Özden responded to criticisms that
the Constitutional Court had acted
hastily in the DEP case even though

constitutional Article 8'+, which calls
for the removal of the parliamentary
membership of a deputy of a closed
p~. said: "In Turkey, it is regrettable
to see opponents of the constitutional
judiciary and furthermore to
hear that this IS a requirement of
beino a democrat. Our court is the
guard of a state governed by the rule
of law. A decision is not made upon
an order. nor can it be the subject of
a baroain. The court does not act
with prejudice."
POinting out that abiding by the
existin¥ rules was a prerequiSite of
beino lOyal to democracy and that
the decisions of the Constitutional
Court were binding. Özden said,
"None of the criticisms directed
againstthe Constitutional Court
regarding the closure of the political
parties are justified. It is the
Constitution which causes one to
lose his parliamentary membership.
The Constitutional Court has fulfilled
its duty.
The court never discusses or
defends its own rulings. Once the
decision is made, relevant officials
assume the responsibility. Resistance
to the judiciary is not praised but
condemned. If the decisions of the
judiciary are altered, obstructed or
not fulfilled due to political decisions,
then democracy becomes socalled
democracy."
Noting that Parliament did nor
need to pass a decision for ending
the memberships of the deputies
whose memberships had automati-'
cally ended in accordance with the
)].1ling of the Constitutional Court,
Ozden said:
"I hope that the changes which are
necessary to be made in the
ConstitutIOn are carried out within
this perspective. If the mandatory changes
are essential, those who have made that
become possible will not be forgotten. The
peculiarity and the characteristics of constitutional
Article 84 regarding the closure of
the political parties should be taken into
consideration, as well as whether a possible
change in that article will be retroactive or
not and whether a lost parliamentary membershipcan
be regained without having to
hold an election by adding a provisional
article in the Constitution,"

Manifestation de 15.000 Kurdes à Francfort contre la pOlitique de la
Turquie
FRANCFORT (Allemagne), 24 juin (AFP) - Environ 15.000 Kurdes, selon une
estimation de la pOlice, ont manifesté, samedi matin à FranCfort, en faveur
d'une solution politique pacifique à la question kurde en Turquie.
La police, qui a déployé plus de 2.000 hommes, a distribué des tracts en
allemand et en turc demandant aux manifestants de ne pas brandir de symboles
du PKK (Parti des travailleurs dU'Kurdistan), interdit en Allemagne.
Le PKK et plusieurs associations qui lui servaient de couverture ont été
interdits en novembre 1993 par les autorités allemandes, après une série
d'incidents violents provoqués par les Kurdes d'Allemagne.
Les manifestants, venus de toute l'Allemagne et de plusieurs pays
européens, sont arrivés à bord de 80 cars et de 200 voitures particulières.
La manifestation, qui devait durer jusqu'en fin d'après midi, répond à un
appel, lancé par une organisation humanitaire Medico international, par deux
avocats et par un groupe d'amitié germano-kurde de Francfort.
Début avril, de spectaculaires et parfois violentes manifestations
avaient été organisées dans plusieurs villes d'Allemagne à l'occasion de la
fête du Newroz, le nouvel an kurde.
