) "processing of personal data" shall me<strong>an</strong> <strong>an</strong>y operation or set of<br />

operations which is performed upon personal data, such as collection,<br />

recording, org<strong>an</strong>isation, s<strong>to</strong>rage, alteration, retrieval, consultation, use,<br />

disclosure, combination, blocking, erasure or destruction, as well as<br />

tr<strong>an</strong>sfers of personal data across national borders;<br />

c) "data controller" shall me<strong>an</strong> the natural or legal person, authority or <strong>an</strong>y<br />

other body which determines the purposes <strong>an</strong>d me<strong>an</strong>s of the processing<br />

of personal data.<br />

ARTICLE 63<br />

Principles <strong>an</strong>d general rules<br />

The Parties agree that the legal <strong>an</strong>d regula<strong>to</strong>ry regimes <strong>an</strong>d administrative capacity<br />

<strong>to</strong> be established shall, at a minimum, include the following content principles <strong>an</strong>d<br />

enforcement mech<strong>an</strong>isms:<br />

a) Content principles<br />

i) The purpose limitation principle – data should be processed for a<br />

specific purpose <strong>an</strong>d subsequently used or further communicated<br />

only insofar as this is not incompatible <strong>with</strong> the purpose of the<br />

tr<strong>an</strong>sfer. The only exemptions <strong>to</strong> these rights should be those<br />

provided for in legislation <strong>an</strong>d necessary in a democratic society<br />

for the protection of import<strong>an</strong>t public interests.<br />

ii) The data quality <strong>an</strong>d proportionality principle – data should be<br />

accurate <strong>an</strong>d, where necessary, kept up <strong>to</strong> date. The data should<br />

be adequate, relev<strong>an</strong>t <strong>an</strong>d not excessive in relation <strong>to</strong> the purposes<br />

for which they are tr<strong>an</strong>sferred or further processed.<br />

iii) The tr<strong>an</strong>sparency principle – individuals should be provided <strong>with</strong><br />

information as <strong>to</strong> the purpose of the processing <strong>an</strong>d the identity of<br />

the data controller in the third country, <strong>an</strong>d other information<br />

insofar as this is necessary <strong>to</strong> ensure fairness. The only<br />

exemptions <strong>to</strong> these rights should be those provided for in<br />

legislation <strong>an</strong>d necessary in a democratic society for the<br />

protection of import<strong>an</strong>t public interests.<br />

iv) The security principle – the data controller should take technical<br />

<strong>an</strong>d org<strong>an</strong>isational security measures that are appropriate <strong>to</strong> the<br />

risks presented by the processing. Any person acting under the<br />

authority of the data controller, including a processor, must not<br />

process data except on instructions from the controller.<br />
