Party (DEP) is to appealsoon<br />

for the release of its chainnan Ya~ar<br />

Kaya who was arrestéd on Thursday because<br />

of a speech he ma<strong>de</strong> last month in<br />

northern Iraq. .<br />

DEP <strong>de</strong>puty chainnan Murat Bozlàk<br />

claimed in a written statement on Friday<br />

that the State Security Court <strong>de</strong>cision.<br />

against Kaya was"both illegal and violated<br />

<strong>de</strong>mocratic principles." .<br />

. Kaya was arrested on a court ruling<br />

,and is being charged with making separatist<br />

propaganda during a speech he had<br />

ma<strong>de</strong> in northern Iraq at the congress of<br />

. thé Iraqi Kurdistan Democrat Party<br />

(KDP). . .<br />

"Asi<strong>de</strong> from military coup periods, this<br />

is the first time in the history of Turkish<br />

<strong>de</strong>mocracy that a political party lea<strong>de</strong>r<br />

has been mterrogated by the police and<br />

later arrested," Bozlak's statement said.<br />

Bozlak also noted that the Supreme<br />

Court of Appeal prosecutor had the authority<br />

to monitor the activities of political<br />

parties and said that in Kaya's case,<br />

this authority had been used by the State<br />

Security Court prosecutor Nusr<strong>et</strong> DemiraI.<br />

He recalled that DEP <strong>de</strong>puty Mehm<strong>et</strong><br />

. Sincar had recently beenshot by imi<strong>de</strong>ntified<br />

gunmen in Batman and it was "un- .<br />

fortunate" for Kaya to be arrested soon<br />

after this inci<strong>de</strong>nt. "This is topoke into a .<br />

bleeding wound," he said. ..<br />

Bozlak ad<strong>de</strong>d that the party would appeal<br />

against the arrest "although the<strong>de</strong>cisian<br />

is. of a political' nature" and would<br />

use .all of its legal rights to/secur<strong>et</strong>he<br />

freedomof Kaya. Kaya was arrested in<br />

the midst .of a campaign targ<strong>et</strong>ing pro-<br />

Kurdish activists in Turkey. In the past<br />

.two years, a total of 54.pro-Kurdish activists<br />

have been killed and at least 15<br />

journalists reporting on the Kurdish issue<br />

have been assassinated.<br />

The latest killing was that of Sincat:on<br />

contad with the outlawed Kurdistan Workers'<br />

Party (PKK) over the release of two German<br />

citizens earlier this week. The tourists were abducted<br />

in eastern Turkey last month. ..<br />

Dr. Jurgen Oesterhelt, Gennan ambassador to<br />

Turkey, told TDN that its government neither established<br />

any contact with the organization, nor<br />

exerted any influence on its re~resentatives, nor<br />

sent any messages, nor tried to mfluence thém in .<br />

secondary ways, like sending unofficial envoys.<br />

"We do not negotiate with terrorists, and we<br />

have not negotiated with terrorists this time," the<br />

Ambassador said. "The abduction of innocent<br />

tourists is unjust and not acceptable." Recalling<br />

that Gennany had ma<strong>de</strong> public that if any harm<br />

came to the hostages it would hold thé PKK responsible,<br />

Dr. Oesterhelt said that Germany<br />

relied on the Turkish government t{)secure the<br />

release of the tourists.<br />

. Theambassador pointed out that Turkish security<br />

operations had continued operations in the<br />

area of the abduction and "it was un<strong>de</strong>rstandable"<br />

that it was difficult to control the difficult terrain<br />

of the East.<br />

"But we are hapry that our citizens were saved<br />

without any harm, he ad<strong>de</strong>d.<br />

Albrecht Christoph Lehmann and Henry Butler,<br />

two Gennan cil1zens, were abducted by PKK<br />

militants last month near Mount Agn (Ararat) as<br />

a part of the organization's campaign to sabotage<br />

Turkey's tourism revenues ($4 billion in 1992)<br />

and gain international attention through negotiations<br />

to release the hostages. .<br />

More than one million German tourists visited<br />

Turkey last year; nearly one third of the number<br />

of all tourists visiting Turkey. Gennany has already<br />

<strong>de</strong>clared that it doesn't recommend travel<br />

to some eastern and southeastern provinces of<br />

Turkey because of the security risk. The provinces<br />

are: Hakkari, ~Irnak, Mardm, Siirt, Bitlis, Van,<br />

Diyarbaktr, Adlyaman, Elazlg, Bingöl, Mu~, Batman,<br />

Tunceli and Igdlr, where the PKK is most<br />

active. .<br />

The <strong>de</strong>claration ma<strong>de</strong> by the Gennan govern-.<br />

ment in July 1993, following the PKK bombings<br />

in resort of Antalya in June; says German citizens<br />

. who insist on travelling to the mentioned provinces<br />

are doing so at their own risk. The German<br />

&~vernmentalso rec.ommendsthat its citizens not<br />

arive at night within the mentioned provinces.<br />

as the Ambassador <strong>de</strong>fines it. The assessment for<br />

that started after the arson attack in Sivas last July.<br />

Ozgür Gün<strong>de</strong>m which is àlso owned by<br />

Kaya. All cases aim to close down the<br />

daily and a second hearingwill be held<br />
