery murders into the light of day, and the testimony
of Orner Güngör has raised many question marks, and
not only in the minds of the relatives of the murdered man.
In a previous statement the A v~ar family had given to the
TON, they spoke of the contradictory statements on where
exactly Av~ar had been taken and, especially, of the identity
of the crucial "seventh man".
~erif Av~ar had been taken away by this unidentified person
and also by a former member of the PKK turned
infonner.
This raises the question as to whether ex-PKK members
are being employed in covert government operations. Other
questions include: Where did the special ID cards come
from? What is the real role of Mesut Mehmetoglu in all this?
Can VillalJe Guards be used to make arrests for the security
forces? my did the Village Guards accompany the group
when it left the Gendarmerie HQ?
All of these questions need answers. The trial continues.

ANKARA, 9 juil (AFP) - 58 personnes ont été tuées depuis jeudi dans le
sud-est anatolien dans des accrochages avec des séparatistes kurdes ou des
attaques de rebelles kurdes contre des villages, a-t-on appris samedi de
sources officielles.
Il s'agit de 45 membres du Parti des travailleurs du Kurdistan (PKK,
séparatiste), de huit membres des forces de l'ordre et de 5 civils. Les
incidents meurtriers ont eu lieu dans les régions de Diyarbakir, Bitlis,
Hakkari, Siirt et Mardin, selon la super-préfecture de Diyarbakir (sud-est),
responsable de la lutte contre le PKK.
Au total 103 personnes - 86 rebelles, 9 civils et 8 membres des forces de
l'ordre - ont été tuées depuis le début du mois dans cette région à majorité
kurde, selon une compilation de l'AFP depuis des chiffres officiels.
